HomeMy WebLinkAbout10/17/1946The Newport Beach City Planning %_O'ommissioh held a regular meeting, Thurs- day, October 17, 1946, at 7:30 pm, in the Council Chamber, City Hall, with ' Chairman Allen presiding. Commissioners present: Allen, Ellerbroek, Johnson, Longmoor, Ple&sr,. BOLL CALL and white. Uommissioners absent: Baitz, Cosplin, and Rudd. Commissioner Pleger made the motion for approval of the minutes of the MINUTES meeting of September 19, 1947, seconded by Commissioner Longmoor. Mot- ion carried. ME secretary Ellerbroek read a letter from Be Be Monaco, Me D., requesting COMMUNICATIONS permission to erect offices for the practise of medicine and surgery on Lots 8 and 9, Tract 884, now zoned R -3. Chairmen Allen stated that the whole block would nave to be rezoned, and would require an Amendment to Ordinance No. 525. Dr. Monaco's letter was not accompanied by the re- quired filing fee, and Commissioner Johnson made the motion, seconded by Commissioner Ellerbrosk, that the Secretary be instructed to write to Dr. Monaco, and advise his to take the proper steps for filing this appli- cation. Motion carried. Dr. Monwo, however, was present, so advised verbally, after which he deposited his check with the Secretary. Secretary Ellerbroek also read a letter from V. W. Jenkins, which applied to the 1. Be White. application (before the Commission at this time). The Jenkins property being across the street from White's, for which he, (Jenkins) requested similar setback change. No action. Also presented was a statement in the amount of $193.80, from Mr. Harry Evans Terrell, Planning Consultant, for services in connection with the Corona Del Mar Memorial Park project plans. Commissioner Ellerbroek made the motion, seconded by Commissioner Pleger for approval of the bill, and recommendation for payment by the City Council. Motion carried. Application of W. Q. Cartter, ror rezoniug from E -3 to 0-2, of Lots 16, 18, 20, and 22, Corona Del Mar, tabled from the last meeting for final hearing, was declared, and heard. The secretary read the report of the Committee of Commissioner Boltz, Copelin, Rudd and Bllerbroek,.(appointr ad to check on this property), which recommended the denial of -the appli- catioui the view of the committee and the Commission being that such a change would set a precedent, and at least twenty other similar proper- ties would igmediately request the same change, also, that there is al- ready too much 0-2 zoning of unimproved property in the area. Commiss- ioner Johnson made the motion, seconded by Commissioner Pleger, that the application be denied. Ayes: Commissioners Allen, Ellerbrosk, Johnson, Longmoor, Pleger, and White. Noes. None. Motion carried, and so ordered. PUBLIC BEARINGS ROLL CALL VOTE Application of Be I. White for 50% setback variance for Lot 20, Block_ 133, Lake Tract, also.tabled from the last meeting for final action, was declared and beard. This had been tabled pending a report of Building Inspector Nelson, which he gave, explaining the area, and the problem in this case, that Mr. White had, without permission,- built beyond his set- back line. Motion made by Commissioner Longmoor, seconded by Commission - er Pleger, was that the application be denied. Roth, for conditional permit for the erect - ion. of the Newport Harbor Lutheran Unurch on a portion of Lot a, Tract 919, Newport Heights, was heard. Rev. Roth was present and explained the plane. No protest was heard or received, and Commissioner Longmoor made the motion, seconded by Commissioner Ellerbroek, fot approval dfrthe.; °:::`. application. Ayes: Commissioners A11en,.Elierbroek,.Jobneon, Longmoor, Pleger, and White. Noest None. Motion carried, and so ordered. OLD BUSINESS Committee report on the W. Cloyd Snyder property, (Lot 40, Block A, Tract 673, Corona Del Mar), was given by Commissioner Baltz' written re- port, i.e., the setback line for the entire block should be changed from 10 feet to 5 feet. To which +Ouilding Inspector Belson argued that every similar lot owner in Corona Del Mar.would want the same change. After discussion, Commissioner Johnson made the motion, seconded by Commissioner Ellerbroek that the Secretary advise Mr. Snyder to comply with the present setback requirements; that the garage may be Milt to. the line, but the now" must go back 5 feet. Carried. NEW BUSINESS The Secretary read, a letter from John Sadlier, carrying application from J. H. Russell and Roy H. Brown, for permission for zone change for the old Newport Theater property for factory use, for making fishing equipment (tackle and allied articles). The Commission stated that this would require M -1 zoning _(now zoned 0-2), which would be contrary to City planning for Central Avenue, and recommended that the company, represented by Russell and Brown, change its plans to use an aggregate of 15 horse power. John Wallace, present, representing the company, said that the Board of Directors insisted that they required 30 horse power, and also, that they must have the city's action on the matter within two weeks. Commissioner Johnson stated that he doubted that a change to M -1 would be made for this location. Commissioner Pleger agreed. Mr. H. L. Anderson, of Standard 011 Company, was present and requested . approval for a Marine Station and Dock at 21st Street, on the Smith pro- perty, for Mr. Ray Donald. Discussion brought out that there is already one Marine Dock in this block, and City Ordinances limit undergrouhd storage to 10,000 gallons per block, therefore impossible to consider this request. Mr. Straley was present requesting action on his application of several months ago for setback variances for his Lots 1, 2,. 3, and 4, Block 337, 0anal Section, Newport. He stated that legal requirements bad now been complied with, and the Secretary was instructed to verify this, and if; correct, to advertise for hearing. Mr. and Mrs. Z, E. Claxton presented for informal action and approval, (no application filed) of their apparent violation of setback require- ments-- having built an enclosed porch beyond their property line st J43d Street, and insisting that they had verbal approval from the Build- ing Inspector 3o do so. However, Mr. Nelson said that permission was not given for a covered porch, but for a "stoop ". Chairman Allen stated that there Is no way that the Commission could permit such violation, am- captious cannot Do made, and that the mistake was made in the interpre- tation of the ordinance. 2 6'5 Motion for.adjonrnment was made by Commissioner gllerbroek, seconded by Com- missioner Pleger.
