Community Development Dire for Carl Neuhausen, Advance Planning Administrator Shirley Morgan Chairman Glass explained the purpose of the Special Meeting and advised that the following two items would be heard concurrently because of their relationship but that separate.actions would be taken on each item. Item #1 AMEND - A proposal to reclassify from the R -2, R -3 and C-1-H Districts to the R -1.5 District, all property MENT located on Balboa Island and generally bounded by -N-(-337 the North Bay Front, the East Bay Front, the South Bay Front and Waters Way. This proposal encompass- CONT. TO es all property on Balboa.Island except as follows: OCT. 5 1. All C -1 zoned lots on Marine Avenue between a point south of Park Avenue and the alley south of the North Bay Front. 2. All C -1 zoned lots on Agate Avenue between Park Avenue and the alley north of the South Bay Front. It should be noted.that this exemption does not include the C -1 -H zoned lots at the northwest corner of Agate Avenue and Park Ave. 3. All C -1 Zoned lots on the south Bay Front between Opal Avenue and Pearl Avenue. 4. All lots on Collins Isle. Initiated by: The City of Newport Beach Page 1. TO but not to exceed 800 square feet. OCT. 5 Initiated by: The City of Newport Beach Public hearing was opened in connection with both Amendment No. 337 and Amendment No. 338, Assistant Community Development Director Hewicker introduced three additional items of correspondence received from the following persons in opposition to the Amendments: Haihnah E. Flynn Elynor L. Garriott William LaPlante The Chairman advised that certain C -1 property on Agate Avenue south of Park Avenue was scheduled for hearing on September 21, 1972 to consider an amend- ment changing the zone to R -1.5 and suggested that the lots on the northwest corner of Agate Avenue and Park Avenue, which were scheduled for hearing this date, be continued to September 21, 1972. X Motion was made to continue the discussion and X deliberation of the change of zone on property, at the northwest corner of Agate Avenue and Park Ave - nue to the meeting of September 21, 1972. George Woods, 115 Apolena Avenue, representing the Balboa Island Improvement Association, appeared before the Planning Commission and stated they felt the zoning should remain as is, 650 sq. ft. is too restrictive, 800 sq. ft. is more flexible, and the rear setbacks should remain at 5 feet. Burton Collins, 107 Ruby, appeared before the Planning Commission in opposition to both amendments. Richard Share, 126 Ruby Avenue, appeared before the Planning Commission and commented on the traffic situation on Balboa Island, the difference between the summer and winter rental units, and property on Park Avenue should be handled in a different manner than interior property. COMMISSIONERS CITY OF N EWPORT D to 0223,0 m r Z P P LL cau September 0 11 18, 1972 BEACH MINUTES INDEX Hannah Flynn, 110 Garnet, Rental Director of Park Newport, appeared before the Planning Commission and stated that only quality 2 bedroom -2 bath apartments would attract year round tenants and 800 sq. ft. is not large enough. Betty Lynch, 217 Apolena Avenue, appeared before the Planning Commission and commented on the traffic problems and enforcement of the zoning ordinance. Robert Hixson, 215 Agate appeared before the Planning Commission in favor of the proposed amendments. Bill Hardesty, 503 Park Avenue, appeared before th. Planning Commission in favor of the present zoning which is R -2 and enforcement of the present zoning ordinance other than the emergency ordinance now in effect, in order to maintain the character of the island. Bill Willis, 107 Garnet, appeared before the Planning Commission and commented on the matter of profit i connection with garage apartments. Mrs. Payton, 315 East Bayfront, appeared before th Planning Commission in favor of R -1 rather than R -1.5 zoning. Lester Barron, 113 Crystal, appeared before the Planning Commission and inquired relative to non- conforming uses. Assistant Community Development Director Hewicker reviewed the Municipal Code and non - conforming uses in residential zones were discussed. Dr. Ken Wilcox appeared before the Planning Commis sion in favor of having 800 sq. ft. or more in the second unit. Mr. Flynn appeared before the Planning Commission in favor of 800 sq. ft. or more for the second uni . Mrs. Edgewarn White, 1104 South Bayfront, appeared before the Planning Commission in favor of the R -1.5 zone change and also stated that small apart ments of 650 sq. ft. or less do attract quality tenants. Barry Wilson, Corona del Mar appeared before the Planning Commission and stated that he had built several duplexes on the island and it seemed that the bigest problem is parking. He felt that some provision should be made whereby three parking spaces would be required on more than one unit. Dick Spearman, Grand Canal, appeared before the Planning Commission and stated he was not in favor of the 650 sq. ft. or the 800 sq. ft.; he felt that 1,000 sq. ft. or 1,200 sq. ft. was more in line. Mr. Beauchamp, 203 Topaz, appeared before the Planning Commission in opposition of the amendments. Kathy Clark, 506 South Bay, appeared before the • Planning Commission and questioned the change of zone.proceedings. Vivian Valley, 508 Bayfront appeared before the Planning Commission and stated that the thing that attracts people to Balboa Island is the fact that it is,a resort area. David Malloy, 226 Grand Canal, appeared before the Planning Commission in favor of 800 sq. ft. minimu on the second unit. Kay Glavas appeared before the Planning Commission in opposition to the change of zone. Richard Martin, 805 N. Bayfront, appeared before the Planning Commission and commented on the character of the island. He is in favor of leavin the island as it is and is opposed to any change of zone. Bart Vance, 1311 N. Bayfront, appeared before the Planning Commission and stated he felt any change would be a conflict of interest because property now developed would increase in value and property undeveloped would decrease in value.. Lyda Pare, 128 Opal, appeared before the Planning Commission in favor of limiting the second unit to 800 sq. ft. Dick Fenton, 220 Ruby, appeared before the Planning Commission and stated there should be some provisio for more on -site parking and did not feel that limiting units to 800 sq. ft. was the answer to the problems on the island. The following persons appeared before the Planning Commission a second time on various points of clarification: Burton Collins Bart Vance Bill Hardesty Richard Martin Robbie Wilcox appeared before the Planning Commission in favor of keeping the island as it now exists. The Chairman closed the Public Hearing. Planning Commission discussed the matter of zoning ordinance enforcement and the problems involved; population figures on a projected number of units; control of population through limiting the number of bedrooms; the need for re- advertisement if a restriction on the number of bedrooms is to be considered for each unit; density throughout the City; and the General Policy Plan Report. Motion X Motion was made to approve Amendment No. 337 and Second X instruct the staff to prepare a new amendment, to Ayes X X X be reviewed by the Planning Commission on Thursday, Noes X X XX September 21, 1972, for the purpose of setting a public hearing, incorporating the provision that the second unit contain a maximum of 800 sq. ft. with only one bedroom. Motion died for lack of a second. ion X Motion was made to disapprove Amendment No. 337. and X s X X X Following discussion on density and character of s X X X X the City and the island, the motion failed. ion X Motibn was made that Amendment No. 337 and No. 338. be tabled until after the joint meeting with the City Council relative to city -wide density hearings and that the Planning Commission, at a later date, again consider Amendment No. 337 and Amendment No. 338 or table them indefinitely. Community Development Director Hogan advised the Planning Commission of the implications involved when a matter is tabled and re- advertised.
