HomeMy WebLinkAbout08/19/1954MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, AUGUST 19, 1954 Chairman Longmoor called the regular meeting of the Planning Commission to order. ROLL CALL: Commissioners present: Copelin, Longmoor, Reed, Hayton, Briggs Commissioners absent: Lind, Rudd, Smith, Keene MINUTES: Minutes of the meeting on July 15, 1954 were corrected to read as follows: Var. 1151 - Kelso & Sloan. At meeting of July 15, 1954 this variance was set over as no one was present representing the applicant. The Chairman of the Planning Commission personally contacted each com- missioner on July 20, 1954 and the commissioners voted unanimously to grant Variance Application #151. Use Permit #153 - Leo B. Kirchner - under FINDINGS, 100 sq. feet corrected to 1000 sq. feet. The minutes were then approved as corrected upon motion of Com. Hayton, seconded by Com. Reed, and carried. VARIANCES: #152 -A Application of Michael G. Wagner for a 2 foot rearyard setback along Channel Place on Lot 1, Block 638, Canal Section Tract, and located at 3800 Channel Place, Newport Island. V - #152 -A The existing setback is 3 feet as shown on District Wagner, Michael G. Map #3. Lot 1, Blk. 638 The hearing was declared open. Canal Section FINDINGS: Existing setbacks in the remainder of the block are approximately 2 feet. No objections have been GRANTED received and the two foot setback will not adversely affect . surrounding property. The hearing was closed upon motion'of Com. Copelin, seconded by Com. Reed, and carried. Com. Copelin moved that the application be granted, seconded by Com. Reed, and carried by the following roll call vote, to -wit: ALL AYES Application of Robert Ingram and Dr. Lewin to re- subdivide an R-3 V - #153 district parcel of ground consisting of Lot #800, Tract #907, Ingram, Robert Lido Isle into two biilding sites as follows: & Bldg. Site #1 - consisting of the northwesterly portion of Lot 800, Dr. Lewin Tract #907 with a property line width of 30.28 feet adjacent to and facing Via Lido Soud, and a front property line width of 77.13 feet Lot #500, facing the West Lido Channel of Newport Bay, with an area of apps. Tract #907 4800 square feet. Said HLdg..site #1 to be used for single family (R-1) construction only. GRANTED Bldg. Site #2 - consisting of the southeasterly portion of Lot 800, Tract #907 with a property line width of 30 feet adjacent to and facing Via Lido Soud and a front property line width of 62.42 feet facing Newport Bay, with an area of approximately 4300 square feet. Said Bldg. Site #2 to be used for single family (R-1) construction only. NIM a r The hearing Was declared open. FINDINGS: A resubdivision of Lot #800, Tract #'907 as proposed herein allows two building sites of greater size than the average recorded lot on Lido Isle. The limitation to Rtl usage allows a better building and traffic condition than would exist under an R -3 usage, thus there would be no adverse effect on surrounding property. CONDITIONS: Each of Building Sites #1 and #2 as described herein will not be used for other than single family R-1 construction and shall be regulated under the R-1 district of Zoning Ord. #635..' The hearing was closed upon motion of Com. Copelin, seconded by Com. Reed, and carried. Com. Copelin moved that the application be granted, seconded by Com. Tract #919, and located at 2226 W. Coast Highway. Required by GRANTED Section 9103.52 of the City Code. Application of Donald Haven Hall to permit the storage, writing, and V - #154 preparation of commercial art and advertising, and as explained in Annex A and B of the application on file with the Administrative Hall, Donald H. Assistant, in an R-2 district on property described as Lot 12, Blk. 439, Corona del Mar Tract, and further located at 418 Lot 12, Blk. 439, Marguerite. C.D.M. Tract On motion of Com. Reed, seconded by Com. Hayton, and carried, application #154 was set over to Sept. 16, 1954 healing, and set over to Commissioners Hayton, Keene, and Reed appointed to further study the Sept. hearing. application. Schiller for a 10 foot Waterfront setback, V - #155 zero sideyard setbacks, and a 4 foot rearyard setback for a proposed 4-unit apartment building with five detached garages on a C-1 -H Schiller, Mxs.Carl district parcel consisting of Lot #22 and easterly * of Lot #23, Lot 22 & 7 Lot 23 Tract #1622, located at 3424 Via Oporto. A variance is required by Tract Section 9105.4(g) as amended by Ordinance #702. #1622 On motion of Cam. Hayton, seconded by Com. Copelin, and carried, application #155 was set over to Sept. 16, 1954 hearing for the set over commission to further study the application. Application of Harry M. Kelso for a 10 foot waterfront setback, zero V - #156 sideyard setbacks, and a 4 foot rearyard setback for a proposed 4 -unit Kelso, Harry M. apartment building with five detached garages on a C -1 -H district Lot #24, & -+ parcel consisting of Lot #24, and the westerly * of Lot #23, Tract #1622 Lot #23, located at 3432 Via Oporto. A variance is required by Section 9105.4(g) Tract #1622 as amended by Ord. #702. On motion of Com. Copelin, seconded by Com. Hayton, and carried, set over application #156 was set over to Sept. 162 1954 hearing for the commission to further study the application. (Set over from July 15th meeting due to °the applicant not being U.P. - #151 present at that hearing) Edler, Vernon Application of Vernon Edler to allow the operation of a boat sales Lot A, Tr.#919 yard on a C -1 -H district property described as a portion of Lot A. Tract #919, and located at 2226 W. Coast Highway. Required by GRANTED Section 9103.52 of the City Code. W The hearing was declared open. FINDINGS: A boat sales operation as applied for herein is consistent ' with similar existing operations in the immediate adjacent area, and in appearance is of the general character of commercial waterfront areas. The hearing was closed upon motion of Com. Copelin, seconded by Cox. Hayton, and carried. Com. Copelin moved that the application be granted, seconded by Com. Rayton, and carried by the following roll call vote, to -wits . ALL AYES Application of B. E. Hoffinger to rent boat slips located in a "U" district waterfront area adjacent to a C-2 district land area for use U.P. 0154 by private boats only and not to include any use by commercial or Ho£ finger, B.E. charter boats. SAdd C-2 property is described as Lot 12, Blk. 219, Lot 12, B1k.219 Section A. Newport Beach, and that property lying between said Lot 12 Sec.A.Npt.Beach and the U S. Bulkhead line of Newport Bay, and located at 221 - 19th St. As the applicant was not present nor represented, this application was set over set over to the meeting on Sept. 16, 1954 on motion of Com. Copelin, seconded by Com. Reed, and carried. Second hearing on application of David I. Nielson, M.D. to amend zoning Ord. #635, Section 9103.1 from an R -1 district to a C-1 -H district on U.P. Lot 19, 'Tract #1136, located at 406 Westminster Ave. Adjacent lots 17 & 18 are now zoned C-1 -H. Amendment #7 Dr. Nielson desires to erect a medical building on Lots 18 & 199 ' facing Westminster Ave. with appropriate off - street parking. Nielson, David I. Recently annexed Lot 26, Blk. 8, Tract #27 directly across Westminster Ave. from ADOPTED said Lot 19 is now being used for commercial purposes. Adjacent and surrounding property should not be adversely affected by the 0-1 -H zone and no objections were received. The hearing was closed upon motion of Com. Reed, seconded by Com. Hayton, and carried. Com. Briggs moved that Amendment #7 be adopted, seconded by tom. Reed, and carried by the following roll call vote, to -wit: ALL AYES Second hearing on Planning Commission Resolution of Intention #585 to amend zoning on the recently annexed Stricker Annexation from a A>psadment #8 "U" district to zoning districts available in Zoning Ord. #635 that Res. of Intention would be appropriate for land uses existing or proposed. The first #585 hearing was held July 15, 1954 and it was proposed to send question- Stricker Annex. wires to each property owner in the annexed area. This was done and the results have been tallied on maps attached to the application on set over for file -with the Administrative Assistant. 3rd hearing. The hearing was closed upon motion of Com: Bri #gs, seconded by "om. Copelin, and carried. Upon motion of Com. Copelin, seconded-by Com. Briggs, and carried, Resolution of Intention #585 was set over to next meeting to take under advisement the zoning and frontyard setbacks, and announce decision at next meeting. 90 Application for approval by the Irvine Co. as presented by Jack S. Tentative Map of Raub, August 2, 1954• 1 letter has been received from the City , Tract #2334 Engineer recommending approval of the tentative map by the Planning Commission. FINDINGSs A resubdivision of a portion of Tract #1700 and #1701 APPROVED wherein 22 lots were created from 29 lots thus improving the lot size. Com. Copelin moved that Tentative Map of Tract #2334 be approved, seconded by tom. Hayton, and carried by the following roll call vote, to-wit- ALL AYES Application for approval by the Irvine Co. as presented by Jae$ S. Final Map of Raub, licensed land surveyor. A letter has been received from Tract #2334 the City Engineer recommending approval of the final map by the Planning Commission. APPROVED FINDINGS: Final Yap agrees with Tentative Map previously approved. Com. Copelin moved that the Final Map of Tract #2334 be approved, seconded by tom. Hayton, and carried by the following roll call vote, to -wit: ALL AYES Application for approval by the Irvine Co. as presented by R. L. Tentative Map of Patterson, Civil Engineer. Letter received from the City Engineer Tract #2172 recommending approval of the tentative map of Tract #2172. , FINDINGS: An increased street width for harbor Island road is APPROVED offered and 5 adequate size lots are provided thus inproveing the area. Com. Copelin moved that the Tentative Map of Tract #2172 be approved, seconded by Com. Hayton, and carried by the following roll call vote, to -wit: ALL AYES Application for approval by the Irvine Co. as presented by R. L. Final Map of Patterson, Civil Engineer. Letter received from the City Tract #2172 Engineer recommending approval of the Final Map of Tract #2172. FINDINGS: Final Map agrees with Tentative Map of Tract #2172. APPROVED Com. Copelin moved that the Final Map of Tract #2172 be approved, seconded by Com. Hayton, and carried by the following roll call vote, to -wit: E:rOs�:� °� Letter received from the City Glerk for the City Council accepting the annual report of the Planning Commission for 1953 -54, commending the service of the commissioners, and concurring with Variance Applications #150,4151, and #152. Letter was ordered filed. . Referred from the Orange County Planning Commission, Use Variance ' Permit Application #W -1359. As the County meeting preceeded the City Planning bommission meeting, the referral was ordered filed. 91 The discussion of Professional Offices was set,over to the meeting of September -16, 1954 ' L. M. Holbrook, Administrative Assistant, presented a plan for a proposed 32nd St. cutoff with ground acquisition to include an area for a proposed playground #l. The plan was tabled for later discussion. Notice was received of National Planning Conference of the American Society -of Planning Officials to be held in Philadelphia, September 26th to 30th, at the Benjamin Franklin Hotel. The notice was ordered filed. Walter Longmoor was unanimously re- elected to the office of Chairman of the Planning Commission. Election Of Ray Y. Copelin was unanimously re- elected to the office of Secretary Officers of the Planning Commission.
