Discussion followed on compliance with and adver-
tisement for exceeding the height limitation since
application was filed and staff report written
prior to adoption of ordinance.
Chairman Glass stated that in line with the State's
Environmental Impact Report requirements that a
continuance would be necessary in this case until
such report is received, reviewed by the staff,
and presented to the Commission for action.
The Chairman opened the Public Hearing.
Larry Moore, Associate Planning Administrator of
the Irvine Company, appeared before the Planning
Commission and discussion followed as to the neces-
sity,of requiring an Environmental Impact Report
before request could be acted upon. Mr. Moore
requested that this request be continued to
November 16, 1972 so that all the applications on t
e
subject property could be processed at one time.
Chairman Glass instructed the staff to recheck the
height question.
Charles E. Griffin, 208 Opal Avenue, Balboa Island
appeared before the Planning Commission stating
that location of club across the street from
present site would be more advantageous for access
to ocean and for view from Promontory Point.
Chairman Glass closed the Public Hearing.

Chairman Glass reviewed the application and staff
report with the Planning Commission.
Community Development Director Hogan stated that
no Environmental Impact Report is;required since
request is consistent with the area and has no
significant effect on the environment.
Robert Bein of Raub, Bein, Frost & Assoc. repre-
senting the Applicant, appeared before the
Planning Commission and stated they concurred with
the conditions of the staff report.

Following discussion, the Planning Commission
approved Resubdivision Application No. 365 subject
to the following conditions:
1. That a parcel map be filed.
2. That the applicable conditions of approval
applied to the Tentative Map of Tract No.
7382 be completed (i.e., street trees, etc.).
3. That the public improvements required along the
Jamboree Road side of the parcel be constructed
at the same time as all the remaining improve-
ments along the northwesterly side of Jamboree
Road from MacArthur Boulevard to the North
Bristol Street frontage raod are completed.
4. That a P.C.C. sidewalk with a minimum width of
six feet be constructed immediately behind the
curb along the Dove Street and Bowsprit Drive
frontages.
5. That a public utility easement, with a width
approved by the Public Works Department, be
dedicated along the southwesterly side of the
parcel and that vehicular access rights to the

Chairman Glass opened the Public Hearing.
Applicant Dana H. Smith appeared before the Plan -
ning Commission and stated he was in agreement with
the conditions of the staff report and had no ob-
jection to rezoning which would make the property
consistent with its land use.
In response to the Planning Commission, Community
Development Director Hogan stated that it has been
established that commercial area should be reduced
in size to a viable central commercial core for
the general area of Balboa Peninsula although the
General Plan has not in itself been adopted, this
approach policy has been approved: Also, if the
Commission decided to retain this area for commer-
cial purposes than the use permit should be denied
as approval of use permit is tantamount to
approving this area for residential development.
Discussion followed and it.was determined that an
Environmental Impact Report would not be required
since development was consistent with the area and
would have
not a significant environmental impact.
Chairman Glass stated that R -2 zoning in this block
would be consistent with the intent of the General
Plan to minimize commercial area in Central Balboa.

stated that there is an emergency ordinance on
Balboa Island pertaining to the R -2 District,
where the second unit on an R -2 lot shall have a.
maximum floor area of 800 square feet. The two
units proposed exceed the 800 square feet limita-
tion, being 1,115 and 1,120 square feet, but are
located in the C -1 District.
Chairman Glass opened.the Public Hearing.
Applicant Rolly Pulaski appeared before the
Planning Commission and responded that the square
footage was enclosed liveable area and did not
include decks or entry decks and stated he was
aware that residential was limited to 800 square
feet but did not consider it since his request
was in a C -1 Zone. Mr. Pulaski also stated that
he was in agreement with conditions of the staff.
Charles E. Griffin, 208 Opal Avenue, Balboa Island,
appeared before the Planning Commission and ques-
tioned the Commission as to parking requirements.
Chairman Glass closed the Public Hearing.
A discussion followed as to increase in residential
density and parking problems when there are two
bedroom units rather than one bedroom units.
Chairman Glass stated that another alternative for
decreasing density would be the limitation of the

Mr. Moore stated that a report on 90 acres (this

the Planning Commission and defended the number
and sizes of signs on his property.
Planning Commission discussed Applicant's lack of
compliance with the conditions of use permit,
right of appeal if requested extension were denied,
litigation proceedings and cost if appeal were
denied and cessation of operations not done volun-
tarily, and noncompliance with the sign ordinance,
and time involved in obtaining building permits
and in starting construction of new building.

Applicant John E. Donaldson appeared before the
Planning Commission and stated he was in agreement
with staff conditions.
Community Development Director Hogan informed the
Applicant that a soil analysis will be requested.
In response to Chairman Glass, Community Develop-
ment Director Hogan stated that an Environmental
Impact Report would not be necessary on a project
of this small scale.
Planning Commission approved Resubdivision Applica
tion No. 367 subject to the following conditions:
1. That a parcel map be filed.
2. That separate water and sewer, services satis-
factory to the Public Works Department be pro-
vided to each parcel.
3. That all improvements to be constructed in the
street or alley right -of -way be accomplished at
the,subdivider's expense. The proposed work .
shall be shown on standard improvement plans
prepared by a licensed civil engineer and shall
be approved by the Public Works and Parks
Departments.

Chairman Glass reviewed the application and staff
report with the Planning Commission.
Assistant Community Development Director Hewicker
stated that there would be an additional Condition
No. 11 to meet the requirements of the building
officials and Fire Marshal (copies of said condi-
tion given to Commission).
Community Development Director Hogan stated that
an Environmental Impact Report was not required
at this time since proposed development is con-
sistent with the surrounding area and will not
have a substantial impact on the environment;
however, under Condition No. 7 when grading plan,
is submitted for approval by the Commission, a
report can be requested at that time.
Larry Moore, Associate Planning Administrator of
the Irvine Company, appeared before the Planning
Commission and stated they were in agreement with
conditions of staff report including the additional
•
Condition No. 11.
In response to Commission, Mr. Moore stated that
all buildings would be two story and one on a
parcel for a total of 9 buildings with parking for
around 600 automobiles.
Sue Ficker, 110 North 9th Street, Balboa, appeared
before the Planning Commission and stated that the
drainage and sewer system from this area are
channeled into bay and having a detrimental effect.
City Engineer Nolan stated that the major contri-
butors from surface runoff into bay are San Diego
Creek Watershed and Santa Ana Delhi Channel and
the effect of discharge is more significant in
impact on bay than local drains.
Discussion followed on pollution of bay and contri-
buting factors.
City Engineer Nolan stated that a preliminary re-
port in draft form entitled, "Water Quality in
Newport Bay ", has been prepared as a joint effort
involving the Flood Control District, the County
•

Robert Bein,of Raub, Bein, Frost & Associates,
representing the Applicant, appeared before the
Planning Commission and stated that requested infor-
mation on the Environmental Impact Report should
be given to staff next week and they have no objec-

tion to conditions of staff report. Mr. Bein
stated that it was necessary for them to record
this map to meet requirements of escrow and complet
agreements between parties.
In response to Mr. Bein, Assistant Community
Development Director Hewicker stated that zone is
P -C, not Unclassified as shown on staff report.
Lowell Martindale, an attorney with O'Melveny and
Myers representing the Applicant, appeared before
the Planning Commission and stated that much time
had been spent on this project involving the basic
transaction, the loan funding, the agreement re-
garding the dedication of streets, agreements re-
garding the separation of parcels on the tax rolls,
agreements as to title - -all structured prior to
the Mammoth case. He further stated the project
has gone through the zone change, the tentative
map stage, through the closing, is partially funded
and that if the map was acceptable, they would
provide a report to fulfill all requirements of the
Environmental Quality Act.
Community Development Director Hogan stated there

order for them to complete requirements of escrow,
agreements between parties, and to me.et other
commitments. Mr. Konwiser also stated that they
agreed to all the staff's conditions; that a
grading permit would not be required since there
is less than 100 yards of dirt but would agree if
it is added as a condition; and they would satisfy
the Commission and the City than an Environmental
Impact Report would be approved before building
and that a revision to said report is being pre-
pared as requested by staff.
Chairman Glass pointed out that the Commission was
at a disadvantage in that they haven't had a chance
to review the Environmental Impact Report whereas
they had had ample time to review the Collins Radio
report.
Mr. Konwiser responded that the same firm that pre-
pared the Collins Radio Environmental Impact Report
also prepared theirs which is equally complete;
•
in comparison their report is simpler because they
are redeveloping and not developing, amount of
dirt to be moved is neglible, and it is a fully
improved site. Mr. Konwiser also added that the
report covers in great detail traffic and require-
ments as outlined in the guidelines approved by
the City Council which are being enlarged upon as
directed by the staff.
Chairman Glass stated that much of the Collins
Radio report were reprints of information previ-
ously submitted and familiar to the Commission and
asked Mr. Konwiser if part of their report was
taken from original presentation on scope and
analysis of this project at former. Planning
Commission meetings.
Mr. Konwiser answered that the report would include
soils report, testimony from 4 public hearings,
and relatively the same information already pre-
sented.
Ms. Sue Ficker of Balboa appeared before the Planni

Harry Merrill of the Donald L. Bren Company
appeared before the Planning Commission and
answered questions relative to the school districts.
He further stated that the addendum to the Environ-
mental Impact Report only covers expansion of the
details on the erosion control plan for the site
presently covered on the grading plan being re-
viewed by the Public Works Department and also
additional data on slope landscaping and tech-
niques used by Ultrasystems, Inc. who prepared the
report.
Following discussion the Planning Commission
approved Final Map Tract 7845 subject to the
following conditions:
1. That all of the conditions of the Tentative
Map be fulfilled.
2. That a waiver from the residential street stan-
dards of sixty feet of right -of -way with forty
feet of paved surface be granted; and fifty -six
feet of right -of -way and thirty -six feet of
paved surface be approved for Port Carlisle
Place and Port Lerwick Place, and fifty -two
