Thomas withdraw his Substitute Motion.
Commissioner Thomas then withdrew his Substitute
Motion.
Original Motion was then voted on, which MOAN
FAILED.
Motion was made to approve Amendment No. 524, with
the following changes to the proposed Ordinance:
1) 1.5 buildable as in proposed Amendment No. 524
2) Item "C" as proposed in Amendment No. 524 3)
Delete Item "D ", as.proposed in Amendment No. 524
4) Substitute for proposed Item "D ", "The area. of
that portion of a building.or buildings which ex-
ceeds a maximum height of seventeen feet (17 ft.)
or an average height of thirteen feet (13 ft.)
shall not exceed thi.rty -three and one third percen
(33 l/3 %) of the buildable area of the lot: 6) De-

the Motion, as the Ordinance would be com-
prised in part by architects that have a
vested interest, to which Commissioner
Beek agreed, due to his feeling that the
residents of Corona del Mar should also
have a part in comprising this Ordinance.

Initially, there was a long.discussion to post-
pone this. item.
Motion was made to postpone agenda .item nos. 2,
3, 4, and 5 to the end of the meeting.
Mr. Morrissey of Ford - Aerospace and Communicatio
Corporation appeared before the Planning
Commission. He reviewed the revised development
plan for the project site. Mr. Morrissey indi-
cated that.the revised plan called for the
development of 331,000 sq.ft. of industrial, 250
single family detached homes with a minimum
6000 sq.ft. lot size, a public park exactly
as previously proposed and 50 attached homes at
the intersection of Jamboree Road and Ford Road.
He indicated that they had examined an alternati
of 100 low- income units in place of the 50
attached units.
Joe Stucker, Daon Southwest Corporation,
presented the details of his company's affordable
housing proposal to the Planning Commission.
He indicated that within the limited time -
frames.they had not been able to address all the
complex issues related to affordable housing.
Mr. Stucker noted that Orange County provides
density bonuses for affordable housing, but
that it is in conflict with City goalls
for this project. He noted the County also
waives building codes and park dedication codes
to provide viable affordable housing opportun-
ities.
Mr. Stucker indicated that Daon Southwest Cor-
poration had looked at how the private.sector
by itself could provide affordable housing
opportunities within. the City of Newport Beach.
He noted that the cost of the units (100
attached) at the intersection of.Jamboree Road
and Ford Road without any profit to the developer
would be over $100,000.00 even with subsidy
from the detached single fami.ly homes.

Based upon this i.nformation, he noted that
without government subsidy provision of affbrd=
able housing in this location, it is not
feasible. At this time, he presented a low -
moderate rent schedule to the Planning Commission
and reviewed its contents.
Mt. Stucker presented a concept of providing off -
site affordable housing based upon a set of
guidelines mutually acceptable to the City of
Newport Beach aft-.d the applicants. He notedjthat
the advantage of no increase in density was`
possible..
Mr. Stucker reviewed the traffic effect of the
revised proposal: He noted that -the project as
proposed would not exceed the 30% rule until
1990 and even at total build -out of the site
would only exceed.the 30% by 50,000 sq.ft.
Commissioner Beek questioned why it was feasible
• to provide existing units and not the construc-
tion of new homes from a financial view.
Mr. Stucker indicated that` the difference from a
financial view lies in replacement costs diff-
erential. He then went on to review and compare
traffic impacts of the project. He also noted tha
no homes would be located within the 65 CNEL
either existing or proposed, noting that cars
will be required to be less noisy in the future.
Finally, he noted that the Applicants would
be providing '$1,600,000 in off - site:improve-ments
in conjunction with- project approval.
Chairman Balalis asked if all streets withiln
the project are designed as private streets.
Mr. Stucker indicated that they were with the
exception of.the entry street off Bison Avelnue
to the -Public Park. The •App:licants then
summarized the revised project and.asked that:
.1.) Resubdivision proposed condition no. 41 be
deleted.; 2.) Tentative Map condition no. 46 be
deleted; 3.) The language of condition nos.
43 and 48 on pages 20 and 22 respectively be
. changed from "for a structure" to "for a silte."

Richard V. Hogan at this point reviewed the var-
ious conditions dealing with "sewer capacity"
for the Planning Commission and Applicants;
Mr.. Morrissey indicated that they have no pro-;
blem with the drafted conditions related to
sewer capacities. He then requested that if the
Planning Commission approves this project, that
the approval become the bottom line and that the
not be subject to further reductions in General
Plan Amendment 79 -1.
Richard V. Hogan stated that this could be
accomplished if the Planning Commission so
desired.
Chairman Balalis stated that this was
not at the Planning Commission's option, but
would be decided by the City Council.
Commissioner Cokas requested information on
the control of off-site rentals.
Mr. Stucker responded that the procedures have
been developed by Orange County and would be
accomplished through a.non- profit corporation.

Commissioner Cokas questio.ned what the applicant
were referring to in terms of "hard- costs."
Mr. Stucker responded with the examples of roof
failure; or those increases directly related to
maintenance. The approach would be similar to
a homeowner's association setting up for maint-
enance expenses.
Commissioner McLaughlin questioned the namei of
the non-profit organization.
Mr. Stucker responded it was the Orange Couinty
Community Housing Corporation.
Commissioner Thomas questioned on membership.
Mr. Morrissey reviewed the Corporation's member-
ship.

Commissioner McLaughlin asked if the applicants
had met recently with representatives of this
non_ profit group.
Mr. Morrissey responded that they had met.3 time
with them.
Chairman Balalis asked if Ford - Aerospace Company
employees would be given 1st priority on the
units..
Mr. Morrissey responded that they would.
Commissioner Allen questioned applicants on
location of road improvement costs.
Mr. Morrissey noted that $1,600.00 would be
spent adjacent to the site and $86,000.00 re-
mote from the site.
. Commissioner Allen stated.that the $1,600.010
would have been required even without the
Traffic Phasing Ordinance and only an.additional
$86,000.00 with it.
Mr. Stucker noted that even though improvements
were only adjacent to the site, they would
benefit the City as a whole.
Chairman Balalis questioned if the City of
Newport Beach would have other road related
financial burdens adjacent to this site.
Don Webb responded that this project complete the
Master Plan of Arterial Highways in this area.
Commissioner Thomas asked who owns the rental
units.presently.. Mr. Stucker responded that
Daon Southwest owns one and has options on the
other.
Chairman Thomas questioned when existing tenant
leases expires.
Chairman Balalis indicated that they would.be
• filled by attrition as existing leases expire.

Mr. Stucker noted that they have accomplished a
profile on the existing tenants and.that for the
most part the tenants.are either very young or
old. The young tenants are for the most part i.n
the "empty - nester" category. This means high
turn -over rates.
Commissioner Cokas asked if they have a feel for
turn -over potential.
Mr. Stucker responded that he anticipates it
will slow down as the .program is adopted.
Mr. Stucker°indicated.tha.t th- ey,ha'd reviewed the
Section '8 program and that it would be available
to the City of Newport Beach as an alternative.
Commissioner Haidinger questioned how it would
work. Mr. Stucker.noted that it was not app-
licable as it was not a part of the proposal
• before, the Planning Commission.
Commissioner Haidinger indicated at this potent
that.he favors a subsidy program. His argument
was that it places the burden on a broader base
of people. He asked if the 100 unit option was
no conger feasible.
Mr. Stucker indicated that it was not.
Commissioner Beek questioned why they had chosen
a 15 year span. Mr. Stucker responded that this
appeared to be a reasonable period.
Commissioner Beek noted that he believes the
Coastal Commission used a 15 year period with a
15 year option. Mr. Stucker responded that he
believed that to be correct.
Mr. Morrissey indicated it was their intent to
provide a clear and honest effort to provide
affordable rents and that they had provided .a
range of. options to the City and were willing
to manage the units if required. He indicated
their willingness to do whatever is appropr -fate.
. to establish and.maintain these units as afford-
able housing.

establish the criteria and mechanics of the

Dear Commissioner Balalis:
You requested that Commissioners Allen, Thomas and I form a sub-
committee to review the proposed development on the "North Ford"
property and. make recommendations to the Planning Commission for
its disposition. We have done so and this is our report.
The subcommittee has met three times; once with representatives
�- of The Irvine Company, and twice with the Community Development
Department staff. Unfortunately, Commissioner Thomas was able to
attend only a portion of one of these meetings and this report may
not, therefore, reflect his views.
BACKGROUND CONSIDERATIONS
Our subcommittee has a general bias toward low density residential
_development on this site as . we do toward low density development
in much of the balance of the City: The contiguous Eastbluff
property and probable residential Ford Aeronutronic development
would make a logical residential tie -in. The Irvine Company has
argued that the existing commercial development on the southwest
portion of the North Ford property should be considered the contig-
uous development and provide a bias toward the proposed commercial/
industrial project. We believe residential development is as
logical as commercial.
The subcommittee was extremely concerned about noise from the pro-
posed Corona del Mar Freeway. We requested a supplemental analysis.
by the staff to update the EIR with more precise CNEL noise contours.
This supplemental data was distributed with the material for the
Commission meeting of August 9th.
The cost /revenue impact was considered and residential development
is somewhat more favorable for the City than commercial development.

We considered the possibility of permitting high density -low cost
housing on th.is site but believe such development would not be
appropriate. Again, this reflects our general bias toward low
density residential development within the City.
This project is not within the Coastal Commission Zone and,
therefore, not subject to their requirements.
Traffic was a concern of the subcommittee and we believe.that the
development as described below would provide adequate phasing to
permit the project to comply, with the "test of reasonableness" as
required. We recommend that the Planning Commission so decide.
CONCLUSION
We recommend that the Planning. Commission change the General Plan..
to provide for residential development on this site at a density
of three per parcel map net acre. We further recommend that no
building be allowed inside a 65 CNEL line until after construc-
tion of the Corona del Mar Freeway. Subsequent to development
of the freeway, the Commission may wish, depending on its route
and noise generation, to modify the General Plan for the remainder
of the site.
