reviewed the application and staff report with the
Planning.Commission.
Because of the large number of correspondence re-
ceived relative to the preservation of views across
the property to the bay, the City Attorney was
requested to give a legal opinion as to Planning
Commission's responsibility and ability to rule on
such a matter. He stated that it was outside the
powers of the Planning Commission to restrict the
use of property in any way to protect the private
view of individuals.
Bob Jaffe, Traffic Engineer for the City of Newport
Beach, appeared before the Planning Commission and
summarized a small area traffic study which had
been done based on the.proposal and projected numbe
of cars per unit. It was his opinion that the
circulation pattern being planned would support
the development. Traffic problems were discussed
at length including signalization at various inter-
sections, changing the location of the main entranc
width of private streets, and enforcement of the
,
California Vehicle Code.
The conceptual grading plan adopted at the same tim
the Planned Community text was adopted was discusse
by the Planning Commission as to its correlation
with the grading plan submitted with the Tentative
Tract Map. Assistant Community Development Directo

reflected on each. He also advised the Planning
Commission that the previous concerns of the Parks,
Beaches and Recreation Commission had been satisfie

Larry Moore, Associate Planning Administrator with

Commission and gave a brief history of the project
in order to bring the Planning Commission and other
up -to -date with respect to zoning; meetings with
various homeowners associations to work out develop
ment problems; and meeting with the Parks, Beaches
and Recreation Commission in connection with recrea
tional facilities.
Ralph Martin, Partner in.Charge of Planning with
Walt Richards & Assoc., the architects and planners
for the project appeared before the Planning Commis
sion and discussed the proposed project relative
to its concept, density, topography, the off - center
recreation area, and pedestrian circulation system.
Larry Moore appeared before the Planning Commission
and summarized some of the key points which include
the concept of trying to get away from mass grading
and abide by the natural contours of the topography
a drastic reduction in density and height of struc-
tures; and keeping in contact with the homeowners
associations in an attempt to work out the various
problems concerning each group. He also stated
that all of the conditions as recommended in the
staff report were acceptable with the exception of
No. 6 which should be eliminated since the concerns
of the Parks, Beaches and Recreation Commission
have been met, and No. 4 dealing with the location
of the recreation facilities. It is intended that
the tennis courts and swimming pools within the
project be used by the residents of Jasmine Creek
and the tennis courts and recreation area at the
northwesterly corner is the City park for use by
residents of the surrounding area.
Planning Commission discussed the location of the
recreation area, the conceptual grading plan as
previously adopted, preservation of the canyons,
•
and natural topography of the project.
Dennis Garrehy, Project Manager, with the Irvine
Company, appeared before the Planning Commission

and commented on the conceptual grading plan.
Larry Moore again appeared before the Planning
Commission and answered questions of the Commission
relative to off - street parking, perimeter treatment
of the project, pedestrian access within the pro-,
ject (there will be no pedestrian access between
Crown.Drive North and the reservoir), recreation
facilities and the need for additional swimming
pools, and parking around the recreation facilities.
Planning Commission. recessed at 10:25 P.M. and
reconvened at 10:35 P.M.
Raymond W. Haas, 1421 Outrigger, Corona del Mar,
appeared before the Planning Commission and dis-
puted the traffic report. He also presented an
overlay of a map which indicated that an entrance
onto San Joaquin Hills Road would be better than
the one proposed and a schematic map with overlays
indicating the blockage of views from various
streets in Harbor View Hills. Mr. Haas presented
a petition which he read for the record and which
•
was signed by 445 persons requesting.consideration
of their comments relative to traffic and encroach-
ment of homeowner's views.
Max Vickers residing in Spyglass Hills Unit No. 1,
appeared before the Planning Commission on behalf
of Harbor View Ridge Homeowners Association and
commented on the lack of recreation facilities in
the area.
Tom Peckenpaugh, 1321 Outrigger, Corona del Mar,
appeared before the Planning Commission and
commented on the City's obligation to its citizens
relative to protection of views, Truth in Real
Estate legislation, advertising a continuing view
of the harbor to,potential homeowners, and re-
design of the project to protect surrounding
residents.
Yvonne Howsell, resident of Harbor View Hills,
appeared before the Planning Commission and commen
ed
on the problem of lack of schools in the area and
the fact that children have to be bused to other
schools outside the area.

Mrs. Smith, residing on Outrigger Drive, appeared
before the Planning Commission in protest of The
Irvine Company taking away her view for which she
had to pay an extra $10,000.

recreation facilities be provided and so indi-
cated on the Tentative Map.
2. That all residential lots on the Tentative Map
have a minimum lot area of 2,400 sq. ft.
3. That a minimum of 190 guest parking stalls be
provided in parking bays of two or more stalls
per bay or on street. Said guest stalls shall
be dispersed throughout the site to the satis-
faction of the Director of.Community Developmen

4. That all cul -de -sacs having a radius of 40 feet
or less shall be maintained free and clear of
obstructions.
5. That a plan for the preservation. of the existin
trees surrounding the existing reservoir site
shall be submitted to and approved by the Director
of Community Development.
6. That street trees be planted within the develop-
ment in accordance with the specifications of
the Parks, Beaches and Recreation Department.
7. That detailed landscaping plans, including any
perimeter walls and fences, and a watering
system and schedule for installation, shall be
prepared by a landscape architect and shall be
subject to approval by the Director of Communit
Development and the Director of Parks, Beaches
and Recreation. Said landscaping may consist
of lawn, trees, shrubbery and other plant
materials. The landscaping and watering system
shall be installed in accordance with the appro
ed
plan and shall be properly maintained. In the
event installation of landscaping is not completed
on schedule, the City of Newport Beach may
require a reasonable guarantee for completion o
said landscaping.
8. That all public improvements be constructed as
required by ordinance and the Public Works
Department.
9. That Section 19.16.030 of the Subdivision
Ordinance regarding map scale be waived pro-
vided maps drawn accurately to a scale of

10. That the boundary of the final tract map be
checked by the County Surveyor before being
submitted to the City for approval.
11. That all grading be in accordance with gradin
plans and reports approved by the Public Works
Director and a qualified Soils Engineer. Upon

completion of the grading, the Civil Engineer
and the Soils Engineer shall certify that the
grading has been completed according to the
plans and the requirements of the grading ordin-
ance. Reproducible copies of the "as- built"
grading plans on standard size sheets shall.be
furnished to the Public Works Department.
In response to a specific question at public
hearings for the Planned Community District
.governing this property, representations were
made to the effect that the g- rading along
Marguerite Avenue would be governed by the
•
contours shown in the conceptual grading plan.
To comply with the spirit of this portion of
the plan, no building sites between the bottom
of the easterly canyon and Marguerite Avenue
shall be higher than 260 feet above sea level.
Should there be substantial changes in street
configuration and lot layout as a result of
this condition, such changes will be presented
to the Planning Commission for review at a
public meeting.
Special attention shall be given to design,
construction and maintenance of erosion control
measures during the grading operations. It
shall be the responsibility of the developer to
have a program for the control of siltation
reviewed and approved by the California Regional
Water Quality Control Board.
12. That the following special conditions of approv

Community Development Director Hogan read Resolu-
tion No. 7771 adopted by the City Council which
directed the Planning Commission to reconsider the
Planned Development Text for Versailles-on-the-
Bluffs. He also.read the portion of the text
dealing with density.as it presently exists and
the conclusions and recommendations of the staff
as stated in their report of September 6, 1972.
Tom Peckenpaugh appeared before the Planning
Commission representing Donald J. Scholz Co.,
Donald Scholz, and William Cagney. He requested
that the City present its evidence as to why the
ordinance should be changed after which he request-
ed the opportunity to respond. When questioned,
he stated he was aware of the staff report dated
September 6, 1972 in connection with Item No. 5
and the contents thereof.
Planning Commissioners commented on various aspect
of the information.contained in the staff report
and discussed the number of dwelling units to be
considered for Phase II.
Tom Peckenpaugh again appeared before the Planning
Commission and voiced objections on the following
issues:
1. That the General Plan Policies Report should
only pertain to new projects; not to projects
partially constructed.
2. That the absence of the freeway will improve
the traffic situation around the project
rather than cause more congestion.

3. That the change in City Policy regarding
duplexes and substandard lots have no bearing
on the Versailles project but only reflects a'
change in .City philosophy.
4. That the density in relationship to number of
units is not the important thing; what is more
important is the number of people the units
will produce.
5. That the comparative areas were selectively
incomplete and did not present a true picture.
Mr. Peckenpaugh presented background information
on the project, commented on the staff report,
stated that the City had no right to make radical.
changes in the basic structure of the ordinance,
questioned the need for a use permit, pointed out
that millions had been spent in preparation for
the entire project including utilities and constru
-
tio.n of a clubhouse, commented on prior commitment
made by the City and the City's moral and ethical
•
obligation to honor same, commented on the economi
s
of the property owners, and answered questions of
the Planning Commissioners concerning previous
statements made.
As to the effect of the deletion of the Coastal
Freeway, City Engineer Nolan stated that the
street system in the area was designed to be
compatible with the freeway construction and the
deletion will have a significant effect on the
overall traffic circulation pattern and.ce,rtainly
will not result in an improvement to traffic
circulation in the area. He also commented on
the cul- de- sating of Superior Avenue.
Community Development Director Hogan assured the
Planning.Commission of their rights and obligation
to reconsider zoning amendments of this type in
that each Phase could be considered as a new
project similar to any other development of pro-
perty in the City which is closely related to an
adjoining piece of property. Also, since the City
began to pursue a general plan, a great deal of
additional information had been gained about the
City which was reflected in reports and adoption
•
of the General Policies Report. The City is
following up on the plan by the implementation of
policies which affect densities of other develop-
ments in the City as well as Versailles.

the City had recently adopted the General Policies
Plan, it was recommended that the maximum number
of dwelling units per acre be limited to 13.2.for
the Phase II portion covering 20.8 acres.

Based on the findings that, changes have taken
place since the initial draft and approval of the
use permit, changes to the original and local
transportation system have had an effect on the
site, and data gathered in the process involved
in the undertaking of the general plan program
since the date of the original Planned Community
ordinance indicates that a revision to the density
for Phase II is in order, it was recommended to
the City Council.that an amendment to the Planned
Community District Regulations for the Versailles -
on- the - Bluffs Planned Community be adopted limitin
the density in Phase II to 18 dwelling units per
acre.
Substitute motion was made, based on the same
findings, that the density be changed to 20 dwelli
units per acre.
