The following two items were heard concurrently_ but separate actions taken on each. C -N -H Applicant: McLain Development Company, Newport Beach Owner:L The Irvine Company, Newport Beach Engineers: Raub, Bein, Frost & Associates, Newport Beach Planning Commission reviewed with the Staff the above requests and discussed which portion of the property covered the reclassification and which portion reflected the resubdivision. Don Corvin of Morris & Lohrbach, Architects, appeared before the Planning Commission in response to questions relative to the acreage involved in each parcel, easements on the property, and a general review of the project. Public hearing was opened in connection with this matter and Bob McLain of McLain Development Company appeared before the Planning Commission on behalf of the applicant. Larry Moore, General Planning Administrator with The Irvine Company appeared before the Planning Commission. He stated that no.access to the bay was planned for anyone other than the tenants. He reviewed other pedestrian walkway in the immediate area which provided access to the water and commented on the problems involved if a walkway were placed along Promontory Bay Channel. He also commented on the density increase by the addition of 14 dwelling units, the additional amount of traffic being generated and the fact that more traffic would be created should the property be developed for commercial purposes and for parking although at different times of the day than for residential Page 3. He also stated that commercial development would not be compatible with the quiet residential area; the number of boat slips would be increased but there would be a change in the persons using the slips; public boat slips should be maintained by.the public and not The :Irvine Company; from a compatibility and economic point 'o view, a public parking lot would not be feasible; and.believes the entire project is very reasonable. Don Corvin of Morris & Lohrbach, Architects appeared before the Planning Commission and explained the location of the various structures and answered questions relative to the setbacks. Larry Miller, resident of Sylvia Lane, Newport Beach, appeared before.the Planning Commission and commented on the possible problem of tenants' friends using some of the boat slips and the parking problem which may be created. There being no others desiring to appear and be . heard, the public hearing was closed. Planning Commission discussed traffic, incompatibility of commercial and public parking, public access to the water, setbacks on the two channels and along Bayside Driye, and the Negative Declaration. An unidentified man appeared before the Planning Commission in opposition to boat slips because of pollution to the bay. Motion X Planning Commission continued their discussion of the project following which a motion was made to recommend to the City Council that Amendment No. 380 be approved. Planning Commission discussed the text of the Negative Declaration and re- wording of same. Motion X Motion.was made that the .Impact Statement be modified as follows: 1. That the Negative Declaration not be accepted because there are impacts on possible public access to the water. 2. That until the impacts are resolved to the . satisfaction. of the Planning Commission, no build- ing permits be issued on the property covered by Amendment No. 380. Page 4. Larry Moore, General Planning Administrator with The Irvine Company appeared before the Planning Commission and commented on the proposed findings relative to.the.Impact Statement. That Amendment No. 380 be approved by the Planning Commission and the City Council. 4. That the approved Harbor Permit Application No. 200 -1001 be amended so as to require all slips and side tie facilities in the Bay adjoining the subject property to be reserved for the exclusive use.of tenants of the "Newport" apartments, condominium owners or tenants of "The Coves" condominium project, or members of the Shark Island Yacht Club. 5. That a parcel map be filed. 6. That all vehicular access rights to Bayside Drive from Parcel No. 2 be dedicated to the City of Newport Beach. Page 5. That the individual water and sewer services necessary to serve each parcel be provided in a manner satisfactory to the Public Works Department. 9. That 13' right- of- way.and improvements be provided for the continuation of combined pedestrian and bicycle path. 10. That all existing structures shall maintain the required setbacks and building separations. 11. That the developer shall be responsible for. all precautionary actions necessary to protect the quality of the waters of the Bay during excavation and construction operations and shall prepare for approval of the California • Regional Water Quality Control Boar.d and the Director of Community Development, plans and .specifications designed to protect the waters of the adjoining channel prior to the issuance of any building permits. 12. That a .10 foot building setback shall be established parallel to the 'west (Promontory Bay.Channel) property line. Encroachments for patios, balconies and architectural features'.shall be permitted within 5 feet. of said property line. TO CTO BER 4 Initiated by: The City of Newport Beach Community Development Director Hogan advised that the Development Standards Citizens Advisory Committee have requested that the Planning Commission not act on this matter until such time as they have completed their report and made.their recommendations which will be the latter part of September. Public hearing was opened in connection with this matter and there being none desiring to appear and be heard at this time, the public hearing was closed. Item B -1 Request to permit a maximum of 20% of the required offstreet parking stalls for a proposed hotel and related facilities to have a minimum dimension of. 7'6" X 15'0" (for compact cars) where stalls with a minimum dimension of 8'6" X 18'0 ".are required. That the compact spaces shall. be clear.l'y. designated for the use of compact automobiles only. 3: All required Parking.spaces shall remain unassigned. 4.. That a landscape plan for the off- street . parking areas shall be approved by the Director of Parks, Beaches.and Recreation. Said plan shall provide for at least one tree for each five parking stalls. Planting areas around buildings shall not be included in calculating the number of trees placed in the parking area. Jackie Cook, one of the applicants, appeared before the Planning Commission to answer questions relativ . to the request and commented on the extra parking across Newport Boulevard. There being no others desiring to appear and be heard, the public hearing was closed. X Following discussion of the matter which included the parking, motion was made that Use Permit Application No. 1686 be approved subject to the following conditions: 1. That a maximum of twenty -four students or teachers be permitted at any one session. 2. That the roof of the existing structure and . the adjoining property to the rear shall be .striped for the parking of eighteen automobiles as illustrated on the plan submitted at the hearing. 3. That the hours of operation shall not exceed the hour of 10:00 P.M. , 4. That this permit shall be for a period of one year with subsequent extensions to be acted upon by the Modifications Committee. During this one year period the applicant shall secure an off -site parking agreement for six additional parking spaces. Grant Hoel, owner., appeared before the Planning Commission and stated he agreed with the.recommend- ed conditions. There being no others desiring to _appear and be. heard, the public hearing was closed. Following discussion, Planning Commission found. that there were unusual circumstances attached to the site because of the topography and that grant- ing the variance would not be detrimental to the public welfare or injurious to property or improve - Motion X ments in the neighborhood. That development be in substantial conformance with the approved plot plans and elevations. 2, That the underside.of. the proposed structure be screened from West Coast Highway and along its easterly and westerly sides; said screening to be approved by the Director of Community Development. 3. That a four -foot wide sewer easement be dedicated to the City of Newport Beach located along the easterly lot line and extending from the exist- ing sewer easement to the Kings Road right -of- Way. The City will be responsible for extending the sewer line up from its existing terminal cl.eanout to the Kings Road parkway. 4. That the new dwelling be required to pump i.ts sewage up to Kings Road discharging it into the existing 8" V.C.P. rather than making.a conn.ec= tion to the existing 6" W.S.P. sewer line run - ning along the side of the bluff.
