MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, AUGUST 259 1952, AT 7 :30 P.M.
IN THE COUNCIL CHAMBERS OF THE NEWPORT BEACH CITY HALL
ROLL CALL: Commissioners Present: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd
and Smith. Commissioners Absent: Ellerbroek. and Wightman.
MINUTES: Upon motion of Commissioner Reed, seconded by.Commissioner Pleger, the
minutes of the regular meeting of July 17th were approved as submitted, to the Com-
mission. Motion carried.
The minutes of the adjourned meeting of duly 23rd were approved as submitted to the
Commission upon motion of Commissioner Reed, seconded' by. Commissioner Plaer and
carried.
PUBLIC BEARING 5s
USE PERMITS: First was the application of R. C. Benner for Use Permit to exceed ;
three units per lot in Rr-3 zone at 1244 -48 w. Balboa Blvd. Chairman Longmoor opened
the hearing and asked if anyone wished to be heard for or against.
-- Harold Young, spoke protesting application. congested condition in the neighbor-
hood already. Thinks should be made to adhere to ordinance.
Secretary Gopelin read two written protests from Mr. Young and H. B. Baetz and then
the committee report etating that committee doesn't object to building of garages
provided that the sideyard setbacks are maintained. Committee recommended denial
on Use Permit and Variance application. Would set precedent in that area. Traffic
problem & population have to be considered.'
Commissioner Pleger moved the hearing be closed, seconded by Commissioner Copell%
and carried. Commissioner Copelin made a motion that in view of the committee report,
the Use Permit be denied, motion seconded by Commissioner Reed and carried by the
following roll call vote, to -wit:
AYES: Commimioners: Briggs, Copelin, Longmoor, Pleger, Reed, and Rudd, & Smith.
NOES: None
ABSENT: Commissioners: Ellerbrosk and Wightman.
Variance application in connection with above for " -0-. sideyard setback on 13th Street
and relief from Section 9103.35(b) of the Zoning Ordinance.,
Commissioner Pleger moved hearing be closed, seconded by Commissioner Rudd and
carried. Jurther discussion from floor. Commissioner Copelin made motion in view
of committee report and Use Permit being denied, to aldo deny Variance application.
Motion seconded by Commissioner Reed and carried by the following roll . call vote,
to-wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, & Smith.
NOES: None
ABSENT: Commissioners: Ellerbrosk and Wightman.
Application of'_J_, E. Jackson for permission to put in Automatic Laundry at 706
Coast Blvd., Corona del Mar. (Lot 5, Tract 1045) C-1 zone. Chairman opened the '
hearing and asked if anyone wished to speak for or against. Applicant was present
and stated that 16 units were to be used. Commissioner Pleger spoke for the in-
vestigating committee and recommended that application be granted.
Commissioner Copelin moved the hearing be closed,. seconded by Commissions Briggs
and carried.

Commissioner Copelin then made a motion that the application for automatic s
laundry be granted, seconded by Commissioner Pleger and carried by the fol-
lowing roll call vote, to -wit:

NOESs Commissioners: None
ABSENTS Commissioners: Ellerbrosk, and Wightman
Application of Hazel M. Bannister for permission to construct double garage
(&nly) on property at 204. 34th Street, Newport Beach (Lots 3 & 4 ) building
to go on Lot 3) Block 133, Lake Tract.
Commissioner Copelin stated that five commissioners had been over to look at it
and Tel that in view of the fact that they had the place on the corner with one
garage Snd four cars, that would be justified in granting the permit.. Wou&d
work no hardship on anyone in area. No living quarters over or in the garage.
Commissioner Reed made a motion that the hearing be closed, seconded by Con-
missioner Copelin and carried.
Commissioner Rudd then made a motion that the application be granted, seconded
by Commissioner. Reed and carried by the following roll call vote, to-wit:
AYESs Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, & Smith.
NOES: Commissioners: None
ABSENT: Commissioners: Ellerbrosk, and Wightman
Chairman Longmoor stated that three additional Use Permit applications had
' come in since the agenda was prepared, the first was that of Charles E Scht t
for a tool & the machine shop at 422 31st Street, Newplr t Beach, Lancaaters
Addition, Block 3319 Lot 20) The proposed shop is in a C-2 zone.
Commissioner Copelin asked that the matter be set over in view of the fact that
no one was present to talk on it and he owns the lot next door of it and would like
it investigated further. Motion seconded by Commissioner Reed and carried.
Application of 'Nei�C� for manufacturing rubber diving suits at 6904 Coast
Highway, Newport Beach. (Seashore Colony Tract, Block 9, "a 3-4,5) C-1 -0 zone.
Mr. (lox was present and stated that it was all hand work—no precessing done.
Work in sheet rubber --cold cement. Ceramic-manufacturing in other half of build-
ing to be occupied. Parking area in front on setback from highway. 1250 square
feet in building. From 3 -5 employees including a1Neill & Cox.
Commissioner Copelin madd motion application be granted seconded by Commissioner
Briggs and carried by the following roll call vote, to-wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, & Smith.
NOES: Commissioners: None
ABSNNT: Commissioners: Ellerbroek, and Wightman.
The last Use Permit application was forA .B. Porter fpr a work shop and garage .
on the Swly 201 of Lot 637 and NEly 101 of Lot 638, Tract 907(112 Via Lorca,
Newport Beach).

After further discussion.. Commis ioner Reed made a motion that hearing be
closed, seconded by Commissioner Copelin and carried. Commisdoner Pleger made
a motion that the application be granted as submitted by plans showing the
entire project as one unit. Motion seconded by Commissioner Rudd and carried by
the following roll call vote, to-wits

VARIANCES:
First Variance application was that of.Mrs. Bruce Bundy to complete room &
bath on third level of house for occupancy on portion of Lot IDI, Corona del
Mar. (1709 Pacific Drive, Corona del Mar.).
Chairman Longmoor declared the hearing open and asked if anyone wished to
speak for or against.
- -Sohn H. Poole, 1718 Padific Drive, Corona del Mar, spoke against the granting
of the application on grounds that it will cause deterioration of residential
property values in the area.
Commissioner Pleger spoke for the committee report and said that it involved
again setting a precedent. Building code specifies two stories or 35' height
limit. Any floor line more than six feet above ground is considered story,
less than six feet is considered basement. Recommended denial.
Mrs. Bundy was present and spoke for the application and answered questions
of the Commission.
Commissioner Pleger moved the hearing be closed, seconded by Commissioner
Reed and carried. Commissioner Pleger then made a motion that the above ap-
plication be denied; seconded by Commissioner Smith and carried by the follow
ing roll call vote, to -wit: '

Application of Nay Beatty Neighbors for an eighteen inch sideyard.setback ih-
stead of required three feet on the Ely 301 of Lots 8-9- 10-11, Block 25,
Balboa East Side Addition. (1619 East Bay Front, Balboa)
Chairman declared the hearing opened and asked if anyone wished to speak for
or against.. Applicant not present. Secretary read the committee report.
Lot is 301 x 1291. Desires to .continue Ely line of house on 18" line.
Committee could see no hardship involved and recommended denial of the appli-
cation. Commissioner Copelin made motion hearing be closed, seconded by
Commissioner Reed and carried. Commissioner Copelin made a motion that the
application be denied in view of the commi ttee report, seconded by Commis-
sioner Reed, and carried by the following roll call vote, to-wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, & Smith.
NOES: Commissioners: None

Application of V. I. Par tch to allow a three foot overhang on garage apartment
on Lot 3, Block 8,.Section Two, Balboa Island (205 Coral Ave.) Chairman de- '
Blared the hearing open and asked if anyone wished to speak for or against.
The committee report stated that it could see no reasons for not granting the
overhang since it was the customary procedure in that area; however, recom-
mended a 216" instead of three feet applied for.
Commissioner Pleger made a motion that the hearing be closed, seconded by Com-
missioner Rudd and carried.

Commissioner Reed then made a motion that the application be granted for a
216" (or 50%) Variance, seconded by Commissioner Copelin and carried by the
following roll call vote, to -wit:

NOES: Commissioners: None
ABSENT: Commissioners: Ellerbroek and Wightman
Application of Norman H. Smedeesard for relief from Section 9105.4(b) of the
Zoning Ordinance on NEly 251 lot 9, and Sally 151 Lot 11, Block 234., Corona
del Mar. (309 Heliotrope Ave) This is to allow an existing two foot overhang
into a sideyard.
Chairman dedlared the hearing open and asked if anyone wished to speak for cr
against. Applicant present.and spoke for. Secretary read Mrs. Powers tele-
gram regarding protest to application: Committee report feared estbalishing
of precedent and upon due consideration had recommenddd denial. After con-
siderable discussion, Commissioner Copelin made a motion to close the hearing,
seconded by Commissioner Reed and carried.
Commissioner Pleger made a motion to deny application, seconded by Commis-
sioner Reed.and carried on following roll'call vote, to-wit:
AYES: Commissioners- Briggs, Copelin, Longmoor, Pleger, Reed, Rudd,.& Smith.
NOES: Commissioners: None
ABSENT: Commissioners: Ellerbroek and Wightman
Application of Richard L. Kirtlabd to allow a two & one half foot overhang on
garage. apartment extending into the rear d setback on Lot 23, Block 4, Sec-
tion One, (210 Emerald Ave) Balboa Island Committee reported that it was
another case of a overhang on Balboa Island that had already been established
as policy, and could see no reason why it couldn't be granted.
Commissioner Copelin made a motion that the hearing be closed, seconded by
Commissioner Smith and carried. Commissioner Rudd then made a motion that the
application be granted, seconded by Commissioner Reed and carried by the fol-
lowing roll call vote, to -wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, & Smith.
NOES: Commissioners: None
ABSENT: Commissioners: Ellerbroek and Wightman
Application of J. E. Talbott for change in.side.yard setback from required
three feet to fifteen incises on Lot 6, BlockZ, Newport Beach Tract.
(3510 Ocean Front) No communications. Commissioner Copelin reported that the
committee upon investigating it could find no hardship. The garage when tbru
down, which was non - conforming on setback lines) would then have to conform .
with ordinance and there was no hardship in having to comply with ordinance.
Commissioner Smith moved the hearing be closed, seconded by CommissiorE r
Pleger and carried. Commissioner Rudd then made a'motion for the denial 6f
the application, seconded by Commissioner Reed and carried by the following

roll call vote, to -wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Ru:id, & Smith.
NOES: Commissioners: None
ABSENT: Commissioners: Ellerbroek and Wightman
Application of 0 A Jones for a four foot rear,yard setback instead of required
five feet on Lot 10, Block 9, Section Two, Balboa Island (216 Diamond Ave)

Committee recommended denial on the application stating that it would mean
adding another foot to the garage and encroaching on the setback.
Mr. Jones was present and stated that there were a number of buildings on the '
alley that do not conform with the setback - that the house is brick, stal
reinforced vertically and horizontally - can't tear the wall out. Commissioner
Rudd moved hearing be closed, seconded by Commissioner Copelin and carried.
Commissioner Copelin then mood that the application be.denied, seconded by Com-
missioner Rudd and.carried by the'following roll call vote, to -wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed,. Rudd, & Smith
NOES. Commissioners: None
ABSENT: Commissioners: Ellerbrosk, and Wightman
Commissioner Copelin brought up the matter of the Use Permit issued to the Scuth
Coast Company which will have to come up for renewal September meeting and
that they had not complied with the terms of the Use Permit in supplying the
required off - street parking facilitea. The Secretary was directed to write a
letter to the Couth Coast Company advising them of the above andasking that the
dituation be remedied.
Chairman Longmoor appointed the following committees to act on the remaining
parts of the Master Plan:
Street & Highway Plan - Reed, Webb, & Longmoor.'
Parking Plan - Copelin, Ellerbroek, & Webb ,
Park & Recreation - Smith, Rudd, & Wightman (refer to Park, Beach, & Recreation)
Tree Planting - Briggs, Pleger, & Rudd
Public Buildings - Ellerbrosk, Pleger, & Nelson
ADJOURNMENT: There being no further business to come before the Commission,
Commissioner Reed made a motion for adjournment, seconded by Commissioner Pleger
and carried.
