The Newport Beach City Planning Commission held a regular meeting oa
October 19, 1944, at 7;80 p.m., in the Council Chamber, City Hall, New-
port Beach, California. Commissioner.Johnson presided in the absence
' of Chairman Hopkins, by order of a motion made by Commissioner Isbell,
and seconded by Commissioner Campbell.
ROLL CALL
Commissioners present; Allen, Campbell, Isbell, Johnson, Nelscm, Pat-
terson, and Seeger.
Commissioners absents Balts and Hopkins.
MINUM
Commissioner Patterson moved,,and Commissioner Isbell seconded that the
minutes of the meeting of September 21, 19440 be approved as read. Car-
ried and so ordered.
Secretary Seeger read a communication from City Clerk Frank L. Rlnshart,COMMUNICATIONS
with attached letter from Mr H. H. Benjamin, addressed to the City Covn
oil of Newport Beach, and referred by that body to the City Planning Co-
mmission; and also a letter from Mr. Philip L. Gildred, (a member of the
San Diego Planning Commission) to Mr. Benjamin. These two letters.pres-
anted a suggested plan of opening a new street and milk from the Newport
Pier extending the full length of the Ocean Front to the and of the Pen-
insula.
' Commissioner Isbell moved, Commissioner Nelson seconded, and the motion
carried, that the letters be filed.
Secretary Seeger also read a letter from Mr. Ralph Maskey requesting a
uniform set -back line of 31 for all lots facing the channel; i.e. - Channel
Place, 38th Street, and Marcus Avenue - instead of a variance of from 3+ to
101. Considerable discussion ensued by Commissioners Patterson and Nelson
and Mr. Maskey, after which Commissioner Seeger moved.that the matter be
referred to the Master Plan Committee for careful consideration. The mo-
tion was seconded by Commissioner Patterson and carried.
Other letters read by Secretary Seeger included one from Mr. S. A. Meyer,
of the Newport - Balboa News Times, with attached maps, wherein. Mr. Meyer
stated that he hoped that said maps would serve as an aid in the working
out of a major traffic thorofares of the city. Following a discussion
Commissioner Allen moved and Commissioner Campbell seconded that the mat-
ter be referred to the Master Plan Committee, Carried.
The final official communication was a letter read by Secretary Seeger
from Chairman Hopkins from.Tulare,.California (enroute to..Saoram nto)
which Commissioner Campbell moved and Commissioner Allen seconded be made
a part of the minutes of the meeting. Carried and so ordered.
Secretary Seeger announced this the second and final hearing, as having REARM
been advertised October 12, 1944, in the Newport - Balboa News Times, withAHTHIK-PEASE
copy of said advertisement together with .affidivit being on file, end
that no further communications had been received upon the matter.
Mr. Pease was present for the hearing and stated that he had nothing fur-
ther to add. Commissioner Allen and Commissioner Campbell of the Invest-
igating Committee (appointed by Chairman Hopkins following the first hear-
ing on September 21, 1944 to further investigate the matter) both stated
that they had gone over the property again, personally$ and had verified

that the business has been non- comforming, and that the situation was not men-
tioned by Mr. Pease at the time of zoning —that the lots in question hold a
four room residence, a real estate office, and the rest of the space, make
shift garages. Mr. Peasets explanation again was that he had purchased the I
property as business property in 1989 and did not realize that any change in
zoning.had been made.
After considerable discussion, Mr. Pease requested that his petition be with -
drawn, and accordingly Commissioner Patterson moved, and Commissioner Camp-
bell seconded that the Hearing be closed. Motion.carried and so ordered.
OTHER Mr. R. G. Blake (petitioning for a proposed museum in Corona Del Mar) again
BUSINESS presented himself, but his plans and application had been laid on the table
at the last meeting of the.Commission, pending the appointment of an Archi-
tectural Committee, which as yet had.not been made, hence Commissioner Allen
moved and Commissioner Patterson seconded that the Secretary advise Mr. Blake
at the earliest possible moment of the completion of the appointment of the
Architectural Committee. Motion carried.
Secretary Seeger, upon finding that all business had been taken care of, hand-
ed Chairman Pro -tam Johnson a letter to read, which was addressed to the New-
port Beach City Planning Commission and signed by Commissioner..Seager, stated,
"I present herewith my resignation as Secretary of the Newport Beach.City Plan-
ning Commission, effective this date." (October 19, 1944) Commissioner Seeger .
moved the resignation be accepted, with the explanation that he felt that he
had done the job long enough, and that present conditions, etc., were, making
his personal enterprise an increasing problem and making it impossible to.find
the necessary time to devote to the secretarial duties, adding that his resig-
nation dial not mean a resignation from the Commission. Commissioner Patterson
seconded the motion.made by Commissioner Seeger, with instructions that "with
keen regrets" be added.
ROLL CALL ATM: Allen, Nelson, Patterson., and Seeger.
VOTE NOES: Campbell, and Johnson. (Commissioner Isbell left the meeting prior to
the motiott, and so did not vote.)
Motion carried and so ordered.
Commissioner Patterson moved that Commissioner Johnson be elected Secretary,
however Commissioner Johnson immediately declined the nomination, explaining
that his health would not permit his doing the work, and suggested that.the'.
election of a Secretary be postponed to the next meeting on November 16, 19440
when Chairman Hopkins could be present to have a voice in the selection, as it
will be.he with whom the Secretary works most closely. Commissioner Allen so
moved and Commissioner Campbell seconded, and the motion carried.
ADJOMiN Commissioner Campbell moved and Commissioner Patterson seconded thst the meet -
ing be adjourned to the next regular meeting set for November 16, 1944. Car-
ried and so ordered.
