TENTATIVE S Tract 5878 The Commission considered the tentative map of Tract 5878, being a proposed subdivision of 22.42 acres divided into 90 residential lots and 2 green area lots of a Planned Residential Development located in the Eastbluf area and recommended approval, subject to the following conditions: Motion Second 1. That the boundary of the final tract map be checked by the County surveyor before being submitted to the City for approval. 3. That Section 9253.21 of the Subdivision Ordi- nance regarding map scale be waived provided maps drawn accurately to a scale of 1" . 100' • are furnished the Public Works Department. 4. That Section 9254.36 of the Subdivision Ordi- nance requiring that lots abut on a street be waived in accordance with the provisions of Section 9256.12, provided adequate access is furnished. 5. That Section 9254.31 of the Subdivision Ordi- nance regarding size and shape of lots be waived in accordance with the provisions of Section 9256.12. 6. That the requirement for a perimeter of public streets be waived in accordance with the provisions of Section 9108.5 of the P.R.D. Ordinance. 7. That all grading be in accordance with a grading plan and report approved by the Public Works Director and a qualified Soils Engineer. Upon completion of the grading, the Soils Engineer shall certify that the grading has been com- pleted according to the plan and the require- ments of the Grading Ordinance. That the design of the proposed private streets be approved by the Public Works Department. 9. That construction of the proposed private streets be inspected by the Public Works Department and that a standard inspection fee be paid; or, that construction be in- spected and certified by the Developer's Engineer. 10. That sewer easements of 15' width be provided; and that sewer access roads continuously accessible to maintenance vehicles for their full length be provided, with a surface which will be usable in all weather conditions. 11. That the developer post a cash deposit for the estimated cost of improving one -half of Back Bay Drive, Road A, and the road (shown as Road "B" on a map designated Exhibit "A" on file in the Planning Department), connect- ing Back Bay Drive to Road A. The improve - meet of these streets should be done at a later date as development and traffic needs • require, and when the configuration of Back Bay Drive has been determined. (In the case of Tract 5435, adjacent to the southwest, a cash deposit was posted with the City cover- ing the cost of future improvement of one- half of Back Bay Drive.) 12. That Lot 90 (high rise lot) is approved in concept but ghat a precise plan be submitted for review and approval by the Planning Commission prior to issuance of a building permit for the 10 story, 60 unit building. 13. That the street extending from the north end of Road A to the intersection of Back Bay Drive, be temporarily designated as Road "B ". USE PERMITS UP- 1054(F) GEORGE M. That University Drive be improved to a width • at least sufficient for 2 travel lanes and a parking lane, that all utilities necessary be constructed, including a 12" water line on University Drive, and that underground street lighting be installed. That the City pay the difference in material cost between an 8" and a 12" water line in University Drive as was done in the case of 'Tract 4444. The size of the line is increased so that it can form a part of the Upper Bay water loop. 12. That satisfactory surety be posted and an agree- ment be executed to guarantee completion of improvements and that a standard inspection fee be paid. 13. That all grading be in accordance with a grading plan and report approved by the Public Works Director and a qualified Soils Engineer. Upon completion of the grading, the Soils Engineer shall certify that the grading has been completed according to the plan and the grading ordinance. A reproducible copy of the grading plan on a standard size sheet shall be furnished to the Public Works Department. 14. That all improvement plans be prepared on standard size sheets by a licensed Civil Engineer. • 15. That access rights to University Drive be dedicated to the City except at the westerly end of the Y.M.C.A. site. CITY COUNCIL REFERRAL 1. Variance No. 866 (Signs on Newport National Bank) con- ditionally approved by the Planning Commission, appealed to the City Council and referred back to the Commission by the City Council on July 26, 1965 at the request of the applicant and placed on the agenda for August 5th, August 19th and September 2nd, was tabled indefinitely until the applicant submits new evidence to the staff, Motion x at which time it will again be placed on the agenda. Second x All Ayes COMMUNICATI4 INS Chairman Curtis asked to be excused from the rostrum and Vice Chairman Jakosky took over the meeting. 1. The Commission considered a request from David W. Curtis to construct garages on the front one half of Lot 1, Tract 5425, Zone R -3 -B, in accordance with Section 9105.4(h) of the Newport Beach Municipal Code. iThe Commission approved the request for an accessory Motion x building or buildings on the front one -half of Lot 1, Second x Tract 5425 subject to the condition that Mr. William P. All Ayes Ficker (representing the principles on Lot 2, Tract 5425) file a letter with the Planning Department Page 5. Chairman Curtis returned to the rostrum. 2. A memorandum from the Planning Director dated August 24, 1965 regarding Use Permit No. 1027 approved by the - Commission on April 2, 1964 for a period of 2 years, permitting-on-sale alcoholic beverages in connection with a restaurant at 209 Palm, Balboa, California, was Motion x referred to the staff for further study. Resolution No. 680, being A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO CONSIDER CERTAIN AMENDMENTS To ARTICLE IX OF THE NEWPORT BEACH MUNICIPAL CODE TO,DELETE SECTION 9104.14 (CHANGE IN • SETBACKS) was adopted and set for public hearing on September 16, Motion X 1965 at 8:00 P.M. in the City Council Chambers.
