IN THE COUNCIL CHAMBERS OF THE NEWPORT BEACH CITY HALL ' ROLL CALL: oml-oners Present: Copelin, Ellerbroek, Longmoor, Reed, and Rudd. Commissioners Absent: Briggs, Pleger, Smith,.and Wightman. MINUTES: Upon motion of Commissioner Reed, seconded by Commis - s o— ne'r Rudd, and carried, the minutes of the East regular maet- ing of August 21st were approved as submitted to the Commission. USE PERMITS: Application of Charles F. Schultz'for tool and die tt ma ne snop at 422 31st Street, Newport Beach. This had been held over from the last meeting for report and investigation. Commissioner Copelin reported that he had investigated it, looked it over and talked with Mr. Schultz andmade a motion for the granting of the application. Motion was seconded by Commissioner Reed and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Copelin, Ellerbroek, Longmoor, Reed, & Rudd NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Briggs, Pleger, Smith, and Wightman Application of George L. Perlin to operate an automobile repair service and shop at 50 -- 0 West Balboa Boulevard, Balboa. Ap li- cant was present to answer questions. Commissioner Briggs recommendation was read stating that it might be best to set for hearing. Commissioner Copelin moved that in view of the fact that the Chairman of the committee sending in report, with above recom- mendation, that the application be set over. After further discussion, motion was withdrawn. Commissioner Rudd then made a motion that the application be granted, and that official notification be sent to the adjoin- ing property occupants and that the Use Permit contain the stipulations contained in the application. Motion seconded by Commissioner Ellerbroek and carried by the following roll call tote, to -wit: AYES, COMMISSIONERS: Copelin, Ellerbroek, Longmoor, Reed, & Rudd. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Briggs, Pleger, Smith, &,Wightman. Application of Earl R. King for commercial anchorage on The Rhine, 631 - 70 3C- � t Street Newport Beach. Anchorage in Rhine Channel on old Newport bredge property andStanley property in a 'U' zone which requires Use Permit. After further dis- cussion, Commissioner Copelin moved the application be granted, seconded by Commissioner.Ellerbroek and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Copelin, Ellerbroek, Longmoor, Reed, & Rudd. NOES, COMMISSIONERS: hone ABSENT, COMMISSIONERS: Briggs, Pleger, Smith, andWightman 228 Application of Waiter B. Mellott Inc., for motel development on Lots 1, 2, j, ract le3l tuorona highlands) Highway 101. Mr. Cos was present to talk with the Commission. R -3 -B zone. ' No definite plans for motel - wanted o.k. that site would be alright for such plans though. Commissioner Copelin made a motion that the Use Permit be is- sued'in accordance with plot plans submitted for use of this property, subject, however, to approval by Commission of de- tailed and completed plans and specifications of any proposed construction and that the Planning Consultant approve said plans also. Motion seconded by Commissioner Reed and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Copelin, Ellerbroek, Longmoor, Reed, & Rudd. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Briggs, Pleger, Smith, and Wightman. VARIANCES: pA pl3oation of Edith Schnider for a Variance on Lot 13, Block 19, Section 3, (324 Amethyst ve.) Balboa Island to permit construction of a bay window on existing house. Chairman declared the hearing open and asked if anyone wished to speak for or against. Mr. Bissell, contractor, discussed plans with the commission. Commissioner Ellerbroek,moved the hearing be closed, seconded by Commissioner Rudd and carried. Commissioner Ellerbroek then moved the application be granted, seconded by Commissioner Rudd and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Copelin, Eller)�roek, Longmoor, Reed, & Rudd. . NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Briggs, Pleger, Smith, and Wightman. Application of Alton B. Culver and other roperty owners for a ariance on Lots 1 to 7 ine., Block 335, anal Section, (3502- 3512 Marcus Ave, Newport Beach) to permit a change in front yard setback from 46' to 201. Chairman opened the hearing and asked if anyone wished to speak for or against said application. Secretary Copelin read the letter of application and attached letters of other property owners showing that five out of seven were in favor of the change, one neutral, and one against. After considerable discussion Commissioner Reed made a motion that the hearing be continued to the next regular meeting of the Commission and Commission was appointed to make a study of the setbacks along all Channel property. Motion seconded by Commissioner Copelin and carried. Secretary was instructed to noify the Building and Engineering departments to prepare maps on the area showing original setbacks and the chnges which have been made since adoption of ordinance.. ' OLD BUSINESS: Secretary Qopelin read a letter sent to the South Coast Boat Company KKKXMXXZKE03MXXX regarding their Use Permit and stipulations being violated, their reply, and two letters of protest from Russell L. Thibodo, and Paul C.Jones. ' Mr. Benzini was present representing south Coast Company and stated that it would be an impossible feat to police parking and would be too costly to expect the company to move the lumber storage to another site - -such as the dater yards. After further discussion, Commissioner Reed made a motion they continue consideration of the application until next meeting and ask the South Coast Company to work out problem of parking either by meters or by green curbing and that committee (com- mission as a whole) study the problem and make, recommendations at next meeting. Commissioner Ellerbroek seconded the motion and carried. COMMUNICATIONS: Secretary opelin read a letter from the City Council dated September 15th advising the Commission on decisions rendered from appeals of their denials on the recent application! of 0. A. Jones, Norman Smedegaard, and set the R. C. Benner appli- cation for a hearing September 22nd, 1952• ADJOURNMENT: her being no further business to come before the C ommission, Commissioner Copelin made a motion for adjournment, seconded ' by Commissioner Reed and carried.
