cation to the Planning Commission and gave the
staff report in connection therewith. In addition
to the conditions recommended..in the staff report,
there should be a third condition that any propose
signing on the property would conform to the R -4
District, which would be a maximum of 12 sqe ft.
Planning Commission and Staff.discussed whether or
not a parcel:.map should be filed because of the
proposed building across property lines and also
whether or not this project should be considered
a motel or an apartment building as outlined in
the staff report,:
Bob Seiling appeared before the Planning.Commissio
on behalf of William Stine, the owner and.applican
He presented pictures for review by the Planning
Commission showing.how the motel will look and
also the position of the signs. Square footage of
signs and yard setbacks were discussed.
Lew Kiser, 2010 W. Ocean Front appeared before the
Planning Commission in opposition of this matter
stating that the proposed project -is.a gross-over-
use of the land and the units are too small,
Planning Commission discussed the project and
inquired of Mr. Seiling whether or not the.appli-
cant would be willing to amend this application
to which Mr. Seiling- replied that they preferred:
the application to remain as- submitted.

Goldie Joseph, owner of property to the east,
appeared before the Planning Commission stating
that she is opposed to an alley and questioned
the zero setbacks on Ocean Front.
Following discussion which revealed that a,public
hearing in connection with the alley has -been
scheduled by the City Council. for September 13,,
1971, the applicant requested that this matter be.
continued to September 16, 1971, to which. the
Planning.Commission gave their consent;
Commissioner Adkins:on stepped down on the follow -,
ing item due to the fact that he is a. general
partner in two partnerships which hold long term
leases on Mariner's Mile, a part of the proposed

Civic District.

recommended approval of the proposed ordinance
with the following modifications: 1. Two years
is too much and one year is plenty. 2. The area
covered should include all of Newport Beach with
a few possible exceptions, such as Fashion Island,

etc. 3; Eliminate.the provision that.all buildings
over 35' will become nonconforming; 4. That the,
freeze not be a guideline for,pl.anners doing the
master plan as they need•the opportunity for free

thinking. 5. During the period the height limita-
tion is in effect, the City investig.ate and imple-
ment.some.form of monetary relief for property
owners hurt monetarily through no wrong doing of
their own;
Commissioner Martin commented on -.his participation
in connection, with the Civic,District Committee
and stated he- believed.that.a height limitation
to a portion of the City.was unfair and:.it should
cover the entire City of Newport Beach.
James Parker, Attorney, 4201 Birch Street, Newport
Beach, representing Occidental Petroleum Land and
Development Corporation appeared before the
Planning Commission and recommended that the
ordinance be rejected and the zoning restored.
Also, if a Civic District is to be formed, it
should cover all water oriented property in the
City and not just a portion.
Barbara Stabler,-123 Via Undine, appeared before
the Commission and stated she did not think there
•
was any threat of a referendum as previously
stated.
Mrs. Stanley Nash, Cliff Drive, appeared before th
Commission and stated that- -.the City of Newport
Beach should be preserved, no.t just the view from
Cliff Drive,
Pauline Howard, owner.of an apartment on the
peninsula,,appeared before -the Commission and
voiced her opposition to highrise buildings.
William Bluerock, Architect appeared on behalf of.
Ardell Marina, Ardell Investment Company, and..
himself, stating their,.opposition to the moratoriu
and the ordinance.
Carl Kymla, City Council's,appointed Chairman of
the Lower Newport Bay Civic`Districi appeared
before the Planning Commission. He commented
on the forming of the Civic District and the inten
of same which was, to protect a public asset. In
1933, the people stated they wanted to acquire -and
improve a public asset; after that ;time people
bought property.adjoining the public asset; The
•
situation is now that private property rights and
public assets must work together. He believed it
was important that this ordinance be enacted and.
that_.any initiative be held in abeyance in order
that,Newport Beacn could have good sound planning.

believed that we have a good:sound program and we
should look at things more carefully before apply-
ing the 35' moratorium.

before the Planning Commission representing the
developer in this matter. He stated that the .
applicant was agreeable to all of the recommended
conditions with the exception of No. 8 pertaining
to the dedication of a 10 foot public walkway
adjacent to the existing bulkhead around the chann

2. That appropriate encroachment permits be
obtained from the State Division of Highways
for all work within the Pacific Coast Highway
right -of -way.

3. That street lights be installed along the
Pacific Coast Highway frontage.
4. That the boundary of the final map be.checked
by the County Surveyor before being submitted .
to the City for approval.
5. That Section 19.16.030 of the Subdivision
Ordinance regarding map scale be waived pro -
vided maps drawn accurately to a scale of
1" = 100' are furnished to the Public Works
Department immediately after approval of the
final map.
6. That the types and locations of street trees
be provided to the specifications of the Parks
Beaches, and Recreation Department and that th
standard inspection,fee of $3.00 per.tree be
paid. A parkway.sprinkler system shall be
installed with a bubbler head for each street,
tree to insure adequate irrigation.
7. That the design of vehicular access connection
to Pacific Coast Highway and River Avenue be
subject to review and approval by the City's.
