AUGUST 29, 1939.
THE NEWPORT BEACH CITY PLANNING COMMISSION met in adjourned
regular session August 29 1939 at-7:30,P-m. in the Council
Chambers, City Hall: Chairman Hopkins presiding.
Meeting called to order by the Chairman.
Secretary stated that this was an adjourned regular
meeting from August 24, 1938-
ROLL CALL -
Commissioners present: Hopkins, Seager, Williams,
Briggs, Findlay, Patterson.
Commissioners absent: Schnitker, Whitson, Hodgkinson.
City Attny. Thompson attended.
MINUTES -
Secretary moved that the reading of the minutes of the
meeti* held August 24, 1939 be dispensed with as all members
had received copies thereof and that they be accepted as writ-
ten. Seconded by Com. sindlay.
Motion carried and so ordered by the Chairman.
CORRESPONDENCE -
A letter from Jose and Joan Escobar protesting the
granting of a 50 %, 5ft. front yard variance to Mr. and Mrs.
James Fleming on Easterly 25 ft: of Lots 27 & 28, Elk 7, See 5
Balboa, Island was read by the'Seerstary.
Mr. Granger Hyer was present and advised the commissice,
that, as stated at the last meeting, Mr. Escobar and he bad-
discussed Us variance and that Mr. Escobar had not objected':
to the variance at that time.
Chairman Hopkins stated that, as this variance had been
Called for hearing at the meeting on August 24th, and no
protests having been received at that time, the variance
had been recommended to the City Council, it is a closed
matter as far as the Planning Commission is concerned and
may not be reconsidered.
Coma Patterson moved that the Secretary so advise the
protestants.
Seconded by Com. Findlay.
Motion carried and so ordered by the Chairman.
HEARINGS -
FIRST HEARING • ON PETITION FOR REZONING
Petition of Mrs. Marian R. Delano for rezoning of Lots
1 to '9 inclusive, Elk 22, Balboa East Side Addition from
R -1 to R -2 classification, and the letter from the City
Council referring the application to the Planning Commission
was read by the Secretary.
The application was accompanied by 3 letters from adjoin -;
ing property owners in the block approving such rezoning.
Secretary stated that the hearing had been advertised
Land notices sent to 12 property owners in the block.

Chairman inquired if anyone wished to speak on the matter.
Mr. W. P. Boland said he and other neighbors in the
block were anxious to know just what this change insoning ,
meant. They wished to discuss the matter among themselves
before making any protests and wished to know if further
• time could be allowed for protests.
Chairman Hopkins informed him that this is the first
hearing and any protests may be presented to the commission:
at the neat hearing; Sept. 21st.
No further discussion.
Chairman Hopkins stated that as a matter of planning,
it should be difficult to change from the greater to the
lesser restricted zone.
Com. Patterson moved that this matter be sent to
second hearing September 219t, 1938 -
Seconded by Com. Williams.
Motion carried and so ordered by the Chairman.
SECOND HEARING - ON PLAN OF PROPOSED MUNICIPAL IMPRonaNTS
AS CONSTITUTING A CITY PLAN -
Secretary stated that the first public hearing on this
matter had been held August 17th; this is the final hearing
on the Plan.
Chairman inquired if nayone on the floor wished to be
advised concerning any of the items listed in the plan or if
anyone present wished to speak on any item.
No response.
Com. Patterson said that his last estimates show that
Item "A" will cost approximately $120,000 instead of $90,000,
figuring type A construction. "E" and "8 ", the Balboa Ocean
Front Improvement, will be $120,000 instead of $115,000.
Item "G" will cost $38,180 instead of $34,000; however,these r
estimates are for the completed projects. We can always
stop when the money is gone.
Attny. Thompson advised the commission that the approxi-
mate costs of each item had been placed in the legal advertis+
ment at the request of the bonding attorneys. .If these fig-
ures are increased, the public has been misinformed and the
bonding attorneys will raise that question. We can go under
the advertised figures but not over them. If the Council
finally adopts the plan, they will have to advertise the same
figures that the Planning Commission advertised. The figures
that we have before us are the only ones which we may con-
sider.
Attny. Thompson stated that a motion is now in order
adopting Resolution No. 141, recommending to the City Council
that all of the projects as advertised be approved as one
project and one general plan for municipal improvement; and
recommending to the City Council

that the matter be submitted to the vote of the electors
of the City of Newport Beach as to whether or not`sAid
Plan shall be approved. _
Com. Briggs as moved, Resolution No. 141.
Seconded by Com. Seeger.
Roll Call vote:
Ages: Hopkins, Seager, Williams, Briggs, Findlay,
Patterson.
Noes: None.
Motion carried and so ordered by the Chairman.
ADJOURNMENT—
On motion of Com. Williams, seconded by Com. Briggs
and carried the meeting adjourned.
