ROLL CALL: Commissioners present: Hayton, Rudd, Smith,- Keehq,::Longmoor Commissioners absent: Reed, Lind, Copelin, Briggs MINUTE'S: Minutes of the meeting on September 15th were approved on motion of Com. Rudd, seconded by Com. Hayton, and carried. Application of Mr. A. J. Looney of 419 Westminster Ave. to permit'side Variance setbacks of 3 feet and 1 foot in place of the required 4 foot setback. The property is located in a block that is partially zoned 0-1 and R�2, #248 the legal is shown to be Block 8, Tract 27, Lot 24. NOTTS: The existing dwellings on this site are in non - conformity as to set - Looney, A. J. backs (sideyard). The property is located in the C =1 district of this com- bined (C -19 R-2) block. The building site is now being used for residential Lot 24, Blk. 8, purposes, and the owner proposes the conversion of the rear garage into Tract #27.' additional sleeping accomodations. The present renters would thus be re- quired to use the existing garage on the Westminster # of the site. Addi- tional garage area is also proposed on this one -half of the property, which GRANTED shall be a two car structure, joined to the present front poach. FINDINGS: There was no opposition presented, and the applicant mentioned developing the property in accord with the surrounding neighborhood. The Committee reported no objections on their part to granting the variance as stated. Commissioner Keene moved that the Commission recommend the Granting of this application, seconded by Commissioner Smith, and carried by the following roll call vote, to -wit: ALL AYES Application of Mr. J. R. Longley, of 720 Narcissus Ave. and further. V - #249 located at the corner of Driftwood and Morning Canyon Road, Corona del Mar, to permit an exception of 10' in place of the required setback of Longley, J.R. 25' feet along Driftwood Road. NOTES: Shorecliff Tract restriction of August, 1946 establishes Mornin . Canyon Road as the front boundary for this particular Lot 1 (section 14fa). As such the required SW yard would be 6t rather than 5' as shown by the GRANTED applicantts sketch. S -ction 9104.11 (c) requires reverse frontage set- backs for the rear's of the lot and not merely 201 as set fort by the applicant. FINDINGS: A point was made of the lack of rear-yard restrictions within the Shorecliff covenants or tract restrictions. Com. Hayton mentioned the unduly harsh penalties imposed when an owner of a corner lot wishes to build in Shorecliffs and the severest of restrictions are complied with. It was shown that a severe difference of opinion developed when the sub- divider and the City Planning ConsUtant drew up their maps for this corner lot; the tract restricted 15' on Driftwood and the City of Newport Beach restricted 251. To relieve .a condition considered of a hardship nature in the minds of the Commission, the request stipulated the side setback along Driftwood Drive was to remain in accord with Shorecliff restrictions, namely 151, for the front half of the lot. The rear half shall have a setback along Driftwood Drive of 251. It was felt the hardship involved consisted of too severe setback restrictions in relation to requirements of neighboring home builders. Com. Hayton moved that the Commission recommend the Granting of this appli- cation, seconded b. Com. Smith and carried by the following Poll call vote, to -wit: AYES: Hayton, Rudd, Smith NOES: Keene, Longmoor i 175 N ' F' Application of t;r. H. F. Kenny, 807 East Bay Ave., Balboa, Lot 3, ' Blk. 11, and located in a C -1 Zone to approve of plans as originally V - #250 filed in 1950. Mr. Kenny proposes the use of this site for residential purposes only. Three units are designed for this development. Kenny, H. F. NOTES: The work on this site has progressed at a very slow pace since the permit had been issued in 1950. Were permission granted to continue witi1 plans as originally constituted, the applicant would have to secure Lot 3, Blk.l] a variance for proposed zero setbacks, permission to allow a 7' vacant Tr. #884 area between buildings, rather than 101, and agreement to violate the 1,000 square foot of land. Parking proposed would be tandem. At present there are two units on the rear portion of the property, which are to be dismantled. Granted FINDINGS: Commissioner Smith mentioned the inability of the applicant to proceed with his work in a more rapid manner since he chose to do all the constrruction by himself. It weds found that the work proceeded con- tinuously , at a very slow pace, since 1950, when the original permit was issued. Inasmuch as the work was of a continuous nature and not under the present ordinance #685, Commissioner Smith moved that the work be permitted to progress as scheduled, and original permitted. Commissioner, Smith moved that the Commission recommend Granting this application, seconded by, Com. Hayton, and carried by the following roll call vote, to -wit: ALL AYES Application of Mr. Frank J. O'Connor, of 1700 Kings Road, for permission to waive certain off-street parking requirements for his proposed "Post V- #251 Office Building ", at 100 to 191 Riverside Ave., Newport Beach, Tract #919, on a portion of Lot 'F' O'Connor, NOTES: The Commission is in recent receipt of correspondence with out Frank J. zoning consultant Mr. Wise, which states that Post Offices are properly classified under the retail stores category. This would necessitate one Lot F, parking space for each 200 sq. feet of building construction. The appli- Tr. #919 cant is supplying 60 off - street parking spaces, which is somewhat shy of the required number for the complete development. It has also been re- quested that the Commission interpret a 'Post Office' as an office building which should require one space for each 500 sq. feet of construction. FINDINGS: Applicant submitted a plot plan of property showing location of Granted the proposed new post office building, and planned off - street parking with facilities, for use of customers and employees. The Commission submitted conditions this problem of off-street parking seriring`.post offices to the Planning Consultant for recommendation. h1r. Wise transmitted a letter, a copy , of which is attached. The Commission felt that the provisions for off - street parking as shown on the plot plan, were not adequate for the useful needs of the Post Office operations. Com. Smith made a motion, which was seconded by Cam. .Hayton, that certaih conditions and requirements be imposed for off- street parking for the post office operation, as follows: 1. The Post office customer off- street parking area be located adjacent to the side of the post office building and adjacent to the front property line on Riverside Ave. with access to the parking area from Riverside Ave. 2. The post office customer parking be based on the requirements ' specified in Code 19102.21(A -2) for retail stores, 4nd that the parking area be computed on the basis of a minimum of 250 sq. feet per car, including access driveways. 3. One pa#irig space be provided for each 2 post office employees. These parking spaces may be located on the rear portion of property adjacent to the post office, N ' F' IM Com. Smith moved that the commission recommend the granting of this application in accord with the specifications mentioned, seconded by Com. Rudd, and carried by the following roll call vote, to -wit: ALL AYES Application of the Macco Corp. P. 0. Box 442, Delboa Island, to permit V - #252 a change in the front yard setback of a corner lot from the present established 8? to 5'6" on Bonnie.Boone Terrace, located at the Irvine Macco Corp. Terrace Tract Development, 729 Santana Drive, Lot 86, Tract #1700. NOTES: These setbacks have been previously established by tariance, Lot 86, Tr. #1700 and the applicant etas seen fit to amend his previous request. FINDINGS:b1r. Moore , the previous owner of this building site, sold the land with the assumption that setbacks existing on. similar lots a bloc4 away would prevail. It felt it might be regarded as mis- repre- Granted sentation on his part were the Commission to deny this application. There was no opposition present and Commissioner Hayton moved that the Vommission recommend the Granting of this request, seconded by Com. Rudd, and carried by the following roll ca-11 vote, to -wit: (continued from Application of the Kelso - Munsey Corp. for the waiver of certain off- street Sept. 15th parking requirements for a proposed office and store building. The meeting.) building will be located in the Lido Isle Shopping Center at 3424 via V - #247 Oporto on Lots 22, 23, 24, in Tract #1622, and on a 0-1 -H Parcel of land. Kelso- Munsey NOTES: The normal requirements for this development as zoned, would be 20* parking spaces, the land area available will provide room for 16. Lots 22,23,24, The applicant feels the pooling of all available parking area as provided Tr. #1622 by all the houses of business would quite possibly be adequate for this shopping district. Granted FINDINGS: The proposed four shops; thouggh small, would be desirable and it is felt would improve the area. It is impossible to provide very much more area to the parking lot and have a great deal of building left. There was no opposition evidenced. Com. Rudd moved that the Commission recommend Granting of this appli- cation, seconded by Com. Smith, and carried by the following roll call vote, to -wit: ALL AYES Application of Ruth K. Davis to resubdivide a parcel of land consisting Resubdivision of Lots 7 & 8, and tidelands adjoining, of Block 49, in the River #20 Section. NOTES: It is desired to split the parcel as described into four building Davis, Ruth K. sites, by the division of the westerly °line into 109' and.:109571'' ' respectively from the northerly point ofthe Soithern Pacific Railroad Lots 7, 8 Right -of -way. The northerly line of the easterly boundary between Blk. 49, Lots 8 & 9 would.be 109' and 111.651 respectively. River Section FINDINGS: It was found that the request for the subdivision.of this land was in fact a continuance of the privileges granted other applicants in Granted this same area. The application was considered in harmony withthe development of these particular parcels of land. t . y� I I r i 177 Application of the Newport Harbor Lutheran Church, of 2501 Cliff Drive, Newport Beach to resubdivide a parcel of land into two building sites. Resub. The division would consist of the lower portion of this hillside #21 property, namely the southerly 100' of that portion of Lot A running 1 for 242.90' approximately parallel to Coast Highway 101 and running at Npt. .Hbr. right angles to that dimension. All in Tract #191. Lutheran NOTES: The sale of this land was completed, and it is the desire of Church the Lutheran Church to comply with this Cities Ordinance #650. FINDINGS: There were no representatives present at the meeting, and the Commission considered it wise to continue this application until 11/17/55 at which time it is hoped to ascertain the true motives continued of both applicant and purchaser. Application of Mr. Charles W. Masters, to permit the construction and operation of 8 single car garages, all but two of these shall be used U.P. #194 for rental purposes. The property is located at 520 Fernleaf Ave. in the Corona del Mar Tract, Blk. 533, Lot 22. Masters, NOTES: Mr. Masters states on his application that the area is in Charles vital need of #arage rental units. The property is located in an W.. R-2 area, but does have C-1 property surrounding it on two sides. A duplex is proposed on the second story. Accessibility would be Lot 22, B1k.531 from either of two alleys adjoining the property lines. C.D.M. Tract FINDINGS: No opposition to the applicant's request was reported. The Commission concurred with the reasoning stated on the appli- Granted cation, namely a scarcity of private rental garages in this area, and Commissioner Rudd moved that the Commission recommend the Granting of this application, seconded by Come Hayton, and carried by the follow- ing roll call vote, to -wit: ' ALL AYES Application of Mr. & Mrs. Paul H. Rodet, 123 East Bay Eve., Balboa to permit a *1 % 10 ' bathroom to be erected on the rear of their H.P. #195, present dwelling. The property is non - conforming and in violation of our side -yard code requirements. Lot 4, Bike it Be Npt. Tract Rodet, Paul H. NOTES: This home is very poorly located on the building site. Lot 4, Blk. 1 There is at present a very bad fire - hazard on the alley portion of E. Npt. Tract this block. It was felt that the bathroom might be more suitably Granted located within thepresent structure. FINDINGS: Hommittee Chairman Smith mentioned in his report, that the Fire Dept. reported a severe hazard was being encountered in this area, and has requested that the application be denied. It was suggested that the applicant seek the cooperation of the Building Dept. in-design- ing a suitable bathroom, on the interior of ..the present structure. Come Keene took note of the fact that possibly this new construction would be the only portion of the block that.would be reasonably fire - proof. He felt the applicant should not be penalized unduly for the crowded conditions crdated by his neighbors. Cam. Rudd moved that the Com- mission recommend granting of this application, seconded by Can. Keene, and carried by the following roll call: vote, to -wi$; ALL AYES ' Application of George H. Thomas for a permit to erect a building and operate a boat sales agency, in connection with a canvas top shop. U.P. #196 The shop will custom build tops for autos and boats; it will also contain a spray booth for the application of water repellents. Thomas, Goo. H. The property is located in Tract 919, a portion of Lot F, and alongside the Bal -Port Motel, as well as a Package Liquor Store, all on the north Granted side of Coast Highway. prtn. Lot F. Tr. #919 prtn. Lot F, Tract #919 IN NOTES: This building site is ih a C -2 -H district, and appears U.P. #196 to have considerable depth for off - street parking. The operation will require the use of a small air compressor to spray water cont. repellents and preservatives. The applicant stated that his business would be in harmony with area as developed. FINDINGS: The big concern of the Commission appeared to be the manner in which the parking area would be planned, and the::. accessibility of that area. It was so stipulated that 17 definite off - street parking spaces shall be provided. One loading space is also required. In accord with these conditions Com. Rudd moved that the Commission recommend granting of this application, seconded by Cog AtonS, and carried by the following roll call vote, to -wit: I ALL Application of Paul C. Jones to permit the operation of a real estate U.P. #197 activity from the business address of 117 - 20th St., Located in a C-1 zone, of the 3rd Add, Newport Beach. Jones, Paul D. NOTES: Mr. Jones is remodeling an old residence for use in his planned operation. He will also provide considerable off - street 117 - 20th St. parking. FINDINGS: The conditions imposed by the Commission was definite Granted off - street parking. There was no opposition in evidence. Com. Rudd moved that the application be granted, seconded by Com. Hayton, and carried by the following roll call vote, to -wi6. ALL AYES �r Application of Mr. Floyd E. Mock, to permit the t rovement and U.P. #198 development of Lots /+ to 12, and portions of 12 to 24, Block 10, Seashore Colony for use as a Trailer Park. The address is 7000 Mock, Floyd E. West Coast Highway. NOTES: Mr. Mock includes a letter with his application, to the Lots 4 - ll, effect that a similar request was made and granted, in 1953. He feels & prtn. 12 - 142 the West Newport Beach area is very suitable for this operation. Block 10, FINDINGS: There was some little discussion about the desirability of Seashore Colony this activity, and some opposition was evidenced by neighbors of interest. Mr. Mock was asked to beautify the development and granted a use permit conditionally. The conditions stipulated by the Commission were: 1. The applicant is to erect a three (3) foot fence in height, two feet from the property line; 2. There is to be a seven foot area from the fence, to be allocated for planting and landscaping. 3. In addition, the applicant was asked to furnish guest parking space able to accomodate 38 guest cars. In accord with the imposed conditions, Com. Keene moved that the Appli- cation be granted, seconded by Com. Rudd, and carried by the following roll call vote, to-wit:, ALL AYES Application of the Irvine Co. and Johnson & Sons, to permit the sale and display of new and used automobiles, at a Pacific Coast Highway U.P. address to be assigned at a later date, and identified as Lots 14 - 17, Tract #2110. (Address 600 Pacific Coast Highway. Irvine NOTES: The applicant mentions a movable temporary office building, Johnson to accomodate their building needs. The property in question is zoned C -1 -H, and is in an area which has been developed in a similar manner.. Lots FINDINGS: Thers::was no opposition:.' evidenced The Ccmmissioli requested that 5 customer off - street parking stalls be maintained. It was also . Tr. agreed to limit the permit to a one year period. In accord with thise imposed conditions, Com. Rudd moved that the application be granted, 179, #199 Co. & & sons 14- 17, #2110 seconded by Com. Smith, and carried by the following roll call vote, Granted for to -wit: 1 yr. ALL AYES Application of Mr. E. J. Conner.to permit the operation of a plumbing repair and contracting business at 3216 Coast Highway, Corona del Mar. Lot 2, Tract #1045. NOTES: There were some facilities left over from the Gilman Bros. U.P. #200 plumbing operation. Mr. Conner would like to operate with some minor alterations. Conner, E. J. FINDINGS: It was found that the previous grant for.this activity to a Mr. Gilman had specific conditions associated with the permit. These Lot. 2, conditions were not complied with, and there was consideration given Tr. #1045 to the move of writing the owner of the property and notifying him that he would have a set limited time alloted him to bring his property into conformity with the City of Newport Beach's Uniform Building Code. Granted 1 The Commission did not wish to impose a hardship on the applicant and yr. agreed to set a one year time limit on the permit. Mr. Conner was also Asked to conform as closely as possible and practical to the code phrase "Business within a building ". Mr. Conner agreed to assume this responsibility. Com. Rudd moved that the Commission recommend the granting of this permit for one year in accord with the conditions agreed upon, seconded by Com. Keene, and carried I' the following roll call vote, to -wit: ALL AYES Time of the Planning Commission meetings were mentioned and it was Meeting time mentioned that a more efficient meeting would possibly result were the change to meetings held at an earlier hour. Com. Rudd moved that the hour of 7:30 P.M. meeting be changed from 8:00 P.M. to 7 :30 P.M., seconded by Com. Hayton and carried. Letters were introduced from Ooms. Copelin and Briggs requesting a leave of absence, and permission was granted unanimously. The business at hand being completed, the meeting was adjourned on motion of Cam. Hayton, seconded by Com.
