TEN NEWPORT BEACH CITY PLANNING COMMISSION met in adjourned
regalar session Wednesday, August 2, 1939. 7:30 p.m in the
' Council Chambers, City Hall; Temporary Chairman Briggs
presiding.

Aset. City Engineer Siegel attended and stated that he
had been deputized by Com. Patterson to represent him at
this meeting, since Com. Patterson was out of tows and could
not attend.
After some discussion, it was agreed by those present
that Mr. Siegel, representing Com. Patterson could be con-
sidered as a member in order to make a quorum..

Commissioners present: Briggs, Seeger, Williams, Bettis,
Mr. Siegel, representing Com. Patterson. .

Hodgkinson.
MINMES -
Com. lotus moved that the minutes of meetings held
July 19 and 20, 1939 be approved as written. Secodded by
Com. $Gager. Motion carried and so ordered by the Chairman.
HEARINGS -
VARIANCE APPLICATION OF ZILA ROBBINS
Application presented by Leon Yale, contractor for Zila
Robbins for a 50%. 21 ft. rear yard setback variance on Lot 11
Blk 12, Sao 1, Balboa Island was read by the Secretary. Hs
stated that the hearing had been duly advertised, plans posted
notices of hearing sent to surrounding property: owners and
all other requifemente of the ordinance complied with.
Be also stated that no written or verbal protests had been
received.
Chairman declared the hearing open for discussion.
No one was present to protest the granting of this
variance.
Plot plan and elevations of the proposed building were
examined by the commission.
Mr. Bllerbroek, representing the applicant, explained
the location of existing buildings and that the garage on
the lot across the alley is entefed from the street; therefore,
allowing a 21 ft. setback variance on this lot will not
interfere with adjoining properties. The size and shape of
this lot makes the granting of this variance necessary.
Cam, lotus moved the adoption of Resolution No. 159
recommending to the City Council that a 50%. 2} ft, rear yard
setback variance be granted to Me Robbins on Lot 1, Blk 12, ?;
Sec 1, Balboa Island and that "the same be transmitted to the
City Council by the Secretary and a copy filed as part of the
Minutes of this meeting. Seconded by Com. Williams.

Motion carried and so ordered by the Chairman.
TEATATI1B MAP OF SOBDIaISIOE OF LOT 49, TRACT 742, BALBOA
ISLAND. -
Mr. Jack Woolley, Engineer, submitted for appproval by
the Commission a tentative map of Lot 49, Tract 742, Balboa
Island which is being divided into 5 lots. He explained
that this piece of property was originally planned as a hotel
site. The present owner, Mr. Harvey of Santa Ana, desires
to divide it up into lots so that he may realise something
from his investment and wishes to cut it up into 5 lots.
Although the lots do not cori'!'aiu the ,4000 sq. "ft. required
by Ordinance 440, they average 3000 sq. ft. and are larger
In area than any ofthe surrounding property. It is not like a
new subdivision where the subdivider should be repaired to
hold to the ordinance. The condition of small lots already
exists in this neighborhood and these lots will be larger, than
any in the vicinity and will be bettering conditions.
Com. Briggs stated that he would be in favor of approv-
ing the tract if there was some legal way to do so. However,
the ordinance requires 4000 sq. ft. in R -2.
Mr. Woolley read Section 11 of Ordinance 440 and felt
that the commission could approve the map under the provisions
of this section.
Com. Estue stated that there are very few places in
Newport Beach not already subdivided into small lots. He
saw no reason to require this subdivider to hold strictly
to the desiouated area when all of the surrounding property
was divided into kuch °smallar' lots.
Com. Seeger was of the opinion that if the property
was divided into larger parcels the lots would be of greater
value.
Mr. Siegel stated that this is not a desirable piece of -
property, since all of the garages of the Bay front houses
face the.streets surrounding it. It will probably be built
up with small homes. Lots 1, 2 and 3 are large late and are
the most desirable, large houses could be built on these
lots.
Mr. Siegel moved that the tentative map of the sub-
division of Lot 49, Tract 742, Balboa Island be approved as
submitted. Seconded by Com. Williams.

TENTATIIE MAP OF TRACT 1007/ -
Mr. Siegel presented the tentative map of Tract 1007
for reversion to acreage and stated that this map was pre-
viously approved by the Planning Commission but that the time

has expired for recording so that it must be re- approved.
Secretary stated that. according to the records, We
map was approved March 2, 1935 with the recommendation that,
an easement for walk purposes along the north side of the
property be designated.' He moved that the tentative map of
Tract 1007 be approved with the same recommendation that
accompanied the approval when it was transmitted to the
City Council on March 2, 1935. Seconded by Com. Estus.
Motion carried and so ordered by the Chairman.
CORRESPONDENCE
Secretary read a letter from the Pacific Electric Bail-
way Co. inquiring if the 25 ft. setback line of E1 Bayo
Tract has been permanently established.'
Com. Stager moved that the Secretary be instructed to
answer this communication explaining the disposition made
of their previous application. Seconded by Com. Estus.
Motion carried and so ordered.
Secretary read a letter from Mr. C. R. Purr, Secretary
of the Huntington Beach Planning Commission requesting a
copy of the zoning ordinance.
Com. Seeger moved that the Secretary be instructed to
send a copy of Ordinance 440 to Mr. Purr and also to offer
to be of any assistance possible to this newly organized
Body. Seconded by Com. Williams. Motion carried and so
ordered.
Secretary announced receipt of 2 communications from
the Division of State Highways in reference to planting on
Coast Righway. These he presented to Com. Williams.
ADJOURNMENT
On motion of Com. Estus seconded by Com. Williams
and carried the meeting adjourned.
