MINUTES OF THE PLANNING CCMMISSION MEETING, THURSDAY, OCTOBER 15, 1953
COUNCIL CHAMBERS. CITY HALL, 8:00 PM
' The Chairmen called the meeting to order, the following members were:
PRESENT: Lind, Longmoor, Reed, Rudd, Smith, Wightman, Hayton ROLL
ABSENTS Smith (Com. Rudd entered the meeting at 8:05) CALL
MINUTES% Upon motion of Com. Copelin, seconded by Com. Reed, and carried,
the minutes of the last regular meeting of September 17, 1953 Were approved
as submitted to the 8ommission. MINUTES
VARIANCES:
#112 Being an application of William J. O'Keefe to extend a 2nd floor V -0112
porch deck With railing and roof a distance of 2 feet into the Wm.
5' front yard setback of Lot 5, Tract 1026, Which is Southerly O'Keefe
of Ocean Blvd. at Jasmine Ave., and fronts on the private road GRANTED
known as Lot A. and also faces Corona del Mar State Park Beach.
Com. Hayton stated that after investigation, it would not adversely
affect the adjacent properties, and that he felt it should be
granted. Con. Copelin moved that the hearing be closed, seconded
by Com. Wightman and carried.
Com. Copelin moved, seconded by Com. Lind that the variance be -
granted, and carried by the following roll can vote, to -wit:

#113 Application of Zelpha T. Roberts and the remaining property V4113
owners in Mock 435 to change the existing 40' frontyard setback
facing the Rivo Alto Canal to a 20' frontyard setback along the Zelpha
entire Block 435 comprising Lots 1, 2, 39 4, & 5 in the Canal T.
Section. Com. Copelin reported that a 30' setback would be more Roberts
consistent with the existing and previously allowed setbacks. GRANTED
Letter from J. T. & Helen K. Jones stating they had no objections
to granting of Variance #1130 Wm. M. Hughes, 3505 Finley, next
door neighbor, and also Mrs. Roberts, both agreed on 301 setback.
Com. Copelin moved that the hearing be closed, seconded by Con.
Reed and carried.
It was moved by Com. Rudd, seconded by Com. Wightman that the
variance be granted with a 30' frontyard setback, and carried by
the following vote, to -wits

#95 2nd hearing for the purpose of final consideration of M. E.
plans for the motel use permit application of M. E. Kirkwood
Kirkwood granted at the public hearing of Sept. 17, 1953, and
set over for this 2nd hearing. GR.VITED

It was moved by Com. Wightman, 2nd by Com. Copelin, and
carried, that the hearing be closed. Com. Copelin moved that
the application be granted incorporating the six conditions
stated at first hearing, plus the following two conditions
7. Flood lighted sign with lighting directed so as not to cause
annoyance to surrounding properties. No neon or flasher
signs will be used.

8. Roof covering will not be white or of reflecting
surface to cause annoyance to surrounding property.
The motion was seconded by Com. Reed and carried by the
following vote, to-wit-

#85 Application for renewal of Use Permit #84 by the South
Coast Co. to permit use of property between the P. E.
USE PERMIT #85 tracks and Newport Blvd. and between 23rd and 26th Streets
for the purpose of storing lumber. Leo J. Benzini, Vice

#97 Application of Earl F. Brunk to operate a woodworking
U. P. #97 shop and light manufacturing at 1501 W. Balboa Blvd.,
further described as Lots 25 & 26, Block 15, Section B.
Earl F. Brunk Newport Beach. Coal. Lind, chairman of investigating
committee, reported the application seemed to be objec-
DENIED tionable for the following reasons:
1. Accumulation of shavings and sawdust creates a fire
hazard.
2. The room indicated as shop is not fire resistent itself.
$. The operation of machinery would cause sufficient
noise to be objectionable to neighborhood.
4. A question of how much fine sawdust would be carried
over the neighborhood.
5. There is no evidence that any neighbors have approved
the use of the room for the shop.-in writing.
The Committee recommended that the application be DENIED.
Mr. Edward T. Healy was present to protest the granting
of this application on same grounds as the committee
reported, also a letter in protest from Mr. & Mrs. W.
Glenn White, of 1420 W. Oc6an Front, Newport Beach. Mr.
Lambert of 1509 W. Balboa Blvd. also present to protest.
Upon motion of Com. Copelin, seconded by Com. Reed, and
carried, the hearing was closed.
Cam. Lind moved that the application be denied, seoonded.by
Com. Rudd, and carried by the following vote, to -wits

' #98 Application of G. Ernest Walker to operate a trailer
park at 7000 West Coast Highway, further located as
Block 10, Seashore Colony between Highland & Grant.
(West Newport). Chairman Longmoor declared the hearing
U. P. ##98 open. Mr. Walker, applicant, was present to answer any U.F. #98
questions. The Committee investigating this application Walker
G. Ernest had no objections. As there were no other protests, the
Walker hearing was closed upon motion of Com. Lind, seconded by
Com. Wightman, and carried. Com. Copelin moved that the
GRANTED application be granted, seconded by Com. Ha$ton, and carried
by the following vote, to -witt

Application of Harry E. Whitman to construct and operate
an Auto and General Repair Garage at 710 -712 Coast Blvd.,
Corona del Mar, further located as Lot 3, Tract 1045.
Chairman Longmoor. declared the hearing open. A letter in
protest was read from Marguerite Streng, another in pro-
test from Margaret M. Scoville, and a letter from Dr. Paul
W. Wise protesting granting of the application. Com.
Copelin moved that the hearing be closed, seconded by Com.
Reed, and carried. Com. Copelin then moved that the appli-
cation be granted, incorporating the following conditionst
1. That all equipment and supplies be kept undercover.
2. That no body and fender work be done.
Motion seconded by Com. Wightman, and carried by the follow-
ing vote, to -wit:
AYES: Lind, Longmoor, Reed, Rudd, Wightman, Briggs,
Copelin
NOES: Heyton.
ABSENT: Smith
#100 Application of Richard W. Loveland to construct and operate
a Laundromat with 8 car parking, at 308 Newport Blvd.,
further located as Lot 3, Tract 3.136 which is three lots
northerly of the intersection of Old County Road and New-
port Blvd. The committee investigating application re-
ported no objections. Chairman Longmoor declared the
hearing open. There were no protests received, so Can.
Copelin moved that the hearing be closed, seconded by Con.
Briggs, and carried. Con. Lind then moved that the appli-
cation be granted, seconded by Uom. Briggs, and carried by
by the following vote, to -wits

#101 Application of Mrs. Hal Harpole to operate a Pets Shop in
addition to her pottery shop at 2620 Newport Blvd., fur-
ther located at Lot 11, Block 224, Section A. Newport
Beach. Chairman Longmoor declared the hearing open. Two

letters were read, neither objecting, from Nick & Mary
Suttora, and from Paul T. Butler and Robert Roubin. Pet
Shop to be limited to caged birds only. Com. Wightman
moved that the hearing be closed, seconded by Com. Copelin
and carried. Com. Rudd made a motion that the application
be granted, seconded by Com. Copelin, and carried by the fol-
lowing vote, to -wit:

#102 Application of Dike, Colegrove, & Koll to construct six tri-
plexes covering Lots 15 to 20 inclusive, Tract 1718, further
located at Haven Place between St. Andrews and Irvine Streets,
Newport Beach. Hearing was closed upon motion of Com. Copelin,
seconded by Com. Wightman, and carried.
U. P. {#102 Com. Copelin moved that the application be granted subject t
Dike, Uolegrove approval of the Building Department as to conformance with the
& Koll Building Code, and to investigation by a Committee of Com.
Lind, L. M. Holbrook, and Com. Copelin, motion seconded by Cam.
GRANTED Wightmen, and carried by the followin8 vote, to -wits

RESOLUTIONS;
#580 lst hearing on Planning Commission Resolution of Intention to
amend Section 9105.4 of Ordinance #635 to add paragraph (g)
RES. #580 which covers setbacks of "R" districts to be used in "C" and
"M" districts when "R" district structures are constructed in
said "C" or "M" districts. Com. Briggs moved that the hearing
be closed, and second hearing set for November 19, 1953, secon-
ded by Com. Lind, and carried.
RES.. #581 #581 The Planning Commission resolved to rezone the Cliff Haven
area and set the first hearing date as November 19, 1953.
OTHER. BUSINESS:
Upon motion of Com. Rudd, seconded by Com. Copelin, and carried,
the following was authorized:
"Permission to build R-1 dwellings only in Unclassified Districts
Permission for of the recently annexed Cliff Haven Area.may be granted b
L. M. Holbrook to L. M. Holbrook, Administrative Assistant to the Planning lom-
grant Use Permits mission, which permission will eliminate the need of a Use
in Cliff Haven Permit for Duch R-1 structures until such time as the area
for R -1 structures is properly and legally coned; these permits to be confirmed
at next regular meeting of the Planning Commission"

INFORMAL BDSINESSs
Mr. Max Pope, representing Dike, Colegrove, & Boll, was Tract ,#1880
present to inquire about Planning Commission's feelings on Dike, Colegrove
their proposed Tract No. 1880. Due to the undetermisied1 & Koll
status of the area in which Tract No. 1880 would be located,
Chairman Longmoor referred them to the bounty. L. M. Holbrook
suggested that the type of street in this Tract be a through one.
COMMUNICATIONSt
Two letters were received from the City Council, one commend- from City
ing the Planning Commission on their 1952 -53 Annual Report, Council,
and their extremely good work; the other stating that the co®nending
Council had concurred with the Planning commission's action on,annual report,
(1) the re- zoning of Irvine Terrace from a "II" district to an &
R-1 district, and (2) rezoning of Gartler property from re- zoning
R-1 to R -3.
REFERRED FROM CITY COUNCILS

Request for Planning Commission approval on request to start
annexation proceedings on the triangular area southerly of Stricker
15th St, known as the " Stricker Annexation". Annexation
Com. Copelin moved that the request be approved, seconded by
Com. Wightman, and carried.
As there was no further business to come before the Commission, Adjournment
a motion was duly made, seconded, and carried for adjournment.
