THE NEWPORT BEACH CITY PLANNING COMMISSION met
In regular session Wednesday, Sept. 18, 1940,
7 :30 p.m. in the Council Chambers, City Hall;
Chairman Johnson presiding.
Meeting called to order by the Chairman.
ROLL CALL
Commissioners present: Johnson, Seager, Estus,
Patterson, Williams.
Commissioners absent: Allen, Findlay, Hopkins,
Nelson.
MINUTES
Com. Patterson moved that the minutes of the
meeting held August 21, 1940 be approved as written.
Seconded by Com. Williams. Motion carried.
Chairman called attention to an error in the
roll call in the minutes of the special meeting
held August 30, Com. Estus was not present at that
meeting.
Com. Patterson moved that the minutes of the
special meeting of August 30, 1940 be approved as
written with this correction. Seconded by Com.Estus.
Motion carried.
HEARINGS
Variance Application of Ray V. Marshall -
Chairman called for hearing the matter of the
application of Ray V. Marshall for a 66 -2/3% side
yard setback variance on Lot 16, Blk 18, See 3,
Balboa Island.
Secretary read Mr. Marshall's application and
stated that the hearing had been advertised, plans
posted, notices sent to surrounding property owners
and all other requirements of the ordinance complied
with.
No written protests were received.
No one was present to protest the granting
of this variance.
Com. Seager explained that the variance in-
volves an overhang on the street side of the
building.
Mr. Marshall was present and explained the
plans to the commission stating that he has requested
the variance to take care of the overhang on the
second floor.
It was the opinion of the commission, after
consulting the ordinance, that not more than a
50% variance could be granted.
Com. Estus moved the adoption of Resolution
No. 177 recommending that a 50% side yard setback
variance on the West side of the lot be granted
to Ray V. Marshall on Lot 16, Blk 18, See 3,
Balboa Island and that the same be transmitted
to the City Council as the recommendation of this
commission and a copy filed as part of the minutes
of this meeting.
Seconded by Com. Patterson.
Roll Call:
Ayes: Johnson, Seager, Estus, Patterson,
Williams.
Noes: None.
Motion carried and.so ordered by the Chairman.
MAP OF S. P. COMPANY'S PROPERTY
Chairman o nson presented a map of the
S. P. Company's property on Central Ave. adjoining_
the D. K. Blue Service Station and stated that he
had been requested to get an opinion from the com-
mission as to the rezoning of this property to C-1.
The matter was discussed but no action could
be taken, since no formal request was before the
commission. It was the opinion of the commission,
however, that a C -1 zone on this property would be
more in keeping with surrounding zoning than the
present R -2 zoning.
DISTRICT MAPS -
Com. Patterson stated that he had completed
the tentative drafts of the district maps to con -
form with suggestions of the various district
committees.
These maps were explained by Com. Patterson
and discussed by the commission.
Com. Estus moved that City Engineer Patterson
proceed to prepare for public hearings the tentative
district maps to include the recommendations of
the various district map committees.
Seconded by Com. Williams.
Motion carried and so ordered by the Chairman.
ADJOURNMENT -
Com. Estus moved that the commission adjourn
to Wednesday, Sept. 25th and that any commissioner
Interested get a copy of the tentative draft of the
revised ordinance 440 for study so that they will
be prepared to discuss same at that time and pro-
ceed to set the matter for public hearing.
Seconded by Com. Williams.
