Owner: City of Newport Beach and County.of Orange Planning Director Wilson presented the applica- tion to the Commission and stated that one of the major questions is the adequacy of parking on the site to accommodate this use in addition to those already established.. Newport Arches • Marina has for some time been trying to negotiate a lease with the State Division of Highways and at a meeting last Monday, a tentative agreement was reached for a limited portion of their property. Location: Lots 9 through 16, Block 8, Balbo Tract, located at 600 -614 East Ocean Front, on the northerly_ side of East Ocean Front, between Palm and Washington Streets. . • Zone: C -1 Applicant: Rolly Pulaski Owner: Mr. & Mrs..Ernest Neufeld, Wasco, California Planning Director Wilson presented the applica- tion to the Commission and stated that the pro- posed development could not take place in the C -1 zone under the use permit procedure, however there are other proceedings which could be undertaken. He suggested that the Commission discuss the general character and suitability of this proposed residential development in relation to the Balboa community in general an the business district in particular and deter- mine what additional proceedings may best appl . These could then be advertised for subsequent hearing. Mr. Rolly Pulaski,.architect for the project, was present and addressed the Commission. He said that the summary of the Newport Tomorrow Progress Report stated the City should encourage and actively support.the revitalization of • lagging commercial districts. Mr. Pulaski stated further that it is difficult to imagine any type of commercial development that would be economically feasible at this location. Mr. Louis Briggs and Mr. Robert Powers spoke in favor of the proposed project and Mr. Mark Baylor and Mr..John Mathison spoke in opposi- tion, Mrs. Elaine Linhoff; who.had served on the residential committee of Newport Tomorrow summarized the feelings of that committee re -. garding "high rise ". Various members-of the Commission expressed concern relative to the height, the density and the proposed parking provided. However, due to the problems connected with this;p.arcel it_was felt the site could be developed with a building lower in density, height, and con- forming parking. 3 After further discussion Chairman Jakosky asked Mr. Pulaski if he would consider having this item removed from the calendar in order • to afford the applicants an opportunity to reconsider the development of this property and submit revised plans in accordance with the feelings expressed by the Commission at tonight's meetimg., Mr. Pulaski was ag.reeeb .1-e.:. Abstain x Planning Director Wilson stated that the usual practice of the Commission is to schedule con - tinued items first on the agenda and that Amendment_ No...268,.which has been discussed on two previous occasions was scheduled as Item No. 7 because Dr. William L. Cunningham; District Superintendent of the Newport Mesa Unified School District had indicated he would attend the meeting but would be late due to a speaking engagement. CITY OF NEWPORT BEACH • Sentember 3. 197n COMMISSIONERS -� 1 � o >^�, \\ Planning Director Wilson presented the applica tion to the Commission and Assistant Planning Director Hewicker pointed out the various area on the map. The Commission at its previous meeting had asked that a letter be written to the City Council inquiring as•to whether the Commission should proceed with the prezoning request or wait until the question of school district boundary lines is resolved. The-- - Council at its study session on August 24, 197 considered this matter and expressed its views that consideration of the prezoning should pro teed; meanwhile, the question of school distri t boundary line adjustments should also be pur -. sued concurrently and one should not wait on the other. The need for a fire station within or immediat ly adjacent to the Planned Community and park and open space linkages were also discussed with the Commission. • Dr. William L. Cunningham, Superintendent of the Newport Mesa Unified School District addressed the Commission and stated that he was speaking only for himself and not the superintendents of the other two districts, nor for his Board. He stated that there is logic and desirability in coterminus boundarie and that the existing boundaries as shown on the map would literally bisect bedrooms and that at least minor adjustments could be worked out amicably.. Perhaps, more important and a major concern, and he is speaking for the other superintendents in this regard, would be to ascertain the ultimate boundary between the City of Newport Beach and the City of Irvine. It was emphasized that it would be very difficult to discuss school boundaries without knowing.the ultimate boundary between the two cities. It was also noted that they would be interested in a map or table either from the City or the Irvine Company regarding the planned development of the area. His Board, in an informal discussion, has said they would be willing to sit down and talk wj t the other Boards regarding readjustment of boundaries but they would like to do this in • terms of long range or permanent planning rather than piecemeal and short range planning. The Commission discussed this matter at great length, again expressing concern about the school.district boundaries and expressing a desire to review the matter again at the time of annexation. However, it was pointed out that the Commission is a recommending body and that the question of annexation referral would be at the discretion of the City Council. After further discussion, Commissioner Glass Motion x moved that the Commission recommend to the Second x City Council that prezoning of the unincorpor - Ayes x x x x ated territory contained in Zone Change Amend -. Noes - x x ment No. 268 be approved and transmitted to the City Council with a recommendation that no further action on this subjects either in the form of establishing prezoning for the parcel • or annexation of the parcel be considered until such time as the school district boundaries are realigned so as to be concurrent with the boundaries of the parcel. Commissioner Adkinson further requested that a footnote be added indicating that he did not feel it proper to prezone land outside of the City for residential use when it is in another school district. Item 4. USE PERMIT Request for extension of use permit allowing 3 off -site directional signs. APPROVED Location: Block 94, Irvine's Subdivision located at the southwest corner of Jamboree Road and East Coast Highwa e ; Lot 32, Tract 4705 located at the northwest corner of Eastbluff Drive and Jamboree Road; and Block 50, Irvine's Sub'div'ision located north of Palisades Road at the extension of Jamboree Road. Zone: "u", "U" R -1 -13, and Applicant: George M. Holstein & Sons, Costa Mesa Owner: The Irvine Company, Newport Beach Page 6. However, they would like to replace the two signs at Jamboree Road and East Coast Highway and north of Palisades Road at the extension of Jamboree Road. Mr. Perryman stated further that before erecting these two signs, approval would have to be obtained from the Irvine Company. RESUBDIVI Request to resubdivide 2 2/3 lots into 2 Sf6� parcels to create two separate dwelling sites. NO. 286 Location: Portion of Lot 11 and all of Lots A OVED 13 and 15, Block 136, Corona del Mar, located at 213 and 215 Jasmine Avenue on the west side of Jasmine Avenue between Ocean Boulevard and Seaview Avenue. Zone: R -1 Applicant: Neil D. Nelson, Laguna Beach Owner: Anthony B. Joseph, Burbank Planning Director Wilson. stated that the landscape architectural plan had been received for relandscaping and refencing along the common property line between the two proposed resubdivision parcels. The proposed lot line shown on this plan differs from the proposed line shown on engineering drawings received earlier and appears to avoid some of the dif- ficulties involved in a small right -angle property line jog. Lyell L. Buttermore Owner: John M. Murray Planning Director Wilson presented the applica tion to the Commission. Mr. Lyell L. Buttermo e was present at the meeting and answered ques- tions of the Commission. Lusk & Son, Newport Beach Owner: The Irvine Company, Newport Beach Planning Director Wilson stated that a letter had been received from Mr.,William D. Lusk, wh also was present at the meeting, requesting deletion of Cohdition No. 23 from the conditio s of approval of Tentative Map of Tract 7247. Condition No. 23 states: "That a pedestrian access way commencing from Street A at the northeasterly corner of Lot 1, thence around the corner of • Lot 1 and connecting to the present util- ity easement between Lots 19 and 20 of the adjacent Tract No. 6152 be installed ". The Commission discussed the effect that such an easement would have upon the two houses fronting on Catamaran Drive and determined that it would be not in keeping with sound planning practices to require the pedestrian access way at this late date since the houses in question in Tract 6152 already have been sold. Therefore, after discussion, it was Motion x recommended that the City Council delete Second x Condition No. 23 from the Tentative Map of Ayes x x x x Tract No. 7247. Noes x Abstain x ADDITIONAL BUSINESS Discussion on possible Lower Newport Bay Civic 1. District. At its meeting on August 24, 1970 the City Council voted to request the City Staff and Planning Commission to explore the desirabilit , legality and feasibility of creating a "Lower Newport Bay Civic District" to deal with prob- lems of and development planning on properties abutting Lower Newport Bay. The Council re- ceived a brief memorandum outlining purpose, suggested area, standards and recommendations concerning this proposed civic district. A Page 9. The question was asked how soon the Council expect an answer. Establishment of anything such as a Lower Newport Bay Civic District would be a major subject and should be given adequate consideration. Discussion followed concerning various methods of achieving desirable development along water front properties, including modifications of the zoning ordinance and areas which might be subject to regulations of density, coverage and building height. The Commission concluded that it would be a mistake to propose special regulations for iso lated areas but that the Commission could refuse to approve any increases in building height beyond those presently allowed pending a broad study of future development of all waterfront properties, including Upper Newport Bay and th Pacific Ocean as well as Lower Newport Bay. It is the intention of the Planning Commission that the complete study be accomplished within a year. Chairman Jakosky mentioned that he would be obliged to abstain from any participation in this.study because he has a' financial interest in waterfront property. * * * * * * * * * * * * * * * * * * * * * * * * * * * ** Chairman Jakosky stated that he would be absen on September 17 and October 1, 1970 and Commis- sioners Glass and Martin indicated they would be absent on September 17, 1970.
