HomeMy WebLinkAbout09/20/1945223 The Newport Beach City Planning Commission held a regular meeting on Thurs- days September 20, 1&45, at 7 :30 p.m., in the Council Chamber, City Hall, Newport Beach, with Chairman Allen presiding. Commissioners present: Allen, Ellerbroek, Isbell, Johnson, Longmoor, ROLL CALL Nelson, and Patterson.. Commissioners absent: Baltz, and Seeger. Secretary Ellerbroek read a letter dated August 6, 1845, addressed to MINUTES the City Council, and referred by that body to the Planning Commission, from the Lido Isle Community Association, requesting careful considera- tion of the proposed lease to Mr. T. Filkenny of the City owned property on Coast Righway, stating that the property owners on Lido Isla:, as well as the entire community would be affected by same. Commissioner Patter -. son made the motion, seconded by Commissioner Johnson that the letter be filed and the matter 'tabled for future referrence, i.e., at the same time as the said Kilkenny lease be taken up again. .Notion carried, and so or- dered. Secretary Ellerbroek read a card from Miss Margaret Van Essen, requesting information on the Public Hearing on the Corona Del Mar property owned by Mr. Vogel, and informed the Commission that Miss Van Essen had been not- ified that the petition by Mr. Vogel had been withdrawn, and the final Hearing not held. Secretary Ellerbrosk also read a letter from Mr. A. G. Burtis, of Laguna. .Beach, asking for a rezoning from R-2 to R-3 for Lots 4, 6, and 8. Block 730, Corona Del Mar, to build apartments or a Motel. Commissioner Pat- terson made the motion, seconded by Commissioner Nelson, that Mr. Burtis be advised to put his request in proper form, accompanied by the filing fee of $10.00. Motion carried, and so ordered. First hearing upon the matter of an application by Mr. R. T. Hubbell, of PUBLIC HEARING Newport Beach.. for rezoning of Lots 26, 27, and 28, Tract 444, First Addition to Newport Heights, from R-3 to C -2, for the purpose of con- tractors offices, with electrical power units, maximum of three one - horse power motors, was declared; the Secretary stating that same had been properly advertised, and filed. A number of property owners of the vicinity of the property in question were present for the Hearing, to protest the rezoning, including Mrs. Lloyd and Betty Hills and a petition with thirty -three names stating "the undersigned property own - ers %.desire to enter a vigorous protest against a change from R-3 to C-2 in the zone Blassifioation of Lots 26, 29, and 28, in Tract 4449 First Addition to Newport Heights, Newport Beach." Mr. Hubbell, also present for the Hearing, stated that he owned the rest of the lots between Santa Ana Avenue and Old County Road, and that he proposed to construct con- tractors offices and do small cabinet work, explaining that the lots in question join the Southern Counties Gas Company installation. Commiss- ioner Johnson(also a property owner in the area) stated that if a zone change were made then all restrictions Woul& be off, and even a makimum of fifteen horse power equipment. After much discussion, Commissioner ' Patterson-made the motion, seconded by Commissioner Nelson, that the Hearing be closed and passed to the second hearing. Motion carried, and so ordered. 224 RTS OF Report on the Buena Vista improvement (petition by property owners), COMITTEES referred from the last meeting, could not be given as the Chairman of the ' committee investigating same was absent. The proposed lease to Mr. Kilkenny of City owned property on Coast High- way, tabled from last meeting, was again tabled by motion of Commissioner Nelson, an1,secdnded by Commissioner Patterson, and carried. OB BUSINESS Tentative map 1118, forwarded by the Orange County Planning Commission, and previously approved by this Commission, was again considered, with Commissioner Patterson making the motion, seconded by Commissioner Nelson, that same be approved and filed. motion carried. NEW BUSINESS A petition of property owners of Newport heights reading as follows, was read by the Secretary: 'The undersigned property owners respectfully re- quest that you change the front yard-setback line on Lots 1 to 9 inclusive Block 18, First Addition to Newport Heights, from five feet to ten feet. All these lots are fifty feet or more wide and approximately 117 feet long, and Santa Ana Avenue on which this property abuts is 100 feet Wide, we feel that a front yard ten feet deep would be more desirable than the present five feet., Mr. Johnson(Commissioner) atated that ill.of the own- ers concerned had signed except ones and he only because he had not yet been contacted. Commissioner Patterson made the motion, seconded by Com- missioner Nelson that the Secretary be instructed to advertise the matter for Public Hearing for the meeting of October 18, 1945. Motion carried. The Secretary read a letter from the Griffith Company addressed to the City Council, and referred by that body to the Commission, requesting the ' abandoning of the following alleys and easements for public utilities: 1. All that`oertain alley, 201 in width, adjacent to Lots 1145 to 1156, inclusive, Tract. No. 907. 2. All that certain alley, 201 in width, adjacent to Lots 1127 to 1142, inclusive, Tract. 907. 3. All that certain alley, 201 in width, adjacent to lots 1158 to 1182, inclusive, and adjacent to the northerly 101 of Lot 1188, Tract 907. 4. All those certain easements, 41 in width, for public utilities, across Lots 1127 to 118E and the northerly 101 of Lot 1163, as shown on map of Tract 007. The petition also stated that the Griffith Company agreed to grant ease- ments to the City for existing utilities, and at new locations, where nec- essary, and agreed to pay all costs in connection with the abandonment of the alleys and the relocation of the utilities. Also in the petition was a request for the approval of a tentative map of Tract 11171, being a re- version to acreage of iota 1097 to 1120, inclusivei Lots 1127 to 1196, in- elusive, and Lots 1205 to 1214, inclusive, of Tract 907. Said petition was presented and.developed for the proposed business district at the on- trance to Lido Isle by the Griffith Company, Mr..P. A. Palmer, agent for the Griffith Company, was present, explaining the project, and showing the proposed-plans and sketches, stating that rill of the property described in the petition is owned by the Griffith Company. Commissioner Isbell made the motion, seconded by Commissioner Patterson, that the matter be tabled temporarily.until Mr. Flewelling, architect (present for the meeting) could present his preliminary sketches for the proposed City Hell, so.that same could be consid red with the Griffith Company plans. Carried. Accordingly, first sketches of the City Hall were presented by Mr. Flewell- ing, and discussed by the Commission. These sketches were mainly layouts. AU of the Commissioners examined these carefully and expressed their views, considerable discussion centering around traffic problems for the project as planned by Mr. Flewelling for the closing of Lafayette Avenue at its northerly end, and the resultant changing of traffic out 32d Street to Central Avenue. ' After discussing these sketches and plans, the matter of the Griffith Company was brought back, and again discussed. Commissioner Longmoor made the motion, seconded by Commissioner Nelson, that the alleys, as described, be abandoned, and the public easements be relocated accordingly. Chairman Allen called for a Roll Call vote. Ayes: Allen, Ellerbroek, Isball, Longmoor, Nelson, and Patterson. No °s: None. (Johnson left the meeting previous to the vote). Motion carried and so ordered, and the Chair appointed a committee consisting . of Johnson, Patterson and Allen to carefully investigate the matter. 225 .ROLL CALL v " The other request in the Griffith Company petition, that of reverting to acreage those certain lots, with the approval of tentative map of Tract 1117,'was dis- cussed, and Commissioner Patterson made the motion, seconded by Commissioner Nelson, that the Commission recommend the approval of tentative map No. 117, and a portion of 907, being a reversion to acr•:age of that property, and the author - Saation of the Chairman and the Secretary to sign said map. Roll call vote. Ayes: Allen, Ellerbrosk, Isbell, Longmoor, Nelson, and Patterson. Noes: None. Motion carried and so ordered. ROLL CALL VM - A letter addressed to the City Council, and referred by that body to the Commiss- ion, from Kenneth E. Wilson, as representative of Mr. Thomas Hamilton, was read by the Secretary. This constituted an offer to lease City owned property on Coast Highway for development as a yacht anchorage, and as headquarters for Er. Hamilton's coastwise charter service; also to moor the VEGA, 138 foot schoon- er, the MAT BII, 100 foot power yacht, and other boats — proposing to bear cost of construction, to either retain ownership of said constructioni'or be reimbursed for cost of same by lease credit --and offering forty cents lineal per foot bare ground lease, said lease for a period of twenty five years. Mr. Filson was pres- ent and explained the project, which was discussed by the Commissioners, and Commissioner Longmoor made the motion, seconded by Commissioner Nelson, that the request be held in abeyance for forwarding to the City Council after further consideration. Notion carried and so ordered. A petition of property owners of Balboa Island, addressed to the City Council, anu referred by that body to the Commission, trequesting that you suspend all permits for new construction of all private piers on public beaches and further- more that you grant no future permits for the construction of private piers on public beaches until you have made a further study of this subject, with due consideration to be given to the interests of all.��overtg owners.' Further requesting that the matter be referred to the Planning Commission, and that the Commission hold a public hearing on the matter, with notice by mail to be given to every property holder at least 10 days before such hearing. Councilman Earl Stanley was present, and stated that some action should be taken and that his personal recommendation would be that the Commission hire a planning Con- sultant to work out such problems, that the Council would allow funds for such a consultant. Property owners present for the meeting included Brig. General A. D. Smith, 911 North Bay Front, who applied for a permit to sonstruct a pier sometime previous. Chairman Allen stated that he had personally made a survey of the island and its piers, and that he was of the impression that the present plan (a pier to every three lots) properly inforced would be O.K. Commissioner Patterson stated that the present plan was adopted after recommendation.from a committee from Balboa Island, and was a compromise plan. Commissioner +bngmoor made the motion, seconded by Commissioner Ellerbroek that the Chairman appoint a committee from the Commission to meet with representatives Bf the two factions 226 on the island, i.e., Bay Front owners and inside lot owners, and report . back to the Commission. Said committee meeting to be held before the next meeting, October 18, 1945. Carried, and.the Chair appointed Commissioners Longmoor, Patterson and Ellerbroek. Then Commissioner Patterson made ' the motion that the Secretary advertise the matter for public hearing for October 18, 1945, and have notices sent to each property owner on Balboa island. Motion carried and so ordered. Several plans for proposed buildings were brought up, with Commissioner Isbell making the motion seconded by Commissioner Patterson that same be referred to the Architectural Committee. Motion carried. Secretary Ellerbroek read the notice of public hearing, scheduled for this date, upon the.application of a petition of property owners of Corona Del liar, for rezoning from R-3 to R -1 of all of Blocks 'C' and 'Df and that portion of Blocks 131 and 152, not already zoned for R -1, ex- plaining that said petition had been withdrawn, and therfore the public hearing was not called. Commissioner Patterson made the motion, second- ed by Commissioner Nelson, that the request be approved, and the appli- cation be withdrawn. Motion carried and so ordered.
