Gilbert, Cost Mesa Owners: Same as Applicants Community Development Director Hogan advised that this matter was associated with General Plan Amen ment 77 -3 -A, under Item #2, and if this Site Plan Review was approved, there would be no need to consider General Plan Amendment 77 -3 -A. Assistant Community Development Director Hewicker projected the site plan on the screen and reviewe the requested proposal with the Commission. He also suggested an additional condition should the Site Plan Review be approved which would provide that there be recorded an easement or agreement between the property owners of the four northerly parcels to provide for a common ingress, egress a access to the four duplexes. He reviewed the modifications being requested and answered questi of the Commission relative to the proposal. Dean Gilbert, 2472 Eldon Avenue, Costa Mesa, appl cant, appeared before the Commission in connectic with this matter. He advised of his preference f a residential development because he felt it was more marketable and seemed to be more compatible with the adjacent residential properties. He reviewed the revised site plan and commented on the reasons for the changes. He answered questic of the Commission and concurred with the staff report and recommended conditions. Soren Sunberg, 229 La Jolla Drive, appeared befor the Commission in favor of the proposed site plan and opposed any commercial or motel development c the property. Page 2. There being no others desiring to appear and be heard, the public hearing was closed. The proposed development is consistent with General Plan and will not preclude the attail ment of the General Plan objectives and poli 2. That the proposed project will not have a significant effect on the environment. 3. The proposed development will not adversely affect the benefits of occupancy and use of • existing properties within the area. 4. The proposed development does not adversely affect the public benefits derived from expe tures of public funds for improvements and beautification of street and public faciliti within the area. 5. That the proposed site will be graded and developed with due regard for the aesthetic qualities of the natural terrain. 6. That the proposed development will be compat with surrounding development and with the character of the neighborhood, and is not detrimental to the orderly and harmonious development of its surroundings and of the Ci ty. 7. That a 6 -inch water main be constructed in Newport Boulevard from the existing main in Catalina Drive to the existing main in the alley northerly of Santa Ana Avenue. (Note: The size of this main may be enlarged by the City. If this occurs, the City will pay the developer for the additional material cost for pipe, valves and fittings). 13. That individual water and sewer services be provided to each dwelling unit, and that pressure regulators be installed on the wate services. 14. That all work within the street right -of -way for North Newport Boulevard be done under ar encroachment permit obtained from the California Department of Transportation. 15. That the street and alley improvements; and the storm drain, sewer, and water facilities • be shown on the City's Standard Plan Sheets; and prepared by a licensed Civil Engineer. 16. That the Standard Subdivision Plan checking and inspection fee be paid by the Developer, 17. The developer shall submit the final gradin, and drainage plans for the review and appro, of the Santa Ana Regional Water quality Con' Board. 23. Drought- resistant plant materials which wil blend in with the local setting, will be utilized for landscape planting. The appli cant shall submit a plan for the landscapin, and fence treatment for the frontage along North Newport Boulevard. This plan is subject to the review and approval of the Director of Community Development and the Director of Parks, Beaches and Recreation, and installation of improvement will be in substantial conformance with the approved plan. 24. If any archaeological, paleontological or historic resources are uncovered during grading, work shall be halted and the appropriate authorities consulted in compli ance with the City of Newport Beach Archaeo logical Guidelines. 25. That the structural designs for the propose units be reviewed by a qualified acoustical engineer and design modification incorporat as required to bring interior noise levels to acceptable levels. Compliance with stat noise insulation standards must be demonstr ted at the time of the building permit appl cation. 26. That the development comply with existing state laws which establish energy conservat standards for residential structures. 27. That an easement or agreement be recorded between the property owners of the four northerly parcels to provide for a common ingress, egress and access to the four duplexes. Commissioner Hummel voiced concern with the amou of structures proposed and the lack of side yard between the dwelling units. Commissioner Frederickson accepted the amendment part of his original motion. Commissioner Lynch advised that he could not support the plan presented because of the problen with traffic, noise, safety, access, etc. on Old Newport Boulevard. Commissioner Heather voiced concern with the exte of the lot coverage and preferred a less dense development in this particular location. Commissioner Agee voiced concern with the lack o- open space and the density proposed with this development and although he concurred with the . concept of residential development, felt that a less dense use at this location was preferable. At this point the Planning Commission discussed the possibility of continuing the matter for the purpose of allowing the applicant the opportunit, to redesign the project with two less units in order to reduce the density. They also discusse the findings which must.be made should the proje be denied. The public hearing was re- opened and the Chairma questioned the applicant with respect to the continuance. Dean Gilbert, applicant, appeared before the Commission and advised of his consent to the. continuance. Motion X Planning Commission continued this matter to the All Ayes meeting of November 3, 1977. Douglas Stelle, Applicant, appeared before the Commission in connection with this matter and advised that the property was purchased by him in March of 1973 and at that time the City indic ed the structure was a legal nonconforming build He is now selling the building and the City repo indicates the existence of some Code violations as well as an illegal bedroom. He is, therefore requesting that the City allow him to bring the bedroom and the building up to Code as he felt that course of action would be better than being required to remove the illegal portion of the structure. Mr. Stelle read a letter from the adjoining neighbor, Nick Tavaglione, in favor of the request. With respect to the various reports issued by th City, staff advised that in 1973 the City issued reports based only on information on file in the Building Division as to permits issued for con - struction, with no physical inspection of the • property. The City now inspects the property an reviews the file to verify that any work or construction has been.done under permit and inspected for proper installation. Page 11. Public hearing was opened in connection with this matter. Thomas Morrissey, Director of Industrial Relation Ford Aerospace and Communications Corp., appearec before the Commission and concurred with the staff report and recommendations. He commented on the uses of the various buildings and the parking. Mr Morrissey advised that the modular buildings were under lease until September 30, 1979, and request • that Condition No. 5 be modified to read " ..shal be removed from the site by September 30, 1979, c 90 days after completion of the permanent buildir whichever is later, ...." in order to cover any unexpected delays in construction.or moving into the new building. Keith Cordray, 33 Canyon Island Drive, introduce( Tony Friedenburg, 58 Canyon Island Drive, and advised they were directors of the Sea Pine Community Association recently formed by the condominium development located on the south sid( of Ford Road midway between MacArthur Boulevard and Jamboree Road. He advised of their interest in the project but had no comments until after tl Board of Directors meeting which would be held in approximately three weeks. Mr. Morrissey appeared before the Commission and advised he was not aware of the new association and would contact them, as he had other associat in the area, regarding the proposed development.
