E Chairman Dosh reviewed.a.- letter received by members of the Commission fr.om.two- station owners, Mr. George Perlin who.owns.an.Arco Station in Balboa and Mr. Tom Sharp who owns.a Union Station in Corona del Mar objecting -to. certain portions of the proposed ordinance-,,.namely, the number of parking spaces required..per..lube bay, the display of tires and the requirement that all work be done within a building. ..... Both Mr. Perlin and.Mr. Sharp addressed the Com- mission elaborating on-their letter. Mr. Jack Barnett of.the.Chamber of Commerce addressed the Commission.and stated he had worked with the station owners after receiving a copy of - the proposed ordinance.. He stated further that he believed all the.people desired to improve their stations; that.the.ordinance was O.K. for the new stations but that stations that have been in business for long time would have difficulty in complying with it. Acting Community Development Director Hewicker reviewed the application with the Commission,.both as originally presented and as amended. Mr. Reggie Doll, representing the applicant, addressed the Commission and displayed photographs of his marine fueling dock in Dana Point Harbor. Page 5. The Commission, in their discussion, expressed concern about repairs being made at this location and questioned whether the operation would meet the safety requirements of the Municipal Code. They also expressed the opinion that this was an improper use in the area. Fire Marshal Noller addressed the Commission and stated that the Fire Department had not approved the installation and that they had never received a complete set of plans; he stated further that the Fire Prevention Code does prohibit doing the type of work indicated in the application. Mr. Noller also answered questions of the Commission regarding existing nonconforming marine fueling facilities in Newport Beach. Acting Community Development Director Hewicker stated that the staff had asked for elevations and accurate plot plans showing exactly what is pro- posed but they had not been forthcoming. Chairman Dosh questioned Mr. Doll as to whether he wished to revise his use permit, withdraw the appli- cation, or have the Commission take action that evening based on the information at hand. Mr. Doll x asked for a continuance until October 21, 1971, x which was granted. Mr. Al Fink represented the owners through Caldwell Banker and explained that Burgess= Donovan, who had filed Tentative Tract No. 7482 covering this area, were -no longer involved and that a new map would be filed. The following persons spoke in opposition: Mr. Don Connor of 2442 Windward Lane, who submitted a petition signed by 26 property owners on Windward Lane; Mr. Ralph Voss of 2437 Windward Lane; Mr. Bill Wille of 2212 Francisco Drive; Mr. Don Voronaeff of 2401 Windward Lane who stated that at the time of annexation a petition with 155 signatures had been presented requesting R -1 -13-2 zoning. The major concern expressed was with the type of development which would take place, the size and frontage of the lots, and that the setback require- ments along Windward Lane should be in conformance with those already existing. Mr. George Robinson, one of the owners of the property, addressed the Commission and stated that he had owned the property that was developed on Windward Lane as well as the property on Francisco Drive, and that he was sure the homes that would be developed on.the subject property would be equal or better in character than those already built in the area. The Commission discussed this application at length and it was -the consensus of opinion that zoning which caused 90% of the entire "Moden Area" to be nonconforming was unrealistic. That landscape planting and sprinkler irrigation plans and specifications shall be submitted by the applicant and be approved by the Community Development Department prior to issuance of.an occupancy permit. 2. The Commis- sion discussed the advisability of granting a waiver at this time; also the possibility of estab- lishing a bicycle trail at this location. x x Following a further discussion, Resubdivision No. 317 was approved subject, to the following conditions: 1. That a parcel map be filed. 2.. That all public improvements be con- structed as required by ordinance and the Public Works Department. 3, That all grading be in accordance with grading plans and reports approved by the Public Works Director and a qualified Soils Engineer.
