O'Brien, Rudd Commissioners Absent: Clark, Marshall MINUTES Minutes of the regular meeting on August 17, 1961, adjourned meeting September 7, 1961, regular meeting September 21, 1961 and adjourned meeting October 5, 1961 were approved on the motion of Commissioner Higbia, seconded by Commissioner O'Brien, and carried. AMENDMENTS A -120 Planning Commission Amendment No. 120 which proposes to amend District Map No. 1 in order to establish 5' set - CONTINUED backs on the southwesterly side of Prospect Street, UNTIL Tract 772, on the following lots, located between 305 NOV. 2,1961 and 491 Prospect Street, Newport Beach, Calif., Lot L Block 25 Lots H, J and K Block 24 Lots R, S and T Block 15 Lots V and W Block 16 . Second x NOT, 2 All Ayes REVISED FINAL MAP The revised final map of Tract 4225 being a subdivision Tract 4225 of 15.8 plus acres divided into 10 lots, proposed to be for commercial use, located south of Westcliff Drive between Irvine Avenue and Dover Drive and on the westerl side of Dover Drive between Westcliff Drive and 16th Street, was recommended to the City Council for approval subject to the conditions stipulated when the final map was considered by the Planning Commission on October 5, 1961, which are hereby incorporated by reference and made a part hereof as though set forth in full, with the exception of condition No. 5, which has been changed as follows: Motion x Second x 5. All Ayes ADDITIONAL B SINESS The Commission considered an appeal from a decision of 1. the Building Department, filed by George R. Wiseman in behalf of his client Mrs. Harry J. March, who had been denied a building permit at 604 West Bay Avenue, Balboa, on the grounds that the plan apparently was designed as a housekeeping unit on the second floor with a separate bachelor unit on the first floor, making a total of two units on this R -1 zoned property. I The Planning Commission, after reviewing the plans and hearing testimony at the meeting, overruled the decisio of the Building Department with the condition that the owner sign a statement, to be prepared by the City Attorney's office and to be recorded, covenanting and Motion agreeing that the unit on this lot will be retained as Second a single family residence.
