Use Plan and Development Policies for the Local Coastal LOCAL COASTAL` PROGRAM Program. INITIATED BY: The City of Newport Beach NEWPORT BANNING RANCH NEWPORT AN Mr. Bill Banning, President of Beeco Limited R NCH which owns Newport Banning Ranch, appeared be- Banning stated that fore the Commission. Mr. 507 of the Newport Banning Ranch lies with - acres in the westerly portion of Newport Beach, of Limits of Newport which 50 acres lies in the City Beach. Mr. Banning stated that'his presentation will lay the groundwork for amore extensive pre sentation in the future. Mr. Banning stated that all but 30 to 40 acres of lease will the property is subject to an oil .which last until 1994. . He stated that intensive into planning activities have not been entered the because of the oil lease. Reddick, presented an.aerial photo of the area and explainei the.boundaries of the area in.relation to the City of Newport Beach. Mr. Stevens also pre - sented a diagram of existing conditions which depicted the relationship between surrounding lan uses. Mr. Stevens stated that based on their analysis, the conceptual land use diagram was developed, which was also presented to the Commission. He stated that the criteria utilized for the land use would not preclude the marina or water re- lated uses, which is in keeping with. the intent of the City of Newport Beach.. Mr. Stevens stated that the land uses they are proposing for the 50 acres within the City will balance the plan and work well with.the.current long term oil leases. He stated that in.changing the property -in question from low density resi- dential to employment uses, will also change the traffic generation. He stated that future- meetin will analyze and justify that the existing cir- culation system will support the facilities, especially in the future when the ultimate system, is built out. He added that the employment uses will have a very positive impact on the area. He stated that they envision some form of resi- dential uses for the upper portions of the bluff area. Mr. Stevens stated that a General Plan Amendment has been submitted to the County of Or be- cause a land use designation of 5.3 Recreational. is not appro.priate for the entire site...He,state( that they are interested in developing the land in a water - .o.rientated manner. Mr. Stevens re- quested that the Commission defer their straw vote on the land use segment for the 50 acres,. until a full presentation and information package. consisting of traffic, environmental, soil report and so on, can be made to the Commission. commissioner Beek stated that he would like to see supporting data that would indicate that it is beneficial to Orange County as a whole, to -2- 7 N 7C W ROLL CALL U October 9, 1980 - 9 2:OO p.m. MINUTES INDEX. Commissioner Allen stated that.she would like to see specific numbers of intens -ity in development and any plans for service /commer- cial uses. After considerable discussion by the Commission, it was decided to hear the full presentation on the Newport Banning Ranch at the Study, Session - Meeting of October 23, 1980. Commissioner McLaughlin. referred to the September HOUSING 18th .minutes regarding the housing element where ELEMENT the Commission voted to delete the Condominium Conversion Ordinance as affected by the LCP area. Planning Director He wicker stated that by deleting the Condominium.Conversion Ordinance, the Com- mission was stating that they did not feel that the Condominium Conversion Ordinance was a viable method of preserving moderate /low income housing. He stated 'that.the areas covered by the LCP would still be subject to the Condominium Conversion Ordinance. Planning Director Hewicker explained the use .of hiring a consultant, which will assist the staff in incorporating the changes as have been suggestei. by the Commission.' The Commission was also in- formed that a consultant.will be hired for the preparation of the City's Housing Element. Commissioner Balaiis stated that the actions of PREAMBLE the City of Newport Beach that already comply to oLSGUSSI0 the Coastal Act need to be identified in the Plan. MINUTES, Gty of t Beach INDEX ROLL CALL Commissioner Allen stated that a number of re- commendations as found in Position Paper No. 2 of the Positive Action Team should be included in the preamble. She questioned the use of the private.property issue, as it may evoke a negative response. She questioned the paragraph on Page 5 and stated that staff may inquire as to its of saturation purpose. She stated that the.issue it is important that it is a serious concern and be mentioned. Commissioner Beek stated that the - parking lots are saturated, not the ocean beaches. Commissioner Allen stated that the issue of satur- ation goes beyond the number of people on the water, and that traffic saturation is a major. the "saturation" problem. She stressed that word is an important term. Commissioner.McLaughlin stated that this would not be a good reference point as there are already some discrepencies noted. She stated that staff has a good idea of what the positive actions have been of the City. Chairman Haidinger concurred. Chairman Waidinger stated that he would like to defer this issue for later_ in the hearing. A-5 Master Plan of Streets and Highways Commissioner Thomas stated that it was his the Commission had scratched understanding that the discussion using the City'.s Master Plan of: Streets and Highways as a guide for circulation, and that it was clear that University. Drive was separate. Commissioner Balalis_ stated that he had.under- stood the.Commission had adopted the circulatio element with the exception of University Drive. Chairman Haidinger stated that the motion stated that University. Drive would specifically be. excluded from being an element of the City's. Master Plan. " Mr. Lenard stated that perhaps a separate poli.c statement can be drafted for the exclusion of University Drive from the circulation element. A -6 - Shuttle Bus System Commis sio.ner,Thomas stated that the September, 4th staff report contains the policy language that more clearly reflects the Commission's intentions. A -8 'Parking In referring to the September 4th 'staff report, Commissioner Balalis stated that the commercial in -lieu parking fees should not be a part of the LCP, but to indicate that-the City has an in lieu parking fees program. . Commissioner Beek stated that he does not see the relationship between.the in -lieu parking program and the LCP. He stated that the in- lieu program provides parking for commercial and employment parking on weekdays. He suggeste that the references to in -lieu parking be 'delete entirely. The Commission concurred. A -9 Public Restrooms Commissioner Balalis stated that the August 21st 2:00 p.m. minutes reflect the Commission's in- tentions on the public- restroom issue. In referring to Page.25 of.the LC.P Draft, Commissioner Beek stated that further studies need to be made before specific locations for public restrooms are identified:. He stated that he would like to defer this issue until he can draft alternative language•to propose to the Commission C MISSIONERS1 October 9, 1980 - 2:00 P.M. MINUTES: 3 N City of Newport Beach ROLL CALL INDEX A -11 Boat Launchinq Ram Commissioner Beek asked staff where the Santa Ana River Mouth wording would occur in the LCP. Mr. Lenard suggested that the policy be placed on Page 25 under policies for visitor serving facilities in the draft LCP,. He stated that comments could be placed specifically under the Beeco /Banning property also. Planning Director Hewicker stated that the concern of the Commission was the oceanside, which is not a part of the Beeco property. Commissioner Beek stated that perhaps a specific area.should be created for the Santa Ana River Mouth. Motion X Motion was made that a specific area for the Santa Ana River Mouth be added to the area descriptions starting on Page 43 of the Draft • LCP, which would include the language that "The City shall encourage provision of a small boat launching facility at the Santa Ana River Mouth, if feasible." Commissioner Allen asked what the advantage would be in making a special area. Commissioner Beek stated that this is a special area where there is a specific objective. He stated that this language coul.d also be added to Page 26, Item No. 15 of the Draft LCP. Ayes X X Motion by Commissioner Beek was now voted on, Noes X X X X which MOTION FAILED. B Public Property Leaseholds Commissioner Beek noted that he would not be participating in the subject of Public Property Leaseholds. • Commissioner Balalis asked if the City would be able to purchase strictly public recreational uses with these funds. B-3 Beacon.Bay- commissioner Balalis asked how the Beacon Bay lease is handled. PI.Anning Director.Hewicker...,:. stated that It is leased to a g roup of. con- trolling individuals which in turn are sub -. leased for-individual home sites. Commissioner Balalis asked how the Marinapark lease is handled. Mr. Lenard .sta.t ed.that Marinapark is leased directly to individuals by the `City Commissioner Balalis asked If the master lease holder can be eliminated from Bea,con Bay. Commissioner Cokas stated that..this is not an appropriate issue for the Commission, to determine, but rather an administrative process for the,City Council to determine through the— City Charter. Commissioner Balalis concurred.. B-5. Marinapark Commissioner Thomas stated that improving the access should be included. Commissioner Balalis asked staff how many, actual residents live at Marinapark and h OV many have other residences. Mr. Lenard stated that 12 out of 58 are permanent residents of Marinapark,. Commissioner Bilalis stated: that if this is the case, the wording for Marinap.ark should be revised. • Chairman Haidinger suggested deleting the words* ".In allowing existing uses, to continue". MINUTES City of Newport Beach ROLL CALL INDEX Commissioner.Allen stated that she is concerned to' change substantially what has already been decided, without the residents of Marinapark present. Commissioner Thomas suggested that the wording from the LCP minutes of September 4th, 2:00 p.m. should be used. Mr. Lenard stated that the last paragraph under - Marinapark on Page 44 of the Draft LCP was de- leted by the Commission. The Commission dis- cussed the possibility of changing the ultimate land use designation to - residential rather than recreational /environmental open space. The consensus of the Commission at that time was that the land use designation be recreational/ environmental open space, with no specific reference to phasing out the mobile home park. Additionally, Commissioner Thomas suggested comments on improving access and signing. . Commissioner Thomas stated that the minutes of September 4th,.2:00 p.m. on.Marinapark remain,_ with the deletion of "In allowing existing uses to continue ". PRIVATE PROPERTY PROPOSALS C -1 Housing Component 0 Planning Director Hewicker suggested that rathe than delete the reference to the Condominium Conversion Ordinance, the provisions of the Condominium Conversion Ordinance should be tightened to prohibit the removal of existing residential structures. Chairman Haidinger stated that this was not the intent of the Commission. Commissioner Balalis stated that the housing element should be part of the overall City housing element rather than specific. Chairman Haidinger concurred. Commissioner Balalis excused himself from the meeting at 4:25 p.m. m t.Il 0 October 9, 1980 - 2:00 p.m. of Newport Beach COMMERCIAL AREA.BOARDWALKS MINUTES Commissioner Allen referred to-the August 21st minutes of 2 :00 p.m. and stated that her motion on the commercial walkway should be included in the Plan. Mr. Lenard referred the Commission. to Page 1 of the September 4th staff report, where the staff drafted the suggested policy language on this issue. Mr. Steve Speck, representing Urban Assist, Inc., appeared before the Commission. Mr. Speck sug- gested that the wording be revised to read, "The City of Newport Beach shall require, where feasible, the granting of access easements in all new commercial waterfront developments in order to establish continuous access along the bay. . Mr. Speck stated that by adding the wording "where feasible" this would allow for specific review on a project by project basis. He stated that there are commercial uses such as gas docks, boat yards, and haul -out facilities which are not conducive to an access provision. Additionally, public safety amd security standpoints must be considerec He stated that.perhaps these uses need to be spelled out in the report. Commissioner Allen stated that the motion speci- fically dealt with these concerns. She stated that it was her intention that this not be arbi- trary, but that it be unilateral. She added that the language states that it be "consistent with public safety and protection of private property. She also added that her intent was not to provide access across the boat portion of marinas. She made reference to Lido Village and the access to the commercial buildings, not to the boats. Mr. Speck stated that he felt that the addition of "where feasible" would make the discretion on a case by case basis. Mr. Lenard stated that the reference to security and protection of private property was deleted because.a public walkway-is an inherent conflict with security and protection of private property. -10- ROLL CALL 0 Motion Ayes Noes Abstain Absent 0 X X October 9, 1980 m 2:00 p.m. Mr. Lenard stated that language such as "where feasible" may not be a. valid recommendation.. Planning Director Hewicker stated that the term "public safety" was included in the language. He stated that.the option would be that the walk could be placed on the street side of the proper as opposed to the bay side, thereby allowing a continuous pedestrian way. Chairman Haidinger stated that it is appropriate for the private property, but that he is un- comfortable with the public safety restriction only. Commissioner McLaughlin stated that she concurred with..Chairman Haidinger's concerns, but that the wording needs to be revised. Commissioner Cokas stated that the language allow many options, except that of jeopardizing the safety of the public. Motion was made to accept. the.wording of the staff report of September 4th, Page 1, Item 1, as written. Commissioner Beek stated that he would vote in favor of the motion because marinas that do not have public walkways, does not mean that the public stays out. He added that there would be no additional jeopardy to private property in- volved because of this action. Motion by Commissioner Thomas was now voted on, which MOTION CARRIED. RECREATIONAL AND MARINE COMMERCIAL Mr. Lenard explained the Alternative A and Alternative B. language to the Commission. Commissioner Allen stated that she is generally supportive of the concept on incentives. She stated that considering the particular parking problem on the Peninsula, it may be appropriate . to include a statement similar to the variance. requirement, in that it would not be detrimental -11- EATI COMMISSIONERS1 October 9, 1980 - 2:00 P.M. Chairman Haiding;er stated that there are more per mitted uses in A1_ternative B, as compared to Alternative A. He added that Alternative B would allow for more uses permitted, without the re- quirement of a use permit. Mr. Lenard pointed out that Alternative B..permits professional office uses on a joint use basis, whereas Alternative A does not permit professional office uses on the waterfront. Mr.. D. T. Daniels of Ardell.Investment Company appeared before the Commission. He stated that Alternative B is more desirable in their judgement • than Alternative A. He stated that it represents a logical and rational approach to the Recreationa Marine Commercial area. Mr. John Curci of Newport Beach appeared before the Commission. He stated that in following the Recreational /Marine Commercial issue, Alternative B clarifies the texts which in the past, has been too restrictive. Ms. Nancy. Kimble, member of the LCP Committee, appeared.before the Commission. She stated that the Committee intended on having a very separate designation-for the waterfront area for.the busi- nesses that need to be on the water in order to, exist at all. She stated that they feared that economics would absolutely do away with these businesses. In addition, she.stated that these businesses are a part of the marine ambience that need to be preserved. Mr. Hightower, President of the Balboa Bay Club, appeared before the Commission. He stated that the language on Page 8 of the October 9th staff report is not clear when it states, "uses which • may be permitted. . ." He stated that by actuall rezoning certain areas of the waterfront as coastally uses. is the intent.of the Coastal Act where it states "to protect coastally dependent uses." Motion K Motion was made that the concept of zoning specifi areas of the City as coastally dependent uses be considered by staff and brought back to the.Com- miss.ion in the LCP. Commi.ssioner Beek stated that the moti.on should.be broadened because there.are also supporting uses, such as engine repair, which does not necessarily have to be on the waterfront to exist. He stated that some of these businesses may find it more convenient to be located on the waterfront, and. should be.permitted on the waterfront also. He stated that there must be a category for marine • dependent uses which must be on the waterfront to exist. Secondly, coastally related or marine supporti.ve.uses which will be permitted on the waterfront also. He stated that, the intent would be to exclude those uses which are very lucrative, and do not. -have to be on the waterfront to exist. AmendmentI I I I I Commissioner Thomas amended his motion to include I other coastal related uses which are marine. orientated. 0 Chairman Haidinger stated that a.cr.eation of this type of zone would eliminate flexibility. Plannin Director Hewicker stated.that it would create many legal non - conforming uses. Commissioner- Thomas-stated that any new zone usually has these affects. Commissioner Allen stated that she does not feel that it should be required that waterfront proper be zoned specifically for those uses. She stated that she did not feel that there is enough of a mandate to require their protection that restric- tively. She added that she is very much in favor of incentive uses which would preserve them. -13- COMMISSIONERS J m z yyS) October 9, 1980 - 2:00 p.m. of NeWDort Beach MINUTES Commissioner Thomas stated that it is not his intent to designate every lot on the entire water front as coastally dependent uses. He stated tha the .concept i.s that areas be designated to meet the demand that currently exists. Commis- sioner Beek stated that the public has been crying`o.ut for many years that the marine uses are.disappearing. Secondly, many boat owners were contacted by the LCP Committee with a questionai °re to.determi.ne their requirements.for marine services on the waterfront. Unfortunately, he stated that the results of the questionaire have not been tabulated. He added that there is a great deal of public interest in boating and yachting activities because these activities give the harbor its ambience and character. He stated that this is why yacht clubs should be a permitted use on the waterfront. Mr. Burnham, Assistant City.Attorney, stated that • in his opinion, because this particular subject has.as an integral part, that of coastally de- pendent uses, Commissioner Beek should not vote on this topic. He stated that the FPPC has ad- vised that Commissioner Beek would be unable to vote on policies that were under the heading.of coastally dependent uses. Commissioner Beek stat that he would defer voting in view of the City Attorney's opinion. Commissioner Allen stated that she would like to see the final results, of the survey Commissioner Beek had referred to, if and when it can be made available. Chairman Haidinger stated that he would be voting against the motion because the proposed alternati give more flexibility and have the incentive feat Ayes X Amended motion made by Commissioner Thomas was Noes X X X X now voted on, which MOTION FAILED. Planning Director Hewicker stated that yacht clubs have historicall been a use in the City which have been permitted in residential zones, subject to use permits. He added that invariably, the subject of parking com up in relationship to the adjoining residential. uses. Planning Director Hewicker suggested that possibly - social clubs should be placed in the use.permit category, due to the-relationship to adjoining land uses. Commissioner Beek stated that he did not under= stand why commercial recreation would haye.t.o be a permitted use on the waterfront. He also stated that social clubs do not have to be located on the waterfront in order to exist. Chairman Haidinger suggested moving commercial recreation to the use permit category II -B. • Commissioner Beek suggested moving yacht clubs to II -A. Commissioner Beek stated that restaurants, hotels and motels do not belong in the other uses category, because these uses do not belong on the waterfront at all. Mr. Burnham reitterated to Commissioner Beek, that according to the FPPC ruling, he would not be able to vote or participate. in this.diseussion. Commissioner Allen stated that she would like for service commercial uses, which include personal service uses, to. be .refined in the zoning and implementation phase. She stated that this would include grocery stores, beauty and barber shops, shoe repair, etc. She stated that these service commercial uses should be included as a designa- tion. instead of hotels, motels and restaurants. Chairman Haidinger stated that the addition of the service commercial uses should be separate from the elimination of 'hotels, motels and. restaurants. Commissioner Allen suggested moving hotels, motels and restaurants to II -C. Furthermore, althoug our residential areas are costly,.anyone who goes to Newport's beaches on a sunny afternoon will agree that because of our tourism, we certainly .c not be ca }led elitist. Therefore, she stated that better services must be encouraged for the existi tourists by permitt.ing'service commercial develop ment before we develop more hotels, motels and restaurants along the waterfront. X Motion was made that hotels, motels and restaurant be moved to II -C; and, service commercial desig- nation to I -B. X Motion was made to bifurcate .the motion as made X X by Commissioner Allen; to consider the issues as X separate, which MOTION CARRIED. Motion was made that hotels, motels and restauran be moved to II -C. Chairman Haidinger stated that he would vote against the motion because the use permit process would give the Commission control on this issue. He stated that he would not want to be locked into absolutely no hotels, motels and restaurants on the bay. X X X Commis.sioner Allen's motion was now voted on, which MOTION CARRIED. The motions on Recreation and Marine Commercial included the following language: "RECREATIONAL AND MARINE COMMERCIAL: It is the intent of this designation to delineate a priority system to guide development approvals on building sites on or near the Bay.
