The Newport Beach City Planning Commission held a regular mseting,.Thursday,
August 18, 1949 at 7;30 pm in the Council Chamber of the Newport .Beach City H
ROLL CALL Commissioners Present: Copelin, Daniell, Johnson, Longmoor, Pleger, Rudd,
Smith, and Wightman.' Commissioners Absent: Ellerbrosk
MINUTES Commissioner Daniell made emotion., seconded by Commissioner Johnson for the
approval of the minutes of the meeting of July 21, 1949 as submitted. Motion
carried.
PUBLIC Chairman Longmoor opened the second hearing on Block 131. First to speak
HEARINGS from the floor was Allen Stolle, owner of Lot 14 & the NEly 101 of 12, Block
1320 who stated that they had very little additional information. He stated
that there seems to be no basis for the rezoning compared to what they would
get out of it and that he failed to see if it were rezoned that there would
be any relief or improvement. He feels they have presented the sentiment of
the vast majority of the people there against the rezoning. Harold 1. Wilson,
320 Iris, owner of property on Carnation & Ocean Front, said that owing
partly to the fact that conditions have changed since the purchase of the lot,
he feels entitled to have the rezoning made to R -3.
Mr. Lev, speaking for Mr. Behnborg, owner of Lot 8 N. portion of 7, said they
felt at the time they built that they were in an R -1 zone and that they were
protected, but through the described "Chain Reaction" of change of zoning
from block to block, too many large buildings were up.and going in, and the
action should not be approved.
W. J. Holcomb, representing Mrs. Van Sooy, owner of 501 at Seaview & Carnation,
said the lot is now worthless for a home and wants the rezoning since they
feel there is not enough R^3 property in Corona del Mar as compared to .other
property.
Mrs. Lynn then gave a recap on zoning of blocks all over Corona del Mar.
Mould like to say again that she does not want a hotel to go on the corner
of Goldenrod & Ocean Boulevard, and will raise quite a fuss if necessary to
stop one from going up there. Wants Block 131 zoned for hotels and to keep -
hotels in that area, and would like to see Block A -34 condemed and turned
into a park.
Mrs. Raymond Baldwin, 205 Diamond, Balboa Island, owner of lot 6 & J of 7,
said that when they bought, they intended to build a home there, but with
other large buildings there and still only zoned for single family residences,
they have tried to sell the property but to no avail. Therefore, it would
seem most just to have the whole section rezoned at this time. (No further
remarks from the floor)
Commissioner Copelin moved the hearing be closed. Motion seconded by Com-
missioner Rudd and carried. Chairman Longmoor made a motion that a recom-
mendation be sent to the City Council denying the rezoning for the following
reasons:
1. Protests against the changing of the zoning in Block 131
are very heavy, not only within the block, but also in the sur-
rounding area.
2. A study of the building permits issued during the year ending
June 30, 1949 in-residential zones were as follows:

3. A study of vacant property in residential..zones by the
planning consultants reveals the following:

4. The above studies indicate that there' is an excessive
amount of zoning as B -3 in Corona del Mar, as well as in the
city as a whole in comparison to the demand for building
permits.
5. The amount.of property zoned for multiple residential
purposes in Newport Beach exceeds the average for such pur-
poses in other cities of comparable size.
6. The planning consultants are making a zoning study of
the entire city and the Commission desires to withhold
further zone changes until those studies are available for
their guidance.
Commissioner Copelin seconded Chairman Longmoor's above proposal for
denying the rezoning and was carried with the following roll call votes
AYES: Copelin, Daniell, Johnson, Longmoor, Pleger, Rudd,,-Smith and
Wightman. NCESs None ABSENT: Ellerbroek
Next on the agenda was the application for rezoning a portion of Block
131. Commissioner Daniell moved that the action on this be the same as
taken on all of Block 131, and that the same recommendation for denial
be sent to the Council. Motion was seconded by Commissioner Copelin and
passed by the following roll call vote: AYES: Copelin, Daniell.. John -
son, Longmoor, Pleger, Rudd, Smith, & Wightman. NOES: None ABSENT:
Ellerbroek
Application of F. W. Briggs for a temporary real estate office on Lot 11,
Block 634, Canal Section. Chairman Longmoor opened the discussion asking
for remarks from the floor. Mrs. Noller, 404 Clubhouse, questioned
whether or not the application had been published and was informed that
it had been properly published July 28, 1949 in th a Newport - Balboa Press.
She asked whether it was a temporary building and if there would be ad-
vertising boards and was informed if the owners so desired there would be.
She stated she would like to go on record as protesting the application
then.
Mr. Briggs said he would have the oil pool taken care of and that he
didn't think their business would be so booming that it would create a
traffic hazard there. The building will face on Newport Boulevard and
he believes it would Help beautify the property.. He presented a petition
of lot owners in Blocks 634 -35 -36 consenting to the application.

Briggs stated that he was all for the widening of the Boulevard, but on a
year -to -year permit, he could not see why it couldn't be granted since be
could discontinue business there anytime the boulevard were to be widened.
Mrs. Noller again spoke and said the big objection Was the .traffic hazard,
but said she would not want to object too strenuously and hinder his means
of making a living, and therefore, wouldn't object to a limited period such
as 30 or 60 days until be was able to make other arrangements for an office.
Chairman Longmoor stated the granting of a permit would be for a year or
nothing. There were no further remarks from the floor. A motion was made
by Commissioner Wightman, seconded by Commissioner Daniell to close the
hearing. Motion carried. Motion made by Commissioner Johnson to deny the
application, seconded by Commissioner Rudd and passed by the following roll
call vote: AYES: Daniell, Johnson, Longmoor, Pleger, Rudd, Smith, and
Wightman NOES: None ABSENT: . Ellerbroak Commissioner Copelin dis-
qualified himself because he was in the same business as the Briggs.
Discussion was then opened on application of John D. Burnham to continue
operating real estate office at 2001 Ocean Boulevard. Mrs. Kuhn, 2005 Ocean
Boulevard, spoke from the floor stating that it was the attitude and feelings
of the people to let the office continue operating. Mr. Wise said he felt
it was not temporary, and under the terms of the ordinance would not advise•
granting it. Motion made by Commissioner Pleger to olose hearing, seconded
by Commissioner Rudd and carried. Commissioner Smith made a motion that the
permit be granted, seconded. by Commissioner Wightman. Following roll call"
vote: AYES: Smith and Wightman NOES: Copelin,.Johnson, Longmoor, Pleger,
Rudd ABSENT: Ellerbroek Commissioner Daniell disqualified himself from
the preceding roll call vote. Motion made by Commissioner Daniell on posi-
tive nature to deny permit, seconded by Commissioner Copelin and carried with
the following roll call vote: AYES: Copelin, Daniell, Johnson, Longmoor,
Pleger, Rudd, Smith, & Wightman.. NOES: None ABSENT: Ellerbnnek
Next on the agenda was the application of the Balboa Bay Club regarding
amendment of zoning ordinance to permit a.sia story building. Secretary
Copelin read Resolution of Intention, of the City Council to amend Section
7, Paragraph B of Ordinance 525 as advertised. Commissioner Copelin moved
to close hearing and that it be set over for the next meeting. Motion
seconded by Commissioner Rudd and carried.
OLD Foster & Kleiser billboard application to install billboards in Corona del
BUSINESS Mar: Commissioner Pleger made his report for the Architetural Committee.
He said that most people would like to see billboards kept out of town.
Several suggestions had been made, but the best one seemed to be putting it
up as a community problem to the various groups Within the community, and
try to get the property owners not to lease their property for signs unless,
it is to the benefit of the community. You can't seem to put up any definite
program for them, and it is practically impossible to say shish signs are
desirable and which are not since everyone holds different views on this.
Mr. David Larson appeared representing Foster & Kleiser Company, Long Beach.
He stated they have always tried to choose locations that would not hinder
the beauty,of the city. He feels the Commission has only two alternatives
a. Amendment through zoning ordinance
b. Possibly the whole city should be zoned tighter, then the
company could not apply at all.

But as it now stands, he does not believe the city can keep them out.
Temple City sited as an example of a tight city which does not have
any billboard advertising. Be stated the panels are well maintained,
kept clean and that they have always tried to keep within the Planning
and Zoning Rules up and down the Coast. Mr. Wise stated that is is
purely a matter of policy as to whether we want them in or not and
that it, is entirely up to the Planning Commission to decide. Commis-
sioner Pleger made a motion and seconded by Commissioner Smith that
application be denied. Motion carried. Commissioner Copelin stated
that Mrs. Lynn's sign application was also included in the above motion.
(Open discussion on the sign she had intended to erect near entrain e
of Corona del Mar. The Planning Commission stated that they could not
allow her sign put up, and try to hold out billboards at the same time.
COMMUNICATIONS None
NEW BUSINESS' Appointment of standing committees.
Architetural Committee. Pleger, Chairman, Ellerbroek and Rudd.
Commissioner Smith moved the above committee be approved, seconded by
Commissioner Johnson and carried.
Chairman Longmoor then appointed the committee to consider referrals
from the Orange County Planning Commission. Johnson, Chairman, Rudd,
and Copelin. Commissioner Wightman moved the above committee be ap-
proved, seconded by Commissioner Pleger and carried.
Motion made by Commissioner Pleger, seconded by Commissioner Daniell
that the Annual Report be approved and a copy sent to the City Council.
Motion carried.
ADJOURNMENT
Commissioner Copelin made a motion for adjournment, seconded by Com-
missioner Pleger and carried.
