Bill Hurrell, of Wilbur Smith and Associates, appeared before the Planning Commission. Mr. Hurrell recommended establishment of a Parking Authority for those reasons outlined in his .letter dated August 8, 1978, and reviewed possible alternatives relating to the compositio of same. Public hearing was opened in connection with.thi item.and Margot Skilling, resident of West . Newport, appeared before the Planning Commission Ms. Skilling commented that Newport Beach has approximately 30,000 feet of ocean frontage and that according to the State of California's standard for determining maximum beach utilizati for State beaches (i.e., one person per 6" of water front), the maximum capacity for the City'' beaches.is 60,000 people. Ms. Skill.ing expresse her belief that the City should set a standard for its beach use prior. to providing additional parking. She then voiced concern with the peripheral parking lot which is proposed to be constructed on Caltrans property on Coast Highwa as this would further congest an already - overimpacted highway. Ms. Skilling also objecte to any commercial joint use of a. parking facilit inasmuch as such commercial use will create the demand for additional parking. Coordination, design, and development of the test peripheral parking facili.ty and shuttle bus system with OCTD. 2. Alteration of existing parking operations including parking rate increases, meter installation and removal, off- street parking operations, meter collection procedures, and parking fine disposition. 3.. Establishing administrative procedures for the parking validation program in commercial areas for existing and future City - owned facilities. 4. The implementation of the Residential Parking Permit Program. TI NLY COMMISSIONERS MINUTES City of Newport Beach t August 17, 1978 ROLL CALL INDEX Public hearing was opened in connection with this item and Jim Jachetta, Engineer for the Shell Oil Company, appeared before the Planning Commission and .brought notice to an error in the staff report in that two, 15'1" high, hexagonal canopies.are proposed to be constructed over the two pump islands, rather than two 27' high canopies as stated in the staff report. Mr. Jachetta then voiced concern with staff's . recommended condition of.approval which provides that a landscape planter area with a minimum width of 2 feet shall be located between the East Coast Highway right -of -way and the adjacent pump island. Mr. Jachetta requested that the . Planning Commission not include this requirement as a condition of approval inasmuch at the, installation of a 2' wide planter in this location would not leave sufficient room for a ,. car to pull into the outside space. He then explained that the City Traffic Engineer suggested the installation of a planter area so as to prevent automobiles from parking on-the sidewalk • while being serviced with gasoline. Mr. Jachetta then expressed willingness to meet with the Traffic Engineer in an effort to arrive at a mutually- satisfactory method of preventing cars from parking on the sidewalk. With respect to staff's recommended condition of.approval which provides that a 10 -foot radius corner cutoff at East Coast Highway and Orchid Avenue be dedicated to the public, Mr. Jachetta felt that this dedication is unnecessary inasmuch as the present turning radius on.this corner is sufficient. He . also commented that if it is necessary to modify the curb radius, the planter space would be affected. Mr. Jachetta also pointed out that subject property is being,leased by Shell Oil Company and that the land required for dedication does not belong to .them. He then reviewed the signage that is proposed for the service station. and commented that "same would be both functional and aesthetically pleasing. There being no others desiring to appear and be heard on this item, the public hearing was closed. Motion X Motion was made that Planning Commission make the All Ayes following findings w.ith.reference to Use Permit 1879: 1. The project will not have any significant environmental impact. 3. The use of relocatable buildings less than 15 feet wide and 600 sq. ft. in area is justifiable in.this particular case, inasm as said structures will resemble permanent buildings when completed. 4. The Police Department has indicated that th do not contemplate any problems. 5. Adequate landscaping and offstreet parking spaces are being provided in conjunction with the proposed commercial development. 6. Exceeding the areas of permitted signs would, under the circumstances of the particular case, be detrimental to the hea' • safety, peace, comfort.and general welfare of persons residing or working in the neighborhood of such proposed use and wouli be detrimental or injurious to property an, improvements in the neighborhood and the general welfare of the City and further that the proposed modifications are not consistent with the legislative intent -of the Zoning Code. 7. The approval of Use Permit No. 1879 will not, under the circumstances of this case be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing or working in the neighborhood or be detrimental or injuriou to property or improvements in the.neigh- borhood or the general welfare of the City and approve Use Permit No..1879, subject to the following conditions: 1. That all existing fire protection equipment such as but not limited to, wet stand pipes, fire extinguishers, fire sprinkler systems, etc., shall be inspected prior to conversion. 8. That existing geological and soil condition shall be reviewed. Where evidence of. questionable geological or soil conditions are found to exist, the Building Official shall have the authority to require new soils' investigations. 9. That all dwelling units shall be required to meet the minimum state standards for sound separation between dwelling units. 10. That all dwellings shall be provided with smoke detectors. 11. That consideration shall be given to provid • each dwelling unit with a separate electric service. 12. That one accessible carport space shall be maintained for each of the ten dwelling uni at all times. 13. That two additional parking spaces shall be provided for condominium owners, tenants, or guests on the property at all times. Commissioner Beek opposed the motion as he felt that policies regarding condominium conversions should be established prior to taking action on conversion applications.. There being no others desiring to appear and be heard on this item, the public hearing was closed. Motion was made that Planning Commission make the following findings: 1. That the proposed residential development is consistent with the General Plan, and is compatible with surrounding land uses. The proposed development will also eliminate unsightly older residential units on the property. 2. That the proposed development meets or exceeds all of the requirements of the R -2 District (i.e., floor area limit, open space option, building height, parking, etc.) 3. That the establishment of a 6 -foot rear yard setback along the rear property line will not, under the circumstances of the particular case, be detrimental to the health safety, peace, comfort and general welfare of persons residing or working in the neighborhood of such proposed use or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City and further that the proposed modification is consistent with the legislative intent of Title 20 of this Code.
