HomeMy WebLinkAbout09/16/194858 The Newp rt Beach City Planning Commission.held a regular meeting, Thurss day, September 16, 1948, with Uhairman Longmoor presiding, ROLL CALL Commissioners present: Baltz, Copelin, Daniell, Lonrmoog, Johnson, Pleg- er, Rudd And ,4ightman. Commissioners absent: Ellerbroek. MINUTES Commissi ^ner Rudd made the motion, seconded by Commissioner Johnsonp for the approval of the minutes of the meeting of August 19, 1948, as read. Motion carried and so ordered. PUBLIC HEARINGS Hearing upon the application of Mr. R. J. iffeston for setback variance on Bay Avenue and also on the alley for the westerly 30 feet of Lots 1 and 2, Block 51 East Newport Tract, tabled from last meeting, was `. again tabled on motion made by Commissioner Johnson, and seconded by Commission6r Rudd, pending ruling by the City Attorney. Motion carried and the secretary was requested to notify Mr. Weston prior to the next meeting relative to such ruling. Hearing upon the application of the Southern Counties Gas Company for a conditional permit for the construction of a Distribution Station on Lots 1 and 3. Block 335, Corone del liar, (corner of Iris and Bay - side Drive), was declared, same having been duly filed and advertised. Commissioner Copelin gave the committee report, stating that he and Chairman Longmoor and Commissioner Baltz had checked the property, the plans and sketches, which the Commission checked as a whole, with Mr. F. Craig, representative of the Gas Company, explaining same. However, numerous property owners were present, in protest, and two letter of protest were also received, one from ir.,Hal Will Smith,.and one from Mr. and Mrs. Clarence A. Marcey. Among those present, who protested, verbally, were Conrad Shook, Mr. Wilson, Mrs. M. C. Mullins, Mr.. Dela- torie, all strenuously objecting to such an installation, or to any change in the character of the neighborhood, i.e., change from the present residential status of the properties. The adjoining property owners of Lots 5 and 7. Mr. and Mrs. Carl Webster, sent a letter, in favor of the installation. Ivor. Craig, for the Gas Company, explained that the present off -'a &ke station on Coast Highway between Larkspur and Jasmine Avenues, is adequate, but same does not harmonize with their other facilities and structures and surroundings, and the property being only 10 feet does not permit such improvements, so they propose to purchase the property at Iris and. Bayside Drive. After much discus- sion, Commissioner Pleger made the motion, seconded by Commissioner Rudd to close the hearing, which carried, and Commissioner.Copelin sug- gested the matter be tabled, for further study, to the next meeting, but, Commissioner.Baltz made the motion, seconded by Commissioner Rudd, that the Commission recommend that this application be denied, which carried by the following roll call vote, AYES: Baltz, Gopelin, Daniell Longmoor, Johnson, Pleger, Rudd and Wightman. NOES: None. ABSENT: Ellerbroek. Hearing upon the petition of property owners, F. R. Putzier, Ray Neil- son, Weaver Smith, Richard Feetherstone, E. E. Grigfiths, Lydai "argar- et Brown, of Lots 399 40, 41, 46, 47, 48, Tract 682, Corona del Mar, for a 50% front yard setback variance for said l6ts, was declared, same having been duly filed and advertised. No protests were received or heard. Mr. Neilson was present for the group explaining.that the application was made to make these lots conform with those on the other side of the street. Commissioner Baltz reported that he and Commis- sioner Pleger had checked the property and were in favor of granting the petition. Commissioner Copelin made the motion, seconded by Com- missioner Daaniell to close the hearing, which carried, and Commission- er Rudd made the motion, seconded by Commissioner Johnson that the 1 Commission recommend the approval of this petition, which carried by the._ 5 g following vote, AYES: Baltz, Daneill, Copelin, Longmoor, Johnson, Pleger, Rudd and Wightman. NOES: None. ABSENT: Ellerbroek. First hearing upon the proposed amendment to Ordinance No. 525, relative ' to "off- street parking", was declared, same having been duly filed and advertised. Commissioner Johnson, chairman of the committee for stury on this, read the proposed amendment, i.e., "Section 1: Sub - section 6 under Section 6 of Ordinance No. 525 is hereby amended to read as follows: "6. The,following uses, subject to the issuance of conditional . permits therefor as provided in Section II: (a) Apartment hotels; (b) Storage garages; (c) Offices of dentists, physicians and others engaged profes- sionally in any legalized form of healing ",.:Section 2. Subsection '4 un- der Section II of Ordinance No. 525 is hereby amended by adding a new subsection thereto, to be known as sub - section (i), and shall read as follows: "(i) Offices of dentists, physicians and others engaged profes- sionally in any legalized form of healing, upon the condition that they are located in an R -3 zone except that part of the City of Newport Beach as shwon by Section 12 of the Districting Map of the City and lying east of "G" Street, as shwon in said Section; and upon condition that the location and building plans be approved by the Planning Commissions and under such conditions which will preserve the integrity and character of the district,.the utility and value of adjacent property, and the general welfare of the neighborhood, and under such conditions and restrictions including off : street parking as the Planning Commission may in their judgment stipulate ". Commissioner Johnson stated that "this is an oppor- tunity to make it possible for medical offices in residential R -3 zones ", which Chairman Longmoor further explained that "this does not open the area, but each application will be considered on its own merits ". After discussion, Commission--r Pleger made the motion, seconded by Commissioner Baltz that the matter be 'set to second hearing at the next meeting. Mo- tion carried,and so ordered. The matter of the application for a license for an Auto -Paint Shop at OLD BUSINESS 1106 Coast Highway, Corona del Mar, by William I:. Irwin, referred by the City Council, and tabled from last meeting, was brought up, but Mr. Ir- win was not present, nor had it been possible tb: contact lim for further information, relative to this, so Commissioner Pleger made the motion, seconded by Commission Johnson that the Commission recommend the denial of this application, which carried and so ordered. A letter from Winifred W. Kingsley, clerk, for'the First Cbdreh of COMMUNICATIONS Christ Seientist, Newport beach, requesting permilsion to erect a sign at the northeast corner of Lido and Central Avenue, was read and order - ed referred to the Building Department for action. Chairman Longmoor read a communication of invitation to the Shoreline Planning Association at Ventura, Califdrnia, on September 24th and 25th which he stated Could be attended by the County Planning Commission re- presentative, and which the City Planning Commissioners might attend if they desired. Sub - division map of the tract in Corona Del Mar, across from Shore Cliffs recently purchased by the brutcher Foundation, was considered and dis- cussed informally, with Mr. Richard Barcelo, representing the Crutcher Foundation.
