Meeting called to order by the Chairman. ROLL CALL - Commissioners present: Hocking, Seager, Williams, Sehnitker, Findlay. Patterson. Commissioners absent: Whitson, Hodgkinson; Briggs, excused. Bldg. In". Nelson attended. Secretary stated that this was a special meeting regularly called and advertised, for the purpose of holding the first public hearing upon the proposed plan of municipal isgtreveme0 UN COMMICATIONS Secretary read a communication from the City Council referring to the Planning Commissio an application from Mrs. Hiriam R. Delano for amandmsnt to Ordinance 440 respecting the rezoning of Lots 1 to S inclusive, Block 22, Balboa Sastsids Addition, from R-1 to B-2, to allow construction of a duplex upon said pzaporty. Application was accompanied by plans of th proposed building and letters from 4 property owners in the block favoring the rezoning. Com.Pindley moved that this matter be sent to first hearing, dates of hearings to be set for August 29, a special meeting, and September 21, a regular meeting. Seconded by Com.Williame. Motion carried and so ordered by the Chairman. Secretary read a letber from Mr. Tilton accompanied by his bill for services for duly of $75. Com.Patterson moved that this bill be approved and the Secretary be instructed to send the necessary demand for same to the City Clark. Seconded by Com.Pindlay. Motion carried and so ordered. Secretary read a communication which he had prepared to be sent to the City Council in reference to the application of R.G.Blake for permit to construct a Museum on his property. As Mr. Blake had not made application for variance in the proper form, no further action could be taken on this matter. 71EST 'MARING ON PROGRAM OF MUNICIPAL IMPROVUENTS AS SONSTITUTING A CITY PLAN - Secretary read the call for this meeting as published; "Pursuant to instructions of the Newport Beach City Planning Commission, Notice is Hereby Given that two (2) public hearings will be held by the City Planning Com- mission of the City of Yewport Beach for the purpose of discussing and considering a number of municipal improvements in one group, as constituting a city plea. as follows:" Secretary stated that an oversight wgs made in advertising the second hearing for August 24th, as the law requires that 10 days shall olapo between hearings. Com.Patterson moved that the second hearing on the Plan of Proposed Municipal Improve - ments be set for August 29th at 7230 p.m, in the-Council Chambers, City Hall, and that the Secretary be instructed to readvertise same. Seconded by Com.Findlay. Motion carried and so ordered. Chairman Hopkins then declared the meeting open for public hearing. He asked that the discussion be danfined to the items as advertised. Secretary read Item "A ". "The aogaisitiona, construction of &public improvement, to -wit: The acquisition and construction of a group of buildings, including equipment of same, on ons paroel of land, including therein a city hall, police station and jail, and construction of streets, walks, and other work incidental thereto, and the acquisition of rights of way and lands aesessary or convenient for the use of said buildings. All of said buildings to be used for public Purposes. Said project to cost approximately $90,000." Chairman asked,if anyone present wished to discuss this item. No discussion. Secretary read. Item "B ". "The acquisition and construction of a public improvement, to -wit: Additions to municipal water eystem,Jucluding thereinfire protection, mains and hydrants, water works, creation tanks, pumping Plante and the acquisition of buildings and lands necessary or convenient to said project. Said project to cost approximately $141,819." Chairman asked if anyone present wished to comment on or discuss this item.' He discussion. Secretary read Item "C ". "'The acquisition and construction of a public improvement, to -wits Additions to muuoicipa ;r sewer system, including therein construction and reconstruction of sanitary sewers, underground pumping'stations, including therein the acquisition of lands and rights of way, and other work incidental thereto. Said project to cost approximately $127,273.m Chalrmaa-$epkine called for discussion from the floor. No discussion or comments. Secretary road Item "D". "The acquisition and construction of a public improvement, to -wit: The construction and reconstruction of A public wharf at Newport Beach, including therein the acquisition of lands and rights of way, and other works incidental thereto. Said project to cost approxi- mately $25,000, Chairman asked if anyone wished to discuss the Item "D ". No discussion. Secretary read Item "In. 1 "The acquisition and construction of a public improvement, to -wit: The acquisition of lands to be need for public park purposes, automobile parking areas, the improving and beautifying Of same, including the arsction and construction of rest rooms and other public buildings, to be used for public purposes. The lands to to be aougired are located on the Ocean Front between Adams and 03" Streets in Balboa, City of Newport Beach, Said project to cost approxi- mately $55,000. City Engineer Patterson explained that this project has been slightly changed from the plan as submitted by Mr. Tilton. The Circular ,Drive extending out on the Saud has been moved back, making the present location approximately 200 ft. from the shore line. He felt that it would be safer not to extend the street out so 01099 to the water line. A$se, the over head creasing at the pier bas been altminated beasues of the cost of construction. The pre. sent plan calls for a crossing at this point. He felt this world b9 safe, as the circular drive will not be a sgsed -way and a boulevard stop will be Installed at the crossing. The circular drive Is a 30 ft, street and he thought this wide enough; if a 40 ft. street is pat In, you will have people parking on the dative. Mr. Jordon inquired if extending the pier bad been considered. He had heard much dis- cussion in favor of extending the pier out farther. Com.Patterson said it would cost approximately $550,000 to extend the pier out into deep water and, as the pier will have to reconstructed, probably within 10 or 15 years, it was not considered wise to add such an item of cost at this time. So further discussion. Item xis was read by the Secretary. "The acquisition and construction of a public improvement, to -wit: The acquisition of a public street along the Ocean Front between Adams and "B" streets, and the paving, curbing and protection thereof from the waters of the Pacific Ocean, including therein the acquisition of lands and rights of way, and other wtrk incidental thereto. Said project to cost approxi- mately $60,000. the improvement ofptheaOcean Front "I" and "F* are plans for whichrhavetjusstibeen0explained by the City Engineer; Item "F" having to do with the circular street. Chairman called for discussion from the floor, No discussion. Item "G# was read by the Secretary. "The acquisition and construction of a public improvement, to -wits The construction of a building for public uses in Corona del liar, including therein a building to be used for re- creational purposes, and public meetings, and playgrounds, showers, lockers, and equipment, including the acquisition of lands and rights of way, and other works incidental thereto. Said project to coat approximately $34,000.■ Chairman called for discussion. Mr. Dennistn inquired where this project was to be located. Com.Patterson informed him that it would be located on city -owned property between Jasmine and Iris Streets. Com.Seager explained that in the original program, there had been two items of public wharves, one at Balboa and one at Corona del Mar which had been eliminated from the City Plan because the commission had questioned the propriety of the city bonding itself for an improvement $51,000 when it is possible to 99Eare funds from another sotLree to finance these improvsmeats. N• presented thefbllowing resolution for the consideration of the eommiasion: TO THE HONORABLE UAYOS AND CITY COUNCIL CITY OF NEWPORT BEACH, CALIFHBNIA WRIBELS, the City of Newport Beach is contemplating and causing to be formulated a plan of Public Improvements, to defray, the cost of which a bond issue will be efd'mitted to the electorate of Newport Beach and an application will be made to the United States Government for an allocation of PWA funds; and, the herein mentioned plan did contain two items of Public Wharves to be erected upon the shores of, and extending into the waters of the Orange County Harbor (Newport Harbor) the same to be located at Balboa and Corona del Mar; and, WERRUS. the contemplated wharves are for the use of the public and vessels from both land and water; and, VEMMAZI the estimated cost of the two wharves will be approximately eighty -one thousand, six hundred dollars, ($81.600) ;.and, Y►l MW- Orange County Harber(Newport Harbor) was improved by the Orange County Farber District and the Unites States Government jointly, and the Statutes of the Stets of California in ran act(genate Bill No.245) to establish an Harbors and Navigation Code, thereby consolidating and revising the law relating to harbors, ports, and navigation, and matters incidental thereto, and to repeal certain act# and parts of acts Specified herein," (Approved by the Governor May 25. A.D.1937); and WHEREAS, said statutes provide that the improvement, development, protection, maintenance, management or control of such harbors *hall rest in the Board of Sup- ervisors of Orange County or a Harbor Commission appointed by said Board of Super- visors, with power to collect fees, levy taxes and otherwise establish a fund for the improvement, dsv..�opmemt, protection, maintenauc._ management of control of said harbor; and, Wfilk . it is the sense of the Newport Beach City Planning'Commission that the herein mentioned Public Wharves are desirable, essential and necessary for the proper operation of siad Orange County Harbor (Sewport Harbor), the snpense incident to the construction and maintenance of sand wharves should be assumed by the Orange County Harbor District through its proper officials rather than by the City of Newport Beach; NOW, TMOMYORE. BE IT RESOLVED by the Newport Beach City Planning Commission that your honorable body request the'fioard of Supervisors of Orange County to enact an ordinance providing for the appointment of a Harbor Commission in accordance with the provisions of the statutes herein referred to. Com.Sehmttkvr moved that Resolution 10.134 be adopted and the Secretary be instruct ed to transmit the same to the City Council as the recommandation of this commission and that a copy be filed as a part of the minutes of this meeting. Seconded by Com.Seager. Discussion: Com.Patterson said he would like time to consider this resolution before voting on it. Be was in favor of securing the improvements mentioned by District funds, if possibls, but he quostionod the right of the Planning Commission to request the appointment of a Harbor Commission. He did not think this was the time or the way to go about securing funds from the District. Com.Seager stated that he bad appeared before the Board of Supervisors on 2 occasions on a committee from the Chamber of Commerce, The Board, at that time, informed the committee that they would be willing to take such action at any time the City Council would make such request. Be considered it economically expedient to have the harbor district pay for im- provement to the harbor rather than the city of Newport Beach. The object of this resolution is td stimulate the City Council to take action. Cem.Patterson favored the resolution except for the recommendation of requesting appoint- ment of a Harbor Commission. Re felt that was outside the jruiediction of the Planning Cam. Chairman Hopkins felt that, as the function of the Planning Commission is to regulate and plan the use of land for the fullest enjoyment of same, that it would be entirely within their right to make such recommendation. Com.Patterson moved that the Resolution be amended by striking therefrom the clause roc* mmeading that the City Council request the Board of Supervisors to appoint a Harbor Cosy mission. Sounded by Com.Williams. Com.Findlay thought that if the Board of Supervisors levied taxes on docks and moorings to pay the cost of improvements in the harbor, it might adversely effect the growth of the harbor and city. Com.Patterson informed him that the Board of Supervisors already has that authority. Question called Air. Roll Call vote: Ayes: Findlay, Patterson, Noes: Hopkins, Sanger, Williams, Schnitber.. Motion lost, Roll Call vote on Resolution No. 134. Ayes: Hopkins, Sanger, Williams, Schnitker. Noes: Patterson, Findlay. Motion carried and so ordered by the Chairman. to further discussion of Item "G". Chairmen inquired if there were any questions from the floor on any subjects relating to the Plan of Public Improvements. Mr. Homer inquired if the Planning Commission expectsto recommend spending azp*nay in Nest Newport. Chairman informed him that only the items appearing in the program as advertised could be considered. We may deleat any item after public hearing but may not add to the plan. Mr. Vogel inquired if the government has to approve all items in order to hold the bond issue election. What happens if only one or two items are approved and the bond issue to not sufficient to do all the work? We are voting on a single proposition. The government approve* of each item separately. It the government decides we need only a city, hall, what will happen to the other projectsT Will the city have to stand the entire cost? Chairman Ropkclae informed him that the City Attorney would have to answer these questions None of the commission knew what the result of this situation would be. Mr. Ryer inquired if the commission is considering costs in their recommendations. Are they setting the amount of the bond issue as 45% of the cost of the combined projects? Chairman iafromed him that the commission will recommend a program containing certain items with estimated costs of each item; but the City Council will set the amount of the bond Issue. To further discussion. T7tNT"M APPROVAL OF PLANS OF CIRCULAR DRIVE AND PARKING AREA AT BALBOA- Com/Patterson presented the tentative plans of the circular drive and parking area and Park as prepared by his department for tentative approval by the commission. This plan had been previously presented and explained. Com. Seeger moved that the Planning Commission tentatively approve the plan of the Balboa Ocean front Improvement submitted by City Engineer Patterson for the purpose of rgquesting a P P A grant from the federal Government. Seconded by Com. Patterson. Motion carried and to ordered by the Chairman. ADJOUSS ST - Cn motion of Com. Seeger, seconded by Com. Schnitker and. Carried, the meeting adjourned.
