HomeMy WebLinkAbout08/24/1938AUGUST 24, 1936 - TER NEWPORT BRACT.'. CITY PLANNING COMMISSION met in regular session Wednesday, August 24, 1938 at 7:30 plm. in the Council Chambers, City Hall. Meeting %alled to order by the Secretary. In the absence of Chairman Hopkins it was necessary to appoint a temproary chairman. Com.Findlay moved that Com.Schnitkor act as tempnnary Chairman. Seconded by Com.Seager. Motion carried. ROLL CALL - Commissioners present: Stager, Schnitker, Williams. Findlay, Patterson. Commissioners. absent: Boppkins, Briggs, Whitson, Hodgkinson. Attuy.Thompson, Mr,Tiltou, consultant, and Bldg. Inep. Nelson attmaded. MINUTES - Chairman Schnitker stated that if there were no objection or corrections, the minutes of meetings hold July 27, July 30, August 10, August 11 and August 17 would stand approved as written. No objections or corrections. So ordered by the Chairman. HEARINGS - APPLICATION FOR VARIANCE Application of C.B.Stanford, owner of lot 8, blk 5, sec 2, Balboa Island, for a front yard variance of 180 to allow construction of a balcony on the house being remodeled upon said lot W read by the Secretary. He stated that the hearing had been advertised, plans posted, notices sent to surrounding property owners and all other requirements of the ordinance complied with. One protest was read from J.Wm.Smith, owner of lot 13, blk 5, sea 2. Chairman iequ�red it anyone present wished to speak on this application. No response. Attay. Thompson expressed the opinion that the Planning Co::-mission has no jurisdiction to grant any further variance as the present set back is 5 ft. Com.Williams was not it favor of making any exceptions in the ordinance by granting a vari- ance under these circumstances. Com.Williame moved the adoption of Resolution No. 135, recommending to the City Council that the application of C.B.,Btanford for an 150 front yard variance upon lot 6, blk 5, s062, Balboa Isled be denied and that the Secretary be instructed to transmit the same tb the City Council as the recommendation of this commission and a copy be Piled as a part of the minutes of this meeting. Seconded by Com.Pattersen. Holt call vote: Ayes: Schnitker, Seager, Williams, Findlay, Patterson. Noes: None. Motion carried and so ordered by the Chairman. APPLICATION FOR VARIANCE Application of Mr. & Mrs. McKinley for a front yard variance on their lot 3, blk 1, Newport .Bag Tract to allow an addition to residence on this lot was read by the Secretary. He stated that the hearing had been advertised, plans posted, notices sent to the surrounding property owners and all other requirements of the ordinance complied with. One protest was read from Grace G.McCunn, Joan MaCuen and Annie Grace McCune, owners of 206 last Surf Ave'. Chairman inquired if anyone present wished to speak on this application. No response. Bldg. Insp.Nelson stated that allowing this variance would make this house line up with the other houses in the block. The variance is applied for to allow construction of a sun perch an the upper floor. Com.Patterson's opinion was that, since the commission had just denied a similar request, this application should also be denied. Com.Pattorson moved the adoption of Resolution No. 136, recommending to the City Council that the variance application of Mr. & Mrs.Mokinley for front yard variance on lot 43, blk 1, Newport Bay Tract be denied and that the Secretary be instructed to transmit the mama to the City Council me the recommendation of this commission and a copy be filed as a part of the minutes of this meeting. Seconded by Com.Williams. Roll call vote: Ayes: Schnitker, Seeger, Williams. Findlay, Patterson. Nose: None. Motion carried and so ordered by the Chairman. APPLICATION FOR VARIANCE Application of H.M.Davis, owner of store building on lot 9, blk 132, re- subdivision of Corona del Mar for permit to construct an addition thereto was read by the Secretary. Re stated that the hearing had been advertised, plans posted, notices sent to the surrounding property owners and all other requirements of the ordinance complied with. The application was aecompan- ied by a petition signed by 10 property owners in the neighborhood favoring the addition. Mr. Belson stated that thestore building is a non - conforming use. Mr. Davie was present and explained that his object in making addition to the building is to make additional room for storage of boxes which are now outside of the building and felt that such addition would make the building more sightly and more desirable to the neighborhood. Mr. Tilton advised the commission that the ordinance designates that non - conforming build- ings shall be hold to their present confines, the object being to eventually gat rid of them entirely. In this manner the status of residential areas is maintained. A non - conforming use may be remodeled when it can be shown that it will be an improvement to the neighborhood and be made to conform'mors closely to the surrounding buildings. It is up to the commission to &aside whether or not they wishto establish a precident by permitting such remodeling or additiot to a non- conforming building. Y2� Com.Willisms stated that it would be an improvement to the neighborhood and that the shore is meat convenience to residents of that section, she favored allowing the addition. Com.Seager said he had viewed the proprty and that to far as being an improvement or add- ing anything to the appearance, it will not; usither will it add anything detrimental. They simply wish to enlarge the present building 14 ft. Com.Patterson inquired if the commission should permit addition to a non - conforming use. Mr.Tilton stated that if this improvement will result in some improvement to the go=K -al appearance of the neighborhood, the commission should to will ing to grant permit for it. The commission must remember, however, that the wholi scheme should be to eventually eliminate all non - conforming uses. Mr. Davis stated that be realised that he will eventually have to take the store out of his building and make it into residential property; at the 'present time, he wishesto make the building more sightly in appearanos and add storage room to the store. Com.Williams moved the adoption of Resolution No. 137 recommending to the City Council that a permit to construct an addition to a non - conforming building on lot 9. blk 132, re- subdivision of Corona del Mar be granted to H.M.Davis and that the Secretary be instructed to transmit the same to the City Council as the recosmednation of this commission and a copy be filed as a part of the minutes of this meeting. feeeeaed Seconded by Com.9sager. Fleming (Mrs.James), owner of Easterly 25ft. of Lots 27&28, blk 7, sea 5. Balboa Island for a W% front, 50% side and 50% rear yard variance was read by the Sec- retary. Re stated that the hearing had been advertised, plans posted. notices sent to the surrounding property owners and all other requiEemeuts of the ordinance complied with. He also stated that this property was so subdivided prior to the adoption of Ordinance 440 and bad so appeared on the tai rolls for several years. Chairman Schnitker inquired if anyone present wished to speak on the application. Mr. Hyer stated that none of the property owners in the neighborhood object to the granting of these variances. Pepito Escobar, the adjoining property owner is in favor of allowing the variances. No written protests were reveived. No one was present to protest the granting of these vari- ances. Com.Ssager stated that he is familiar with the property. The lot is small and the variances are necessary to allow any building on the lot. He felt the commission should grant these var- lances. Com,Ssager moved the adoption of Resolution so. 138 recommedning to the City Council that a 50%, 5 ft, front yard, 50%, ls" side yard and 50%. 5 ft. rear yard variance be granted to Marian M. Fleming (Mre.James) on•Bastely 25 ft. of lots 27 &2S, Blk 7, Sec 5, Balboa Island and that the same be transmitted to tb City Council be the Secretary as the recommendation of this commission and a copy be filed as a part of the minutes of thin meeting. APPLICATION FOR PERMIT Application of the Irvine Company for permit to construct comfort stations, bath rooms, lavatories and open -air grills and installation of tables and benches on their property lying between Bayside Drive and the easterly shore of Newport Bay was read by the Secretary. He stated that the hearing had been advertised, plane posted, and all other requirements of the ordinance complied with. The plans of the proposed improvement were explained by Ml.Tilton. He explained that picnic grounds were permissible in an R -1 zone if not used for commercial purposes, a small fee for parking might be charged to defray expenses. It was the opinion of the commission that it was not necessary to present the matter to this commission as this is a permissible use under the ordinance. Mr. Tilton stated that Mr. Billie washed to have the approval of the Planning Commission before applying for permit. Com.Patterson moved the adoption of Resolution No. 139, recommending to the City Council that a permit be issued to the Irvine Company for constnuetion of the improvements as applied for on their property lying between Bayside Drive and the Easterly shore of Newport Bay, and the Secretary be instructed to.tranamit the same to the City Council an the recommendation of this commission and a copy be filed as a part of the minutes of this meeting. Seconded by Com.Pindlay Roll Call vote: Ayes: Schuitker, Seager, Williams, Findlay, Patterson. Now None. Motion carried and so ordered by the Chairman. SECOND HEARING (CONTINUED) ON REZONING OF CITY -OWNER PROPERTY BETWE'CY+T NORTH CHANNEL AND STATE HIGHWAY FROM H-2 to M -1. Chairman called for diseassion.of this matter, The opinion of the commission was that rezoning this property would be detrimental to sur- rounding property. -3- Com. Patterson moved the adoption of Resolution No. 148 recommedniug to the City Council that no change in the zoning be made on that parcel of City -owned property lying between the North Channel of Newport Bay and the State Eighway and that the Secretary be instructed to transmit the saes to the City Council as the recommendationodthis commission and a copy be filed as a part of the minutes of this meeting. TUTATM APPROVAL OF PLAN FOR RHOREATIONAL CZNTER aT CORONA ➢Iii MAR - City Engiaser Patterson presented for tentative approval the peens of the recreational center at Corona del filar. He explained the plane to the commission. Com.Findlay moved that the Planning Commission tentatively approve the plans for the Recreational Center at Corona del .ear for the purpose of making application to the P • A. Seconded by Coa.Williams. notion carried and so ordered by the Chairman. TENTATIVE APPROVAL OF PLANS ION RECONSTRUCTION OF tTWPORT PIER - City Engineer Patterson presented for tentative approval the plans for reconstruction of the Newport Pier. He explained the plane to the commission. Oom. Findlay moved that the Planning Commission tentatively approve the plans for reconstruct- ion of the Newport Pier for the purpose of making application to the P.W.A. Seconded by Com. Patterson. Motion carried and so ordered the by the Chairman.
