THE NEWPORT BEACH CITY PLANNING COMMISSION met
in an adjourned session Wednesday, October 13, 1937
• at 7:30 P.M. in the Newport Beach City Council
Chambers. This adjourned meeting is a continuation
of the regular meeting of September 29th as author-
ized by that regular meeting.
Chairman Hopkins presided.
The meeting was called to order by the Chairman.
ROLL CALL: Chairman Hopkins stated that since
this was a special meeting and the last regular
meeting had adjourned to this date, the regular
order of business would be dispensed with if there
was no objection from any of the members of the
Commission.
APPLICATION FOR VARIANCES
Application of George H. McFarland, owner of
Lot 4, Tract 742, Balboa Island for 50% variance
on front line set back and 50% variance on side
line set back was presented to the Commission for
consideration. Secty. Seager stated that the
• notices had been published and notice posted, also
cards sent to the surrounding property owners.
Chairman asked if Mr. IcFarland was present. He
waa. Chairman asked him to come forward and ex-
plain his plan to the Commission, first taking up
the front line variance. P4r. McFarland explained
that he felt justified in asking for this variance
because the house on the 4th lot from his was
built out to the sidewalk and there was one other
house built to the 5 ft line. Chairman asked if
there were any objections from the adjacent pro- .
perty owners.to his building on the 5ft line.
He said that that there were none.
Commissioner Briggs moved that the 50% front
yard variance be granted. Seconded by Schnitker.
T'otion carried.
The 50% side line variance was presented for
consideration.
Mr'. McFarland explained that since the side
yard variance he wanted was on the alley and would
not interfere with the neighboring properties, he
• believed it to be a just request. After examination
of the plat and discussion by the Commission,
Mrs. Williams moved that a 50% side yard variance
be allowed. Seconded by Briggs. Motion carried.
So ordered by the Chairman that these actions
be referred to the City Council as the recommend-
ations of this Commission.
Attention wns called to the 51 rear yard var-
iance shown on the plat submitted by Mr McFarland
and he was advised by the Chairman that this
variance was not included in the above actions.
HEARING ON AMENDMENT TO ORDINANCE 440.
Chairman Hopkins called for the hearing on
the matter of Amendment to Ordinance 440 in
regard to Lido Isle and instructed the secretary
to read the letter from the Lido Isle Community
Association which stated in part:
(Copy) "Vie hereby apply for an amendment to Zoning
Ordinance No. 440 of the City of Newport Beach
with respect to Paragraph (d) Section 5, and the
related exception recited in Paragraph 31 Sub -
Section (a) of Section 10.
This amendment is requested to apply on the
following named cross streets, all located on
Lido Isle, being Tract 907, as shown on Miscellan-
eous Flaps, Book 23, Pages 25 to 36 Incl. Records
of Orange County, Newport Beach, California:
Via Koron, Via Orvieto, Via Remo, Via Viaziers.

Our purpose in requesting the amendment is that
our Restrictions on these lots state in part as
follows: "On these lots or building sites every
structure must either be built up to the property
line on the wide street for the full width of
the lot or else a wall the full width of the lot
must be constructed at least six feet high along
this frontage on the wider street. These walls,
however, need not be solid and. may have doorways,
windows, and ventilating openings as desired when
approved by the Association."
Secretary said that a check had been enclosed
with the letter and that Public Notice had been
published.
Chairman Hopkins called on Mr. P.A.Palmer as
re- presentative of the Community Association to
explain further to the Commission the situation
on Lido Isle. Mr. Palmer said that the letter
was self- explanitory, but that he would be glad
to answer questions.
Hopkins: What are the size of the lots?
Palmer: The largest are 551 with depth of 88t,
however, most of them are 351 fronting on a 40f
sheet with 41 sidewalks.
Mr. Palmer stated that the present requirements
tions which run for 45 yrs. or to January 1st,
1973, with renewals in successive periods of 207rs.

• Chairman Hopkins stated that if there was no
further discussion, this would be considered the
first hearing on this matter.
HEARING ON REVERSION TO ACREAGE
Secretary Seager read a letter from Newport
Harbor Corporation submitting 2 maps showing the
property of this Corporation and requesting the
approval of the Planning Commission to revert the
property to acreage, in order to vacate the pre-
sent alleyway. This acreage to be known as
Tract 1007.
Mr. John Siegel, assistant City Engineer,
representing Mr. Patterson, brought the maps be-
fore the Commission and asked that the Commission
recommend to the City Council that the reversion
to acreage be approved.
Hopkins inquired why this matter was presented
to the Commission.
Siegel stated that they wanted the Planning
Commission as an advisory Committee to recommend
• such action to the City Council, that the owners
were anxious to have the property revert . to
acreage to obtain a tract of sufficient size to
erect a large building. Sampson referred to
Section 9, Chapter 670, Page 4, of Assembly Bill
776, as authority for bringing such a matter be-
fore the Commission and stated that at the present
time tentative approval could be given the sub-
divider.
Hopkins: You have heard the discussion, have you
any suggestions as to how vie may advise the sub
divider?
Briggs moved to give tentative approval of the
plan with the provision that a 15ft alley be put
through from Fernando St. to Bay View, running
east and west. Seconded by Schnitker. Motion
carried. Chairman ordered that this recommendation
be forwarded to the City Council.
MEETING DATE
Hopkins stated that Mr. Sampson had informed
• him that Mr. Tilton could attend the Planning
Co_mission meeting if.it were held on Thursday.
Briggs moved to set Thursday, October 28, 1937 as
the date of the next regular meeting. Seconded
by Seager: Motion carried.
SUBDIVISION .
The matter of how to protect the City from
errors in subdivision in areas adjacent to the
• city was brought up by Mr. Sampson. He suggested
that a boundry map be prepared with the advise of
the City Engineer, setting the boundries 3 miles
outside of but parallel to the present City
Boundries, have maps printed and sent to the
Santa Ana Planning Commission showing boundries.
Hopkins asked if it would be wise to take any
action on this,suggested a committee might be
appointed to formulate a recommendation to the
City Council.
Seeger moved that the Chairman appoint a commit-
tee of 3 to confer with the City Engineer and
make records of a map with a 3 mile limit to place
before the City Council. Seconded by Schnitker.
Motion carried.
Hopkins stated that this is the first step in
Community Planning and if it is going to cost
anything let us get our moneys worth.

0018MUICATIONS
Secretary read a letter from Yr. David. B. Heyler,
calling attention to the fact that the property
adjoining his at 805 No. Bay Front, Balboa Island,
had been leased to a party who is contemplating
operating a Boys' Camp and asking information as
to the best method of protecting his property
rights. Hopkins suggested that the Secretary confer
with Attny. Thompson as to the legality of operat-
ing such a camp and answering Mr. Heyler's letter
giving him Mr. Thompson's opinion.
ADJOURNMENT
It was moved by Briggs and seconded by Schnitker
that the meeting stand adjourned. Motion carried.
