Zone: R -3 -B Applicant: Estate Builders International, Newport Beach Owner: Same as Applicant Engineer: McIntire & Quiros, Inc., Santa Ana Planning Commission discussed this matter with the staff including a study required by the State of California and authorized by the City of Newport Beach relative to inundation of the property below Big Canyon Reservoir; the preparation of an Environmental Impact Report, the contents thereof, and the addition of any other conditions which may be needed as a result of the review of said Environmental Impact Report; density of the pro- perty and of the surrounding area; and re-wording • of Condition No. 1 recommended in the staff report. Hamilton Smith, representative of Estate Builders International, appeared before the Planning Com- mission and answered questions relative to the request. Motion X Following discussion, Tentative Map Tract 8406 was All Ayes approved subject to the following conditions: 1. That prior to the issuance of a grading permit or the approval of the Final Map, whichever should come first, the subdivider shall comple e an initial study to determine the impact that this project may have on the environment. In addition, the subdivider shall submit either a Negative Declaration or a Draft Environmental Impact Report for review by the City pursuant to City Council Policy K -3. 2. That residential development on this parcel shall not exceed forty -two dwelling units. 3. That development plans (including landscape an irrigation plans) for the open landscaped area • on the site shall be submitted to the Director of Parks, Beaches & Recreation for Th review. developer shall make a presentation before the Parks, Beaches & Recreation Commission of said development plans for its approval. That the boundary of the final tract map be checked by the County Surveyor before being submitted to the City for approval. 7. That the water capital improvement acreage fee be paid, and that storage capacity in San Joaquin Hills Reservoir equal to one maximum day's demand be dedicated to the City. 8. That all grading be in accordance with grading plans and reports approved by the Public Works . Director, and a qualified soils engineer shall certify that the grading has been completed according to the plans and the requirements of the grading ordinance. Permanent reproducible copies of the "as- built" grading plans on standard size sheets shall be furnished to the Public Works Department. Special attention shall be given to erosion control measures necessary to prevent siltatio and sedimentation caused by storm water runoff during the course of the grading work. 9. That all vehicular access rights to MacArthur Boulevard be relinquished to the City of Newport. Beach. 10. That the interior street system conform to the City's private street policy regarding street widths, turnaround radii, centerline radii, etc., except where modifications are approved by the Public Works Department. The structural pavement sections shall be reviewed and approved by the Public Works Department. 11. That the construction of the interior street • system be inspected by the Public Works Department, and the standard plan check and inspection fees be paid. Page 5. That public utility easements to be dedicate to the City have a minimum width of ten feet with wider easements provided where required by the Public Works Department. 13. That the design and location of the water an sewer systems be subject to further review and ultimate approval by the Public Works Director for those protions to be dedicated to the Ci Wherever possible, the water and sewer lines, sewer manholes and cleanouts, gate valves, and other appurtenances shall be located in the paved areas of the private streets. Access way to those facilities outside street pavement areas shall be provided with a surface treatment adequate for use by maintenance vehicles during all weather conditions. 14. That all street parkway trees be planted in accordance with the standards of the Parks, Beaches and Recreation Department and that the standard tree inspection fee be paid. 15. That fire fighting facilities, such as proper water mains and fire hydrants, must be installed as approved by the Fire Department and Public Works Department. Access for fire apparatus must be provided as approved by the Fire Department. Neither the owner nor any other persons desired to appear and be heard in connection with this matter, therefore the Chairman closed the public hearing. X Planning Commission moved that Use Permit No. 1134 be revoked and the matter be forwarded to the City Council together with the following recommenda- tions: 1. That Use Permit Application No. 1134 be revoke . 2. That all existing structures shall be removed from the premises. 3. That all underground storage tanks shall eithe be removed or emptied and filled with a materi 1 meeting the approval of the Building Official. 4. That a demolition permit be obtained from the Department of Community Development and that all demolition be completed within a period not to exceed ninety days from the date of final determination of this action. Item B -5 Request extension of time permitted relative to EXTENSION allowing the addition of a second apartment to an existing nonconforming building with commercial OF USE PERMIT uses on the first floor and one apartment on the 1513 second floor. That development shall be in substantial conformance with the approved plot plan, except for minor modifications which may be approved by the Director of Community Develop- ment. 2. That two off - street parking spaces per unit be provided. 3. Conformance with the Uniform Building Code. 4. Maintenance of eight foot vertical clearance for the projecting portion. Item B -6 Request to permit live entertainment in conjunc- USE tion with an existing restaurant in the M -1 PERMIT District. 16 Location: Lots 1 through 6, Block 429, APPROVED Lancaster's Addition, located at C70NDI- 3010 Lafayette Street, on the east TI0- LLY side of Lafayette Street between 30th Street and 31st Street in the "Cannery ". Zone: M -1 Applicant: Western Canners Co., Inc., Newport Beach Owner: Western Canners, Ltd., Costa Mesa The recommended conditions of approval were discussed by the Planning Commission. Public hearing was opened in connection with this matter. Bill Donovan, partner, appeared before the Planning Commission representing the applicant, and stated they are in agreement with the recommended condi- tions. That there be no more than three entertainers at any one time. 2. That no brass or percussion instruments or instruments requiring electric amplification shall be used. 3. That this approval be for a period of two years, and any extension shall be subject to the approval of the Modifications Committee. Item B -7 Request to amend a portion of Districting Map No. AMENDMENT 37 from a C -N -H District to an R -3 District and to NOS. 9T accept a Negative Declaration. CONT. TO Location: Portion of Lot "B ", Tract 3867, and AUZUST T6 a portion of abandoned Bayside Drive, located on the south side of Bayside Drive, westerly of Marine Avenue and the Balboa Island Bridge Zone: C -N -H Applicant: McLain Development Co., Los Angeles Owner: The Irvine Co., Newport Beach Public hearing was opened in connection with this matter. Robert Bein representing McLain Development Co: appeared before the Planning Commission and questioned the recommended 10 foot setback on Bayside Drive. He stated that one corner of the northerly building was located 7 feet from Bayside Drive and requested that if the.10 foot setback was established, a modification be granted for the encroachment. He reviewed the plot plan with the Commission and answered questions relative to access, parking, density, use of the property for residential purposes rather than commercial or other uses because of the configuration and grade of the lots, and public access to the bay. Planning Commission discussion of the project with the Staff included traffic in the area and its affect on the signal at Jamboree Road and Bayside Drive and provision for public access and use adjacent to the channel and bay. Charles Thornback appeared before the Planning Commission representing a number of boat owners in the existing slips adjacent to the property and questioned the continued use of the slips by the public. He was advised that the use would probabl be precluded due to the lack of public parking. Larry Moore, General Planning Administrator with The Irvine Company appeared before the Planning Commission and expressed concern relative to the use of the remnant parcel of land created by the construction of the channel to Promontory Bay and the legal ramifications which may be involved. There being no others desiring to appear and be heard, the public hearing was closed. Motion X Following discussion, Planning Commission adopted All Ayes Resolution No. 816 recommending to the City Counci that Amendment No. 381 be approved. Item B -11 Request to create one parcel of land for develop - RESUB- ment. Owner: Same as applicant Engineer: Williamson & Schmid, Santa Ana Tim Strader for Koll Center Newport appeared befor the Planning Commission and stated agreement with the conditions as recommended by the staff. Motion X Following discussion, Planning Commission approved All Ayes Resubdivision Application No. 399 subject to the following conditions: 1. That Amendment No. 381 shall be approved by the City Council. 2. That a parcel map be filed. 3. That all improvements be constructed as required by ordinance and the Public Works Department. 4. That sewer service for this parcel be provided . by connecting to an existing 8" V.C.P. lateral extending into the property from MacArthur Boulevard. That an instrument, satisfactory to the City Attorney and Public Works Department, be recorded to guarantee access across Lot 5 from Von Karman Avenue to Parcel No. 1. Such pro- visions are necessary because vehicular access rights were relinquished and dedicated to the City of Newport Beach by the Final Map of Tract No. 7953. 6.: That the storm drain easement to be dedicated across the property be fifteen feet wide. 7. That all applicable conditions of approval of Final Map Tract 7953 (i.e.,stree.t trees, etc.) be fulfilled. Request to consider an amendment to Title 20 of th Newport Beach Municipal Code as it pertains to offstreet parking requirements for residential uses. Initiated by: The City of Newport Beach Community Development Director Hogan reviewed the staff report and the proposed ordinance with the Planning Commission. Commissioner Rosener presented an additional alternative for consideration whereby parking spaces are based on the number of rooms. regardless of kind of room, excluding bathrooms, to wit: 1 parking space for 1 room unit, 1.5 parking spaces for 2 room unit, 2 parking spaces for 3 room unit, 2 parking spaces for 4 room unit, 3 parking spaces for 5 or more rooms. Public hearing was opened in connection with this matter. Margo Skilling, resident of West Newport, appeared before the Planning Commission in favor of the square footage concept as outlined in the staff report as she felt it was easier to determine the square footage rather than the number of rooms of a structure. Glen Martin appeared before the Planning Commissio also in favor of the square footage concept and requested clarification of the section on non- conforming uses. Page 13. Motion X Planning Commission continued the public hearing All Ayes to August 16, 1973. ADDITIONAL BUSINESS: Motion X Planning Commission reviewed the plans and All Ayes established the grade for construction purposes on property located at 518 -520 Iris Avenue, in Corona del Mar, at a plane running between the alley and Iris Avenue, parallel with 3rd Avenue. Motion X Planning Commission adopted Resolution No. 817, All Ayes setting a public hearing for September 6, 1973 to consider an amendment to Chapters 19.12 and 19.16 of the Newport Beach Municipal Code as they pertai to Tentative and Final Subdivision Maps.
