She brought the Commission up -to -date on the history of the property, reviewed the work completed up to the present time, thanked the staff for all of their patience, guidance and understanding in the preparation of this project, and answered questions by the Planning Commission. Assistant Community Development Director Hewicker read letter received from Charles Shannon, 110 26th Street, in favor of the request. John Naderi, Valet Parking Service, appeared before the Commission to answer questions relative to valet parking and explained the traffic pattern which would be created by the use of parking attendants. Jim Heaton, Architect, appeared before the Commis- sion to answer questions and commented on the number of parking stalls required by the number . of seats proposed and advised of the type and location of the landscaping. Al Penhal, resident of Peninsula Point, appeared before the Planning Commission in favor of valet parking and the entire project. There being no others desiring to appear and be heard, the public hearing was closed. Motion X Motion was made to continue the matter until the Planning Commission was informed by the Staff as to what is adequate parking for successful restaurants. That parking attendants be provided during all hours of operation of the restaurant. That all of the conditions of the Harbor Permit, as well as additional recommendations of the U. S. Army Corps of Engineers and the California Regional Water Quality Control Board, be fulfilled. 3. That the restaurant be. designed in such a way as to limit the occupancy load to 129 persons. 4. That ail public improvements, including side- walks and curb cuts, be provided in a manner_ satisfactory to the Public Works Director. 5. That a landscape plan be approved by the Director of Community Development. 6. That all signs be approved by the Director of Community Development. 7. That the project substantially comply with the plans as submitted. 8. That the applicant shall be responsible for all necessary precautions to protect the waters of the bay during demolition of existing structures and construction of all new structures. 9. That all storage or trash shall be shielded from view within a building or within an area enclosed by a wall not less than six feet in height. Item A -2 MENDMENT Proposal to amend the Planned Community Develop - ment Standards for "Harbor View Hills" by reducing 0. 361 the permitted density in Areas 8 and 13; a general updating of the statistics as they pertain to the ONT. TO developed residential areas; amendments to the CT. 4 sign standards in Areas 8 and 13; and revisions to the standards as they pertain to the height and location of fences in Areas 9, 10, 11 and 12. Bill Hagen, 307 Carnation, applicant, appeared before the Planning Commission in connection with this request and deferred details of the project to his architect. Stewart Woodard, 3709 Ocean Boulevard, Corona del Mar, Architect for the project, appeared before the Planning Commission and presented the project. He commented on the surrounding property and land use; density of the project; estimated sale price of each unit; the fact that no variances of any kind were being requested; that if the project had been for apartments, it would have been unnecessary to appear before the Planning Commission; the present zoning is R -3 which would allow 36 units under the existing ordinance; if the property were zoned R -2, at least 26 units could be constructed whereas their request is for 18 units; and the property owner intends to live in one of the units. He presented a model of the project for review by the Commission • and discussed the details of the project, including height,.setbacks, private elevators, "step- down" construction, landscaping, parking, additional open space being created by separation of building and providing a view vista through the project, type of construction, and visual impact of the project. He answered questions of the Commission relative to dwelling units per acre, grading of the land, and soil stability. Planning Commission and staff discussed soil stability of the property, the Environmental Impac Report as it pertained to traffic on Bayside Drive, air standards for Newport Beach, incremental increase in traffic, and reduction in density. Community Development Director Hogan read a portion of the Subdivision Map Act outlining the powers of the Planning Commission as they pertain to tract map approvals and advised that if the tentative ma met all local ordinances, the request must be approved. Planning Commission discussed the ordinances governing tentative tract maps as well as the possibility of continuing this matter beyond the 30 -day time limit. • Bob Waunch, resident at the corner of Carnation an Seaview, appeared before the Planning Commission and presented a petition in opposition to the Page 7. Dave McGraw, 312 Carnation, appeared before.the Planning Commission and presented another petition in opposition to the project together with pictures for review by the Planning Commission. Mrs. Elsie Smith, 301 Carnation, appeared before the Planning Commission in opposition to the request because of the close proximity, setbacks and.noise. She also presented three letters in opposition to the request: Randy Wright appeared before the Planning Commiss.io and questioned the number of apartments which could be built as opposed to the number of condominiums being proposed. Steward Woodard appeared before the Planning Commission and responded to comments by the opposition. M *on X Following discussion, motion was made to approve Tentative Map Tract 8432 subject to the twelve conditions as recommended by the staff and accept the Environmental Impact Report. Planning Commission discussed the Environmental Impact Report and its deficiencies in.connection with the impact on local traffic, soil stability, and view obstruction. She requested that the matter be withdrawn. The public hearing was closed in connection with this matter.
