Rudd and seconded by Cam. Copelin, MINUTES: and - carried, the minutes of the last regular meeting of August 201, 1953 were approved as submitted to the Commission. AMENDMENTS: Chairman Longssoor opened the second hearing on appli- cation of the Irvine Co. to rezone Tracts #1700 and #1 1701, further described as Irvine Terrace, from a PUR Irvine Terrace to an R-l. District. Said property located easterly GRANTED of Marine Ave. between Bayside Drive and the Coast Hwy. As no one appeared at the .hearing in protest nor were any written protests received, Coo. Copelin moved that the hearing be closed, seconded by Cam. Lind and carried. Cem. Copelin made a motion that the application of the Irvine Co. be granted, seconded by Cam. Reed, and carried by the following roll call vote, to -wits lld. AYES Chairman Longsoor declared the second wring open on the application of Barbara Elizabeth Gartler to rezone the lower portion of Lot D. Tract 919 from an R-1 to an #2 R-3 District. Said property located at the northwest Gartler, Barbard E. corner of .Avon St. and Riverside Ave. GRANTED Muriel Pinover representing the owner,.ststed.that Mrs. Gartler planned to divide this list into -3, Rr3 sec- tions, which sections are defined by map and written description. Each parcel is in excess of 71,000 sq. ft. As there were no written or verbal protests, Coma. Copelin moved that the hearing be closed, seconded by Com. Reed and carried. It was moved by Cam. Rudd, seconded by Cm. Copelin that the application be granted, and carried by the follow. ing ron call vote, to -4dts ALL AYES VARIANCES: Being an application of H. E. Wellman to move.an existing house forward on Lot 1, Blo* H. Seashore Colony Tract, and #111 alter the side and rear yard setbacks subject to an exchange Wellman, H. E. of property between said applicant and the City of Newport - GRANTED Beach to provide an alley between Lot 1 and Lot 9 in Block H of said Seashore Colony Tract. Cam. Copelin stated that after investigation, movement of this building forward to allow an alley, regardless of serbacks, would be a great improvement to the block. Motion to close hearing was made by Como Copelin, seconded by Caron. Reed, and carried. Com. Copelin moved that application be granted, seconded by Com. Budd, and carried by the following roll call vote, to -Vitt ALL AYES Hearing for the application of M. E. Kirkwood to construct 21 units with swimming pool on Lot 1, Tract 1237 located at the northwest corner of State Hwy and Seaward Road. Property is now zoned 163-B. Mrs, Marie Zralik came forward to inspect the plans as presented by Mr. Kirkwood, and discussed her objections as owner of Lots 62 and 63, Tract 1237, which property is adjacent to the north of Mr. Kirkwood's. Her objections were possible trash accumulation at the rear of the build- ing and mass parking of oar. Mr. Kirkwood agreed to the following proposals by the Commission for the protection of property owners whose view might be obstructed, said pro- posals being as follows: 1. A11 units shall have a covered garage space or carport. 2. That a fence shall be built along the northerly side of the motel site, separating Mr. Kirkwood's property from the adjacent lots to the north. 3. That all planting will be limited to a height of 16 feet, except that which might lie within the normal allewed- setbacks and which is now covered by the code. 4. Apartments on the side of the property adjacent to Lots 61 and 62 shall bn9 be one story in height. 5. Entrances to the premises shall be off of Seaward Road. 6. Layout and location of the units shall be as per plane attached and made a part of this permit. A written protest from Mr. & Mrs. Edward D. Jones of 405 Serra Drive, ®orona Highlands, was received and read at the hearing. It was moved by Com. Reed and seconded by Con. Hayton that the hearing be closed. 25 USE PERMITS #95 M.E. Kirkwood GRANTED (Incorporating conditions.) Com. bind moved that Mr. Kirkwood's application be granted incorporating the above conditions, seconded by Cam. Rudd and carried by the following roll call voge, to -wits ALL AYES Hearing opened on application of Paul A. Golden to operate a #96 car washing and polishing business and erection-of .a steel Golden, Paul A. and glass structure to house said business, on portion of GRANTED Lot A, Tract 419, further described as 1100 Coast Highway# Newport Beach. Bob Gallia, and We Leahy manager for pro- posed business, were present to represent the applicant. Mr. Leahy stated that the infra -red drying process would be used to dry the cars, thus eliminating the usual noisy blowers. 20 Come Lind moved that the application be approved, seconded by Come Rudd, and carried by the following roll call vote, to -wit ALL AYES RESOLUTIONS: #580 Being a resolution of intsntien.:.to smend.Sedtion 9105.4 Amend Sec-9105.4 Chapter 5 of Ordinance #635 so that paragraph (g) be Ch. 5, Ord. 635 added. Said amendment provides for "R" District yard provisions in "C" or "M" Districts where they may apply. Moved by Come RwM,, and seconded by Gam. Gopelin that this Resolution of Intention be adopted, and carried by the following roll call vote, to -witr ALL AYES INFORMAL REQUESTS: L. M. Holbrook suggested consideration of an amendment to Section 9105.6 to apply on all zoning districts to elimi= hate possible screwball structures which meet the eode, but do not look well. No action taken. 1 R t u... Arch. Comm. Chairman Longmoor appointed an Architectural Comaittee, consisting of J. Be Webb, City Engineer; A. M. Nelson, City Building Inspector,. and Goo. J. Lind, Architect 1952 -53 Annual Report The annual report for 1952 -1953 of the Planning Commission was brought before the Commission for approval. Motion made by Como Copelin, seconded by Coax. Lind, and carried that annual report be approved. Como Reed moved that report be presented to City Council at its neat meeting. Motion seconded by Come Lind and carried. A letter referred to the Newport Beach Planning Commission from the Orange County Planning Commission, with application of E. F. Birth, 803 Bayside Drive, Newport Beach, to permit the erection of a shop building on the premises.of an exist- ing yacht anchorage in the A-1, General Agricultural District. Said Shop building to be 20 feet by 22 feet and be located approximately 16 ft. northwest of west wing of existing dwelling. The building to be used for the repairing of yachts on the ways which are 15 ft. west of proposed shop. L* Me Holbrook ordered to answer letter stating that the N. Be Planning Commission had no objections, as the pro- posed structure and location meets requirements.
