ARCHAEO- LOGICAL Initiated by: The City of Newport Beach P�— Community Development Director Hogan presented APPROVED the archaeological policies to the Commission for review as well as the guidelines for archaeological and paleontological procedures which had been. previously adopted by the Commission on July 18, 1974. Mariam Parks, liaison between the Citizens Environ- mental Quality Committee and the City on archaeo- logical and paleontological matters, appeared before the Commission and commented on the pro- posed archaeological procedures. She read suggest ad revisions to the guidelines and procedures from Dr. Keith Dixon, Professor of Archaeology, State California University, Long Beach, and presented the Commission with an interim list of four archaeologists whom she felt were qualified to act as consultants to the City. He was informed that the Planning Commission had already recommended paleontological policies and his remarks should be directed to the City Council when this matter comes before them for their consideration. Planning Commission discussed the various policies and suggested amendments as well as minimum qua.lif - cations which should be specified. X Following discussion, motion was made recommending X X X X to the City Council that the Archaeological Guide - X X N lines and Procedures be adopted with the following amendments: 1. That an introductory paragraph be included in the guidelines which states "That the City shall, through its planning policies and permit conditions, insure the preservation of archaeological and paleontological resources and require that impact be mitigated in accordance with the California Environmental Quality Act, 1970." 2. That wherever the words "preserve archaeology" appear; the words "in context where practicabl " shall be added. 3. That minimum qualifications of a consulting archaeologist shall include one or more of the fol'lowing criteria: Verifiable experience or education in survey, excavation, analysis and interpretation of archaeological findings; or associated with a university, museum or founda tion having a recognized archaeological progra and associated within that program; and finall that determination regarding qualifications shall be made by the Director of Community Development. Item #2 Request to permit the construction of a thirteen USE story hotel complex that includes restaurants, PERMIT meeting rooms, retail shops, banquet rooms and 15 recreational facilities. Zone: P -C, Applicant: Atlas Hotels, Inc., San Diego Owner: Koll Center Newport, Newport Beach Community Development Director Hogan reviewed the staff report in detail and especially the parking requirements and recommendations of the staff based on the parking studies made by Governmental Professional Services. Environmental Coordinator Foley appeared before the Commission to review the demand studies for evening parking as well as mid -day parking and answered questions regarding same. He advised that the studies were based on the assumption that the hotel would be operating at 95% occupancy of the guest rooms, that 75% of the room occupancy would be from conferences and business meetings, • and that 25% would be from individual businessmen, commercial travelers, etc. Parking requirements during peak hours were based on the assumption . that all of the conference and business meeting people would be on the premises and that half of the commercial people would be on the premises. He also commented on the hours of operation and use of the various restaurant facilities through- out the hotel. Planning Commission discussed with the staff the recommended parking which consisted of 577 on -site parking spaces and an off -site parking agreement covering the additional 130 spaces required, makin a total of 707 spaces which appeared to be suffici nt, based on the parking demand studies. Hank Mohle of Governmental Professional Services appeared before the Commission to answer questions relative to the parking demand studies and stated he felt that the hotel would be operated as a corporate meeting hotel.as indicated, since this is what they do best and are experts in this particular.,field. • Public hearing was opened in connection with this matter. Ernest Wilson, of Langdon and Wilson, appeared before the Commission and reviewed Block A of Page 3. He concurred with the staff report and recommended conditions of approval including the off -site parking conditions. Terry Brown, President of Atlas Hotels, appeared before the Commission to explain the operations of Atlas Hotels and reviewed the proposed plans and elevations which are designed towards the corporate group market. He also stated concurrent to the condition of an off -site parking agreement, for an additional 130 spaces, however he still . felt they would not be necessary. Ernest Wilson reviewed the parking in Koll Center Newport with the Commission advising of the free flow of traffic with proper signing throughout the parking area. He also reviewed the location of the off -site parking spaces which would be adjacent to the on -site parking. There being no others desiring to appear and be heard, the public hearing was closed. That development shall be in substantial con- formance with the approved plot plan, floor plans, and elevations, except as noted in Condition No. 2. 2. That 577 spaces be provided on -site and that a off -site parking agreement providing an addi- tional 130 spaces after 6:00 P.M. on an adjace t site be approved by the City. Council. 3. That all conditions of approval for Resub- division No. 457 shall be fulfilled. 4. That all illumination in the offstreet parking areas shall be shielded or directed so as to confine direct rays to the subject property. 5. All driveway approach locations and widths, parking lot interior circulation, and the location of signs, trees, and other landscape features adjacent to the approved driveways . shall be approved by the Traffic Engineer. 6. Planning Commission discussed placing a time limit on the request in order that same may be reviewed to determine the appropriateness of the development in the future. Public hearing was opened in connection with this matter. George Koteles, Architect, appeared before the Planning Commission and concurred with all of the conditions except No. 2 pertaining to landscaping. He presented the Commission with a revised plan indicating a 10 foot landscaped area at the westerly end of the property, elimination of a 3 foot planter in front of the proposed showroom, and continuous planting in front of the display lot. He also requested that the condition which requires installation of planting prior to issuanc of a building permit be changed inasmuch as the landscaping would be destroyed if installed prior to construction of the proposed building. Don Brinkerhoff, Landscape Architect, appeared before the Commission and reviewed drawings indi- cating various stages of growth of the landscaping and screening material. There being no others desiring to appear and be heard, the public hearing was closed. Commissioner Parker disclosed for the record that the landscape architect was a client and relation of his, however, did not feel those facts inter- fered with his objectivity in this matter. X Following discussion, motion was made that in X Y X X connection with Variance No. 1043, Planning X X Commission make the findings that there are excep- tional and extraordinary circumstances applying to the land; that the granting of the application is necessary for the preservation of substantial pro- perty rights; and that the granting of the varianc will not, under the circumstances of the particula matter, materially affect adversely the health or safety of persons residing or working in the neighborhood and will not be detrimental to the public welfare or injurious to property or improve- ments in the neighborhood; therefore Variance No. 1043 was approved subject to the following condi- tion: 1. That development shall be in substantial conformance with the approved plot plan and sections. Item #16 Proposal to amend Sections 20.02.140, 20.02.150, AMENDMENT NO. 436 20.02.160, 20.02.170, and 20.02.180 as they per- tain to the definition of the terms "Dwelling Unit ", "Dwelling, Single - Family ", "Dwelling, Two- Family or Duplex ", "Dwelling, Multiple ", and "Family ". APPROVED Initiated by: City of Newport Beach Community Development Director Hogan reviewed the proposed amendment with the Planning Commission and explained the problems which have existed under the present definitions of "family" and . Public hearing was opened in connection with this matter and there being no one desiring to appear and be heard, the public hearing was closed. Planning Commission discussed the matter of design and whether or not any criteria regarding same should be included in the definition of dwelling unit. They also discussed the term family as it pertained to employees. The various problems of code enforcement were also discussed both as they pertain to the present code as well as the propose amendment. Commissioner Agee requested and received permis- sion to be excused from the Planning Commission meeting of August 15, 1974.
