IN THE COUNCIL CHAMBERS OF THE NEWPORT BEACH CITY HALL ROLL CALLS Commissioners Present: Copelin, Ellerbroek, Longmoor, Reed, Rudd. ' Commissioners Absent: Briggs (entered at 8:15 for short while) Pleger, Smith, and Wightman. MINUTES: Upon motion of Reed, seconded by Rudd, the minutes of the meeting of August 16th, 1951 were approved as submitted to the Commission. Motion.carried. PUBLIC USE PERMITS: 1. Application of the Hoag Memorial Hospital for construction at HEARINGS: Newport Blvd and Highway 101. No discussion. Commissioner Copelin moved the application be granted, 'seconded by Commissioner Reed and.carried by the follow- ing roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, and Rudd. NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, andWightman. 2. Application of Rosen. Inc, for light manufacturing at 625 Coast Highway, Newport Beach. (Lot G, Tract 919) Chairman Longmoor opened hearing and asked if anyone wished to speak for or against application. Craddock, 226 Heliotrop, C DM: Would like to inquire what other light manufact- uring is in city, where located, and how many people employed. Ana: Hwy 101, at South Coast Construction Co, in M-1 Zone, along Rhine, between Rhine and New-. port Blvd and some in Corona del Mar; however, it would be difficult to say how many people were employed. The Chairman stated that they had asked that Rosan, Inc. provide off - street parking for employees and Mr. Eastman, representing ' company, said that they would work out the off - street parking. Upon motion of Commissioner Copelin, seconded by Commissioner Reed and carried by the following roll call vote, the application was granteds AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, and Rudd. NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, and Wightman. 3. Use Permit application of Chas A. Beecher to erect sign at 609 Coast Hwy, Newport Beach, (Lot M. Tract 919). No.communications; no one to speak for or against. After consideration, Commissioner Ellerbroek.made a motion that the application be granted, seconded by Commissioner Rudd and carried by the following roll call vote, to -wit: AYES: Commissioners; Copelin, Ellerbroek, Longmoor, Reed, and Rudd. NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, and Wightman. 4. Application of Irvin George G for three car garage at 1121 Balboa Blvd., (Lot 19, Block 11, Tract 234 ) R-3 zone. After some discussion, Commissioner Copelin made a motion that the application be granted, seconded by Commissioner Rudd and carried by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, and Rudd. ' NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, & Wightman 169 5. Application of J. H. Greens to turn medical building at 900 Balboa Blvd, Newport (Lots 1 -2 & 3, Block 109, Section B) into office building. No communications, and no one to speak for or against the application. Commissioner ' Reed made .a motion that the application be granted, seconded by Commissioner Copelin and carried by the following roll call vote: Use Permit not valid un- less property purchased by applicant, J. H. Greene. AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, and Rudd. LACES: None ABSENT: Commissioners: Briggs, Pleger, Smith, and Wightman. 6. Application of the Irvine Company to establish, laundry and cleaning establishment at 2471 Coast Highway, Newport (Lots 36 and 37, Tract 1210). Mr. Hadd Ring was present representing the applicant and said that the plans were subject to the approval of the Irvine Company. •Location at West of Chev- rolet Agency, 100 feet. Floor area 60' x 70' or 4,200 square feet. Lot area 100' x 120' or 12,000 square feet. Only other unit on Pacific Coast like this is in Bakersfield. No conflict with zoning - -C -1 zone. Estimate five employees. Dry cleaning material safe. Wants to start construction prior to October lst-- when N.P.A. restrictions go on. The question was raised as to whether it would be advisable to let a laundry and cleaning establishment go in right beneath the residential zone. Commissioner Ellerbroek made a motion that a committee be appointed to contact Mr. Wise, the Planning Consultant, and approve the Use Permit subject to the approval of the committee after consulting with the Planning consultant. Motion seconded by Commissioner Rudd and carried by the following rill call vote, towits ' AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, and Rudd. NOES: None. ABSENT: Commissioners, Pleger, Smith, and Wightman. Chairman Longmoor appointed Commissioners Ellerbroek, Reed, and Rudd to the in- vestigating committee on the above Use Permit application. 7. Application of WallacLe Jeffs for a four unit a tment or dwelling at 1544 Miramar Dr, Balboa, ot 200 Block J, Tract 5187 R-3 zone.. Mr. Sex- ton represented the applicant. Stated that there were no.improvements on the property now. The four units were to be contained in one building. P1anndd parking space for three car garage and one car -port. Since the application had come in the last minute and the Commission had not had sufficient time to study it or see it, Commissioner Copelin made a motion that the application be set over to the next regular meeting October 18th for investigation. .Motion seconded by Commissioner Reed and carried.' VARIANCES: 1. Application of Ted Russell to change rear yard setback from 101 to 51. At 124 Iris Ave, (Lot 28, Block A -36, CUM) After considerable discussion with Mr. RussellIs representative, it was shown how by changing the plans, the Variance would not be necessary. Commissioner Copelin made a motion that the hearin'gelbe closed, seconded by Commissioner Rudd and carried. Commissioner Copelin then made a motion thAt the application be denied, seconded by Commis - sioner Briggs, and carried -by the following roll call vote, to -wit: AYES: Commis'sinners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, & Rudd NOES: None ABSENT: Commissioners: Pleger, Smith, and Wightman 170 2. Application of Marjorie P. Crumlev to divide Lot 1, Block 239, Corona del Mar, (1600 Pacific Dr) into two building sites. Chairman opendd the hearing and asked if anyone wished to speak for or against. — Arthur Hovey, 1602 Pacific Dr. Thinks it unfair. Made application for 1 second unit on his property (236 feet Lent) in 1945 and was refused. j -- Certie House, 1606 Pacific Dr. If you divide that lot, they should have the privilege of dividing in that block. Thinks residents in all of the block would be glad to have two building sites. - -Harry Westover, 1615 Pacific: If variance is granted to change one lot, it should be changed on entire block. Mrs. Crumley was present and said that she would like to buy the property and that it was in escrow now; however, it would be too much property as R-1 for her and considering the size-of the lot --2361 on one side, 2261 on other . and 35' wide - would be appreciative of variance to divide into two building sites. Commissioner Briggs moved the hearing be closed, seconded by Commissioner Rudd and carried. Commissioner Rudd then made a motion that the application be denAdd, seconded by Commissioner Briggs and carried by the following roll call vote, to -wit: AYES: Commissioners: Briggs,.Copelin, Ellerbroek, Longmoor, Reed, and Rind. NOES: None ABSENT: Commissioners: Pleger, Smith, and Wightman Commissioner Briggs then moved that the Commission furnish Mr. wise with a ' map on this area and ;resent him with the facts regarding this property and ask that he make a recommsndation. Motion seconded by Commissioner Reed and carried. 3. Application of Ethel R Free for 50� rear yard variance on . Lot 8, Block 16, Section 3, Balboa Island, 314 Coral Ave). Chairman declared hearing open. Secretary Copelin read letter from neighbors in area stating that they had no objection to the granting of the request, letter signed by: Raymond Dorn . 313 Apolena Ave Harry Williams 317 Apolena Ave Clayton Lowe 310 Coral Ave A B Campbell 312 Coral Ave Paul Parker 316 Coral Ave Emery Rider 318 Coral Ave The overhang is for the second story only. Commissioner Ellerbroek made a motion that the hearing be closed, seconded by Commissioner Copelin and car- ried: Commissioner Ellerbroek than made a motion that the application be granted, seconded by Commissioner Copelin and carried by the following roll call vote, to -wit: ' AYES: Commissioners: Copelin, Ellerbrosk, Longmoor, Reed, and Rudd ' NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, and Wightman 171. 4. Application of H. J. Larison to overhang roof on front of house 20" it 306 The Rialto, (Lot 4, Block 236, Canal Section). After discussion, Commissioner Copelin moved the hearing be closed, seconded by Commissioner Rudd and carried. Commissioner Copelin then made a motion that the appli- cation be denied, seconded by Commissioner Reed, and carried by the follow- ing roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, and Rudd. NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, and Wightman. 5. Application of J M McFadden to extend.proposed addition to rear property line at 105 8th St, Lot 3, Blk 71 East Newport). No hardship caused in neighborhood by the granting of said application. Commissioner Ellerbroek moved the hearing be closed, seconded by Commissioner Reed andearried. Commissioner Rudd then made a motion that the application be granted, seconded by Commissioner Ellerbroek, and carried by the following roll call vote, to- wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, and Rudd, NOES: None ABSENT: Commissioners: Briggs, Pleger, Smith, and Wightman. 6. Application of William Bi for relief from strict application of Section 9105.5.of Ordinance 35. 119 for Ave, Balboa Island (Lot 12, Block 3, Section 1,) Applicant was present and said that addition was a necessity. Room to be 12' x 161. Variance from ordinance requiring twenty feet fv garage; now measures 18 feet from setback to building. Posts can be 18 feet and rood can project two feet from posts making the twenty feet; therefore, no variance required. .Refund fee was ordered for the applicant. AMENDMENTS- Second hearing re- opened on application of Gladys Sidler to rezone Lot 1, Block 13, Balboa Tract (901 E Bay Ave) from Rr3 to C -1. Mr. Ross Greeley was present representing the applicant and stated that the applicant again desires to have the hearing post -poned indefinitely. Said they did not care to with- draw application but wanted to keep it active. - -Van Pelt: Owns property adjacent to Sidler property. Thinks zoning 'should end and begin in middle of street and not allow any spot zoning. Would like to see the matter settled once and for all. When asked why they kep wanting to postpone the hearing, Mr. Greeley said he was in no position to answer that. Mr. Van Pelt said that he understood 7 out of 13 of the property owners were not in favor of postponing it. Said the property owners were told the easement would be lifted if they signed the petition for postponement. Commissioner Ellerbroek made a motion that the hearing be set over to the regular October meeting on the 18th and that definite action be taken at that time. Motion seconded by Commissioner Reed,and carried. 172 First Hearing: Application of certain property owners to rezone from R -1 to R -2: NE 10' Lot 13, & Lot 15, Block 138, CRM 10' Lot 25, & Lot 27, Block 138, CDM , Lot 12, Block 139, CDM Lot 20, Block 139, CDM Lot 22 and 24, Block 139, CDM Chairman opened the hearing and the Secretary read a letter from eight property owners to keep the property in an R-1 zone. James Ray spoke in behalf of the property owners petitioning for the change of zoning. Said there were lQ lots involved, 9 improved, 7 two - family resi- dences. -- Cormakk, owner of Lot 12. Didn't think the zoning should be changing back and forth. Bought his property for R-2 and would like to see it changed back to that. Commissioner Copelin moved the hearing be closed, seconded by Commissioner Reed and carried. Setover to second hearing at next meeting. Commissioner Rudd moved and Commissioner Ellerbroek seconded the motion that the Planning Commission pass a Resolution of Intention to hold hearings fcr lots not involved in the application. Motion carried. NEW BUSI- The Secretary read a Resolution of Intention to hold hearings to consider a NESS proposed amendment to sections 9103.73 and 3110 of the. Municipal Code so as to allow the use of commercial incinerators under certain regulations and cordtions. Commissioner Reed made a motion that the Resolution be passed ' and it be advertised that such hearings would be held, seconded by Commissioner Rudd and carried by.the following roll call vote, to -wit: AYES: Commissioners; Copelin, Ellerbroek, Longmoor, Reed, and Rudd. NOES s None ABSENT: Commissioners; Briggs, Pleger, Smith, and Wightman. COMMUNI- Secretary Copelin read a letter from W. T. Jefferson with enclosed photo CATIONS of Ocean Blvd with utility poles, T. V. areial etc., marring the view. He asked that in the future, builders be made to bring utilities from below, have sunken garbage and trash containers, and that they be allowed to incline their driveways to their garages at the rate of two feet or more per ten Peet, — thereby helping to save the view. It was suggested that a letter be written to Mr. Jefferson saying that the Planning Commission has no juris- diction on such matters. Carried and so ordered.
