HomeMy WebLinkAbout10/16/1940OCTOBER 16, 1940 THE NEWPORT BEACH CITY PLANNING COMMISSION met in regular session Wednesday, October 16, 1940, • 7 :30 p.m. in the business office, City Hall; Chairman Johnson presiding. Meeting called to order by the Chairman. ROLL CALL Commissioners present: Johnson, Seager, Allen, Estus, Findlay, Nelson, Williams. Commissioners absent: Hopkins. MINUTES Minutes of meetings held September 18 and 25, 1940 were considered. Com. Estus moved that the minutes of these meetings be accepted as written. Seconded by Com. Findlay. Spearin for a 50% front yard setback variance upon Lot 25, B1k 1, Sec 5, Balboa Island. He stated that plans had been posted, hearing advertis- ed and notice sent to surrounding property owners. Secretary read letters of protest from Carrie F. Eames, J. B. Ruth and Ida B. Ruth, Philip Blumer and Ben W. Utter who also protested for Judge Thomas Gould. The commission examined the plans of the pro- posed building and discussed the setbacks of con - tiguous properties. Com. Patterson consulted the district map and stated that a 9 ft. setback had been established for the lot in question. Com. Estus moved the adoption of Resolution No. 178 recommending that a 1 ft., 10% variance and reduction in front yard requirements be ; granted to Sid J. Spearin on Lot 25, Blk 1, Sec 5, Balboa Island and that the same be transmitted to the City Council by the Secretary as the recommenda- tion of this commission and a copy filed as part of the minutes of this meeting. Seconded by Com. Findlay. Roll Call: Ayes: Johnson, Seager, Allen, Estus, Findlay, Nelson, Patterson, Williams. Noes: None. Motion carried and so ordered by the Chairman. Application of Frank J. Veith for Variance Secretary read the application of Frank J. Veith for a 100% side yard setback variance on Lot 32, Blk 24, Newport Beach Tract, to allow • construction of a garage. Secretary stated that plans had been posted, hearing advertised and notices sent to surrounding property owners. No verbal or written protests were received. Plans were examined and discussed by the Commission. It was noted that Mr. Veith desires to set the garage back to the property line in order to allow him room enough to enter the garage. The alley being very narrow at this point. Com. Patterson moved the adoption of Resolution No. 179 recommending that a 100,% side yard setback variance be granted to Frank J. Veith on Lot 32, Blk 24, Newport Beach Tract and that the same be transmitted to the City Council by the Secretary as the recommendation of this commission and a copy filed as part of the minutes of this meeting. Seconded by Com. Estus. Roll Call Ayes: Johnson, Seeger, Allen, Estus, Findla; Nelson, Patterson, Williams. . Noes: None. Motion carried and so ordered by the Chairman. DISCUSSION OF DISTRICT MAPS The district map of Corona del Mar was dis- cussed. Com. Patterson said he had received a suggestion to change the zone in that district west of Marguerite and south of Sea View to R -1. Com. Patterson moved that the zone be changed from R -2 to R -1 on property south of Sea View and between Goldenrod Ave. and Marguerite Ave. with the understanding that the existing property with Improvements on the rear and where it was the in- tention of the original owner to construct an addition on the front portion of the lot that they be permitted to do so. Seconded by Com. Allen. Motion carried. Another change suggested by Com. Patterson was In the district along Central Ave. between • Alvarado and the first alley east of "G" St. be changed from C -1 to R -3• Com. Allen moved that the zoning be changed on the district map from C -1 to R -3 on that pro- perty along Central Ave. between Alvarado and the first alley easterly of "G" St. 9 • Seconded by Com. Patterson. Motion carried. Com. Patterson said he had to R -2 along Ocean Front west the decision of the commission left R -3. changed the zoning I of 15th St. It was that it should be DISCUSSION OF TENTATIVE DRAFT OF NEW ORDINANCE Com. Patterson read the draft of the new or- dinance as returned from the City Attorney's office and each paragraph was discussed. Com. Estus moved that the City Attorney be requested to word the paragraph legally having to do with allowing an overhang of 50% of the setback on alleys. Seconded by Com. Patterson., Motion carried. Com. Patterson moved that the paragraph refer- ring to allowing buildings closer than 5 ft. from the center of the alley be stricken out. Seconded by Com. Nelson. Motion carried. There was considerable discussion on area requirements per family in R -3 and C -1 districts. Com. Estus moved that the area requirement per family be changed from 600 sq. ft. to 500 sq. ft. in the R -3 zone. Motion lost for lack of a second. Com. Findlay moved that the area requirement be reduced from 600'sq. ft. to 500 sq. ft. per family in C -1 zones in order to rectify conditions on Balboa Island as well as other sections. Roll Call: Ayes: Estus, Findlay, Nelson. Noes: Johnson, Seager, Allen, Patterson. Com. Williams - no vote. Motion lost. Section 12 having to do with re- buildi q non- conforming uses was discussed at length. Com. Patterson moved that this be worded so as to allow reconstruction from loss by fire, earth quake, etc, up to 100% of the city's assessed valuation on such property during the fiscal year in which such damage occurs. Seconded by Com. Allen. Motion carried. The matter of having copies of the proposed ordinance prepared for public inspection was discussed. Com. Patterson moved that the Secretary be instructed to cause 100 copies of the proposed ordinance to be mimeographed. Secretary Seager offered an amendment to the motion to the effect that the Secretary request the proper city official to cause same to be done. Seconded by Com. Estus. Motion carried. Com. Patterson moved that the proposed ordinance "establishing districts within the City of Newport .Beach and establishing classifications of land uses and regulating such land uses in such district• s; regulating the height of buildings and open spaces for light and ventilation; adopting a map of said districts; defining the terms used in said ordinance; providing for the adjustment, amendment and enforcement thereof; prescribingpenalties for t1 violation and repealing Ordinance 440 and all ordinances amendatory thereof or supplimentary . thereto and all ordinances or parts of ordinances In conflict therewith" be set for hearing October 30, 1940, 7:30 p.m. in the Council Chambers, City Hall. Seconded by Com. Allen. Motion carried and so ordered by the Chairman. STREET NAMES - Com. Patterson stated that the matter of the street re- naming referred to the City Council at the last meeting had been tabled for further recommendation and that he had received suggestions on certain changes. Com. Patterson moved that the Planning commis- sion recommend to the City Council that Central Avenue from West Jetty to Coast Blvd. and Coast Blvd. to State Highway be named Peninsula Blvd. Seconded by Com. Seager. Motion carried. Com. Patterson moved that Central Avenue from • McFadden Place to State Highway be named Newport Blvd. Seconded by Com. Seager., Motion carried. Com. Patterson moved that the 15 ft. walk south of Tract 518 and easterly of "G" St. to the jetty be called Ocean Front Ave. • Seconded by Com. Nelson. Motion carried. Com. Patterson moved that the previous recommend ation of Cato St. be changed to Cove Street. Seconded by Com. Nelson. Motion carried. ANNUAL REPORT - Secretary reported that the annual report had been prepared and forwarded to the State Planning Board. He submitted a copy for inspection of the commission. Com. Nelson moved that the annual report as prepared by the Secretary be accepted. Seconded by Com. Allen. Motion carried. ADJOURNMENT - On motion of Com.
