Initiated by: The City of Newport Beach Public hearing was continued the the Chairman introduced the following items of correspondence as having been previously received: Letter from Mr. & Mrs. Russell Flynn on Garnet Avenue; Letter from Mr. & Mrs. Lynch on Apolena; Letter from Mrs. Wilcox on Agate; Petition and letter from Cathy Clark on South Bay Front, consisting of many pages; Petition consisting of three pages circulated by Bill Hardesty on Park Avenue; Letter from Elynor Garrett, an absentee property owner. He stated that time did not permit the return of more than approximately 30% of the cards sent out and would like a little more time in order that a more accurate tabulation could be made. Russell Flynn of Garnet Avenue appeared before the Planning Commission and stated that he felt the vote was 'unfair. Carroll Beek of Balboa Island appeared before the Planning Commission in favor of leaving the zone as R -2. Ralph Miller, property owner on Balboa Island appeared before the Planning Commission in favor of allowing the property owner.to distribute his own square footage and also suggested that one and one -half garages be required for each unit. Bob Slater, 512 S. Bayfront, appeared before the Planning Commission and stated that limiting the number of units would not control the number of • people or cars on the Island and nothing would be accomplished by changing the zone. Dr. Robert Nevin, 7002 W. Oceanfront, appeared before the Planning Commission in defense of tax- paying property owners whether or not they live with the City of Newport Beach. Harvey Pease, owner of commercial property on Balboa Island, appeared before the Planning Commission and commented on parking. He also appeared in opposition to any change of zone on the C -1 -H property at the northwest corner of Park Avenue and Agate Avenue. Richard Martin, 405 Bayfront appeared before the Planning Commission and questioned the use of the number of bedrooms as revised figures for popula- tion. Hannah Flynn, 110 Garnet appeared before the Planning Commission and commented on zoning enforcement. Ralph Hanger, Balboa Island appeared before the . Planning Commission and commented on property values. Robert Hixson, 215 Agate, appeared before the Planning Commission in favor of the amendments. Page 3. Mr. Lynch, 217 Apolena appeared before the Planning Commission relative to code enforcement and a newspaper article . regarding same. Planning Commission discussed zoning enforcement. The Chairman declared the public hearing closed. X Following discussion, motion was made that no action be taken on Amendment No. 337 and No. 338, but instead move that the emergency ordinance be continued until the process of gathering informa- tion from the community on density requirements has been completed.and at that time the staff be instructed to develop a substitute ordinance in accordance with the information that is gathered. Following discussion on the motion, the above motion was withdrawn and a substitute motion was made that Amendment No. 338 be withdrawn. X Based on the above, plus the fact that commercial property .lends itself to the neighborhood environ- ment and in particular to this neighborhood where it puts things within walking distance for everyday living, motion was made to withdraw Amendment No. 342. Frank Spangler appeared before the Planning Commis- sion on behalf of the applicant and requested that Amendment No. 340 be withdrawn. He was informed of the ramifications of his request after which Mr. Spangler requested to confer with the applicant in view of the policies regarding residential development in commercial zones. Frank Spangler appeared before the Planning Commis- sion on behalf of the applicant and stated that the property should be developed as residential because of surrounding residential development, the density is lower fo this type of development and commented on the parking, open space and various other elements of the project. Mr..Steigwold appeared before the Planning Commis- sion in opposition of the Use Permit and Change of Zone and urged the Planning Commission to deny these requests. There being no others desiring to appear and be heard, the public hearing was declared closed. Planning Commission discussed marine facilities and their related problems. • Public hearing was re- opened and the following persons were heard: David A. Sebastian; The Owner of Harbor Glass who did not state his name. The Chairman again closed the Public Hearing. Location: Lot 7 of Block 9, Seashore Colony Item #1 AMEND- MENT NO. 335 Tract. located at 209 Fern Street, APPROVE between West Coast Highway and Canal Street in Newport Shores. Zone: C -1 -H Applicant: Dr. Robert Nevin, Newport Beach Owner: Same as Applicant. Assistant Community Development Director Hewicker reviewed the application and staff reports with th Planning Commission. He also read the condition attached to Use Permit No. 353. Planning Commis- sion reviewed the plot plan in connection with Use Permit No. 353. Public hearing was opened by the Chairman. Dr. Robert Nevin, applicant, appeared before the Planning Commission and answered questions on the background, use, and improvements to the property, both in connection with the Use Permit No. 353 allowing the operation of an animal hospital on four and one -half lots as well as the requested amendment to change one of the lots to an R -2 zone Planning Commission discussed the fact that Use Permit 353 must be amended before any final action can be taken on Amendment No. 335 and the most desirable way to handle the matter. There being no others desiring to appear and be heard, the public hearing was closed. X Planning Commission recommended to the City Council that Amendment No. 335 be approved but that no final action be taken until the applicant has submitted an application for the removal of Lot 7 from the original Use Permit No. 353. Also, it was recommended that at the end of the meeting the Planning Commission initiate proceedings to rezone Lot 8, which adjoins the property, to an R -2 zone. Page 10. COMMISSIONERS m � � A P &L .CALL S" CITY OF NEWPORT BEACH October 5, 1972 MINUTES Tom Malcolm, 146 Via Undine, Newport Beach, Preside it of the Lido Isle Community Association, appeared before the Planning Commission and presented a petition with approximately 1,000 signatures of persons in favor of the lights which have been installed. He also presented a map of the island indicating properties for or against the lights, greenbelt areas, and other tennis courts on the island. He stated that they have no objections to conditions No. 1 through No. 4, however, they felt that condition No.5 was unnecessary. Those in favor of the lights were requested to stand. R. W. Wright, 217 Via Jucar, appeared before the Planning Commission in opposition to the lights and stated that the lights were creating a nuisance in the area. He presented a petition with signatures of 13 persons in opposition to the lights. Those persons in opposition to the lights were requested to stand. Gene Vreeland, 115 Via Jucar, owner of the vacant property next to the tennis courts, appeared • before the Planning Commission and stated that he plans to build a new home on the lot and is in favor of the lights on the tennis courts. Ned Roder, 121 Via Havre, appeared before the Planning Commission and stated that the Community Association only wants the same use on this court as is permitted on the other courts on.the island. He also questioned the need for condition No. 5 of the'staff report. Margaret Howland, 216 Via Ithaca, appeared before the Planning Commission in opposition to the lighting and stated that the L.•I.C.A. Board is very lax in rule enforcement and does not think it is fair for the surrounding property owners to be subjected to the noise after dark. She also questioned the signatures on the petition in favor of the lights. Jean Hecker, 226 Via Ithaca, appeared before the Planning Commission and stated that the lights from the tennis court shine directly in her front room, patio and den. . Julie Jardine, 208 Via Dijon, appeared before the Planning Commission in rebuttal to a statement made by Mr. Wright. Irene Hardage, President of the Lido Isle Women's Club, appeared before the Planning Commission and stated that she lives near the Via Genoa tennis court and does not find the lighting objectionable. In fact, she uses the lighting as a night light. The Chairman closed the Public Hearing. Planning Commission discussed shields for the lights to prevent the rays from shining into adjacent homes, continued maintenance of the lighting, and enforcement of the conditions imposed on the use permit. The interior surface of the existing top shields.shall be painted flat black, and additional bottom and side (end) shields shall be installed as necessary.in order to.. obscure the light source from the following locations: a. The northerly side of Via Lido.Nord. • b. The southerly side of the adjoining basket ball court. c. The easterly side of Via Jucar. Page 15. The applicant shall submit to the Department of Community Development a statement from a licensed electrical engineer certifying that the lights have been adjusted and the shields painted and installed as required by Condi- tions No 1 and 2, and shall be maintained in the above certified condition. 4: The electrical panel containing the light switch shall continue to be provided with a. keyed lock. The lights shall be turned off by 10:00 P.M., and the panel shall remain locked between the hours of 10:00 P.M. and 8:30.A.M. 5. To insure that the installation, maintenance and operation of said lights remain compatible with the residential uses of the adjoining properties, the Planning Commission shall review this application at the end of.two years following the effective date of the use permit.
