The Newport Beach City Planning Commission held a regular meeting Thursdays
August 16, 1945, at 7s80 p.m., in the Council Chamber, City Hall, Newport
Beach, with Chairman Allen presiding.
Commissioners presents Allen, Boltz, Ellerbroek, Longmoor, and Nelson.
Commissioners absents Isbell, Johnson, Patterson, and Seeger.
Commissioner Lougmoor made the motion, seconded by Commissioner.Baltz,
that the minutes of the lui* 21, 1945 ma6ting be approved as corrected,
(i, e. substituting,the oomplete written committee report on the Buena
Vista proposed improvement, in lieu of hhe interpretation of same, as
appeared in the draft of the minutes), and the minutes of the.meeting of
July 10, 1945, and the minutes of the special meeting of August 5, 1945,
be approved as read. Motion carried and.so ordered.
Secretary Ellerbroek read a petition from the property owners of Buena
Vista Street for the vacation of a portion of that street, and the deed-
ing to the City of a 51 strip of land on rear of the lots, and adjacent
to the present alley —to construct a 51 concrete sidewalk, and to install
the necessary lighting, meeting oity requirements. Owners to bear all the
costs of lighting and construction, and costs of moving present buildings,
which brought the motion by Commissioner Ellerbroek and seconded by Com-
missioner Boltz that the matter be referred to the committee, previously
appointed for checking on this, and consisting of Commissioners Johnson,
Boltz and Patterson, for recommendation. Motion carried and so ordered.
Secretary Allen also read a letter of application from R. T. Hubbell,
' requestibg the rezoning of Lots 269 27, and 28, Tract 441, First Addition
to Ne port heights, from zone R-3 to zone C-2, for proposed business of
contractors offices, with electric power units, a maximum of three 1-
horse power motors. A 'preliminary sketch of the proposed buildings was
attached and the $10.00 filing fee had been deposited with the City Clerk,
Commissioner Boltz made the motion, seconded by Commissioner Belson that
the matter be advertised and set for public hearing.. September 20, 1945.
Motion carried and so ordered.

CCEMUNICATIONS
First hearing upon the matter of the application of John F. Vogel, for
his property at 1401 Ocean Front, Corona Del. Mar, for rezoning from R-5
to C -1 was declared, and a latter from Mr. Vogel read by Secretary Eller -
broek stating "after investigating the sewer situation for further develop-
ment of the area for hotel or business purposes, please withdraw my appli-
cation for rezoning, and cancel same without further action." without
further discussion, Commissioner Baltz made the. motion, seconded by Com-
missioner Longmoor, that the..application, as advertised, be withdrawn.
Motion carried and so ordered.
Second hearing upon the matter of a proposed Amendment to Ordinance No. 525
for a change of rear yard setback line from 101 to S' on the east side of
58th Street between Marcus and Channel Place, was declared, and no protests
were received or heard, so Commissioner Longmoor made the motion seconded
by Commissioner Nelson that the hearing be closed. Motion carried, and
' Commissioner Boltz made the motion that the Commission recommend to the
City Council the approval and adoption of such an amendment to Ordinance
No. 525, as shown on Section 5, page 28, of the Districting Map of Newport
Beach, kotion seconded by Commissioner Nelson, and roll call vote called.
Ayes: Allen, Boltz, Ellerbroek, Longmoor, and Nelson.
Noes: None, and Motion c++rrisd and so ordered.

Tabled from the last meeting was the matter of the proposed lease to
CSiTTTEES
T. F. Kilkenny of the City owned property on Coact Highway, upon which
the Commission was to constitute itself as a committee to investigate.
Many property owners were present at the meeting for the public hearing '
on Mr. Vogel's property, so Chairman Allen explained the proposed plans
and asIted'for expressions from the floor. Mr. P. A. Dinamore, of the
Irvine Company, spoke first, stating that he was "very much interested
in the property ", that it"was donated to the City for - educational and
recreational purposes, end leasing would be contrary to those purposes "9 .
that the donor(Mr. Irvine) "was promised that it would be used as intend-
ad".. and "business purposes would be contrary to the best public interests",
and that that the City "should have certain areas set aside for recreat-
ional purposes ", likening the proposed leasing with San Francisco leas-
ing the Golden Gate Park, or Los Angeles of Pershing Square. Frank Rey -
nolds, property owner of Corona Del Mar, thought it very laudable that
it be left for recreational purposes, which was echoed by W. K. Ball,
Dr.Cash, and Mr. Glendenning, all of Corona Del Mar. Commissioner Long -
moor brought up the thought that that area, if developed for a public
bathing beach, would be endangered by the traffic of boats going up and
down the channel. Commissioner Nelson made the motion, seconded by Com-
missioner Ellerbroek, that the matter be laid upon the table. Carried.
NEW BUSINESS
Petitions, signed by hundreds of property owners of Corona Del Mar,
protesting the proposed rezoning of Mr. Vogels property from R-8 to C-1
also carried a clause for proposed rezoning from R-3 to R -1, for an of
blocks C and D. and the northerly held of 181 and 182. However Chairman
Allen pointed out that the petitions could not serve a twofold purpose
and if such rezoning were desired that the matter would have to be pro-

perly presented. Mr. Reynolds stated, as spokesman for the property own-
ers, that they appreciated very much the work of the Commission, for
"doing a grand job, a thankless job."
ADJOURNMENT
Commissioner Nelson made the motion for adjournment, seconded by Com-
missioner Longmoor. Motion carried, and the meeting adjourned to
Thursday, September 20, 1945, at 7::30 p.m..
