Speeial-Session at 7:30 P.M. in the City Hall, Sept.
30, 1936. Chairman H.L. Parks presided.
Present: Parks, Patterson, Palmer, F.W.Briggs,
L.W.Briggs. Inspector Nelson and Consul -
tant L.Deming Tilton attended.
Absent: E.B. Whitson, Baum, Thompson.
Minutes: The minutes of the regular meeting of
Sept. 16,1936 were approved as written on
motion of Com. Palmer seconded by Com.
Patterson and carried.
PUBLIC HEARING: On the request of the chairman, Mr.
Tilton took charge of the meeting and announced that
any persons present desiring to speak on the petition
for rezoning by the Irvine Co. or by Mr. A.L. Willet
would be heard.
W.V. EMPIE, representing the Citizens Bank of Los
Angus, a large property holder in the Corona Del
Mar district, stated the small area in Block "D" now
zoned C -2 was so zoned after careful consideration at
the time of the adoption of the Ordinance, that it is
required for the benefit and servicing of the Corona
Del Mar area, that it answers an imperative need, and
that the Bank is Entitled to make this request as the
acted in good faith with the city in making certain
adjustments of streets and property boundaries baseds, .
in part, on the zoning of the general area as shown
by the ordinance. He asked that the zoning be left
as it-is.
In response to an in %airy Mr. Patterson stated this
C -2 zone in Block "D is mmed entirely by the Citi-
zens Bank and Mr. Fisk.
MR. WILLETS stated that, in his opinion, no property
in the area is less desirable for business use on
aecount.of its inaccessibility.
JUDGE HYER asked how much land in'this C -2 district
is owned Fy the Citizens Bank and Mr. Patterson re-
plied "about 300 feet on the Road and 175 feet on
the bay front ".
In reply to Com. Palmer's inquiry if the Bank plans
to develop any of this land Mr. Empie stated that he
could not say at the present time.
JUDGE HYER remarked that if the property is not being
offered for sale the owners plea for the retention of
business zoning is not entitled to a great deal of
consideration.
MR. EMPIE stated that a comprehensive development of
the Bank's holdings in this general area is eontem- 11
plated which would call for the use of the parcel
under discussion for commercial purposes. Also,
that this development must be deferred until comple-
tion of very complicated negotiations with the city,
and others.
MR. 'MILLET remarked if the owners are sincere in
their stated purpose of providing commercial service
to the area it seems strange that they would choose
location so inaccessible. Further, that the props rt
owners who have built and are building good residen-
ces in the area are entitled to consideration and {
protection.
MR. INGHM stated that the small size of this C -2 dis-
trict would, in his opinion, classify it as spot
zoning, as it is not large enough to be of any great
value as such, and, further, that commercial uses in
this small district would hurt adjoining residdntial
uses. He asked *list the great necessity for business
on the water front might be in this location, and why
the Bank was favored with a monopoly. Would favor
allowing for the construction of a city pier in this
district and restriction otherwise to R -1.
A. FINDER, of Norwalk, a property owner on the bluff
above this C -2 district, favored a change to residen-
tial zoning.
MR. EMPIE stated that in view of certain deeds being)
in escrow in connection with the Bank's adjustments
with the city, an indication of the commission's pro-
bable recommendation was imperative.
MAXWELL PETITION: Mr. Maxwell stated that in the
event the Council does not act favorably on the re-
commendation now on file from the Planning Commission
to amend the ordinance to show R -3 zoning in the
block between 9th and 10th Streets and between Cen-
tral Avenue and the U.S. Bulkhead line, to R -3 throw
out, that he would at that time withdraw his peti-
tion. He remarked that he was satisfied that the
present non - conforming use &nown as Bob's Boat Shop
would soon disappear if the R -1 zoning is retained on
the bay front in that block, and requested his peti-
tion be temporarily tabled.
40 MR. REUTHER, owner of two bay front lots adjoining
Booms Boat Shop on the west, also property across Bay
Ave. from them, remarked that he had recently con-
cluded a long and expensive court fight to clear the
title to this property and it had consequently cost
him.a very high price; did not know the city had a
zoning ordinance but stated that had he been doing
the zoning in this area himself, could not be better
pleased. Wants the present zoning retained. Stated
he questioned the legality of the lease to the Legion,
also that he would not oppose an auditorium on the
Legion property if the uses allowed to be made of it
were properly restricted.
ARMAND MONACO, owner of four lots in the same block
w —iIh the Maxwell property, two of which are improved
with single family residences, stated he and his fam-
ily had pioneered the bay front west of the Yacht
Club, that district is continually improving and he
was opposed to any alteration in zoning on the bay
front here from the present R -1 requirement.
MOTION: 'Come Patterson moved that we request the
Council to return to us for further consideration our
recommendation for change in zoning from R -1 to A -3
on the bay front between 9th and 10th Streets, and
40 that the Legion be notified when the Commission would
bring this matter up for such reconsideration. Se-
conded by Com. Palmer and carried.
