The Newport Beach City Planning Commission held a regular meeting, Thurs-
day, October 21, 1949, with Chairman Longmoor presiding.
ROLL CALL Commissioners present; Baltz, Copelin,. Daniell, Ellerbroek, Johnson, Long -
moor, Pleger, Rudd and Wightman.
Commissioners absent: None.
M,ITTUTES Commissioner Johnson made the motion, seconded by Commissioner Rudd for
the approval of the minutes of the meeting, of September 16, 1948, as
read, which carried, and so ordered.
PUBLIC Hearing upon the application of T•.':r. R. J. Weston for a 50% setback variance
HEARINGS on Bay Avenue, and a 50% setback variance on the alley for the westerly
30 feet of Lots 1 and 2, Block 5, East Newport Tract, was heard, same hav-
ing, been tabled from the last two meetings, pending roly by City Attorney
Charles Dennison, on the matter of lot areas. Chairman Longmoor read Mr.
Dennison s ruling, which stated, in part "The proposed site, (Mr. Weston's)
is a portion of two adjoining delineated parcels of land, which had sep-
arate and distinct designations on a plat recorded in the "£fice of the
Count=* Recorder on the effective date of Ordinance 440 (January 6, 1936).
The dimensions of each of said lots are 70'feet by 30 feet with a total
area fpr the two lots of 4200 square feet. A two - family dwelling has
been erected on the original parcel and the protion with respect towhich
the instant application relates was acquired by Mr. Veston subsequent to
said effective date. The required building site for a two - family dwell -
ing in an R -2 zone at such elevation is 4,000 square feet. However, the
lots being shown of record before the effective date of the ordinance, are
subject only to the provision that the building site be of a minimum area
of 1,000 square feet per family or house - keeping unit"q and, "the two lots
may be put to the same uses under several ownerships as they could be
under a single ownership ", and, ".the fact that the total area upon which
Mr. t;eston proposes to build is only 1,880 square feet prevents him from
building, a two - family dwelling, since the building site rqquired would be
2,000 square feet, but to build a one - family dwelling he need provide a
building site of only 1,000 square feet ". Yr. Weston was present and
again explained his application., Commissioner Johnson stated that he felt
that the variance should not be granted on Bay Avenue. Commissioner Baltz
made the motion for closing the hearing, which Commissioner Ellerbroek
seconded, and which carried. Commissioner Ellerbroek then made the motion
seconded by Commissioner Daniell that the Commission recommend that the
application of Mr. Weston for a 50% setback variance on Bay Avenue, be
denied, and, further recommended that the application for a 50% setback
variance on the alley for the westerly 30 feet of Lots 1 and 2, East New
port Tract, be granted, up to 3 feet of the alley, and that this consti-
tutes a side line shtback, adjacent to the alley. Motion carried by the
following roll cell vote: AYES: Baltz, ilopelin, Daniell, Ellerbroek,
Johnson, Pleger, Rudd and Wightman. NOES: None. ABSENT: None.
Final hearing upon the matter of the proposed amendment to �'rdinance NO.
525, was declared and heard. No communications and /or protests were re-
ceived or heard. Commissioner Johnson read the proposed amendment, re-
lative to off- street parking requirements for R -3 zones. Commissioner
Copelin made the motion, seconded by Commissioner Johsnon, for closing
the hearing, which carried, and Commissioner Johnson then made the motion
seconded by Commissioner Daniell that the Commission recommend that the
City Council amend Ordinance No. 525, as proposed, and as given in the
minutes of the meeting of September 16, 1948. This resolution passed by
the following roll call vote, AYES: Baltz, Copelin, Daniell, Ellerbroek,
Johnson, Longmoor, Pleger, Rudd, Wightman. NOES: None. ABSENT: None.
Hearing upon the application of Mr. H. H. Holbrook for a conditional per-

mit for the use of a portion of the building now built on Lots 22, and 23,
Block 28, Newport Beach Tract (2801 Coast Boulevard ),� for an office for
the plumbing business and for allowing the use of a building to be coast-
, eructed on said lots for'the purpose of operating a plumbing business, was
declared, same having been duly filed and advertised. Secretary Copelin
read Mr' Holbrook's application, and stated that no communications and/or
protests had been received. P+r. Holbrook was present and explained his
application and plans, stating that he has operated a plumbinh business
at that location since 1931, in a building that "I am ashamed of, and
would like to have a better looking building ". Mr. Poutert, owner of the
property west of Per. Holbrook's was present and spoke in favor of granting
the application. Commissioner Johnson, chairman of the committee checking
on this matter, stated "the Commission can not stop Mr. Holbrook from con-
tinuing the business at this location, but, the ordinances 'do not permit
any enlarging, and the Commission should accordingly deny the permit for
the new building. The application should have been made for rezoning, or
Mr. nolbrook should move into the proper zone. The committee recommends
that the applications be denied ". Commissioner Daniell agreed that this
be all that the Commission could recommend, but, 'would personally like'to
see some way to help Mr. Holbrook ". Commissioner Johnson further stated
that "this area is more or less of a business area, and the day will come
when a change -ill have to be made. Suggest that Parr. Holbrook get up a
petition, signed by the property,owrers ". Secretary Copelin pointed out
that the Planning Consultant, newly employed by the City, "may recommend
that this property be rezoned for business, suggest Mr. Holbrook wait for
this ". Commissioner Baltz made the motion, seconded by Commissioner Cope-
lin, for closing the hearing, which carried, and Commissioner Johnson
made the motion, which Commissioner Rudd seconded, that these applications
of Mr. Holbrook be recommended by the Commission for denial, which carried
by the following roll call vote, AYES: Baltz, Copelin, Daniell, Ellerbroek,
Johnson, Longmoor, Pleger, Rudd and Wightman. NOEZ: None. .ABSENT: None.
Hearing upon the application of Dr. R. R. Hansen and Dr. H. A. LeVantine,
for a change of zone classi#ication from R -3 to C -2 for Lots 16, 18, 202
229 Block`732, Corona del ;afar, was declared, same having been duly filed
and advertised. Secretary Copelin read the application and stated that
protests had.been received from the owners of Lots 119 139 15, 17, 19, and
21, which constitutes a 60% of the adjacent properties. Commissioner Pleg-
er made the motion, seconded by Commissioner Johnson that the matter be
set to second hearing for action. Motion carried and so ordered.
Mr. L. C. Bean, contractor, was present, with plans for a twelve unit apart - NEW BUSINESS
ment house on property in Block D, Coron& del Mar, on Carnation Avenue, own-
ed by Mr. J. Roberts, and explained that they were requesting a 50% setback
variance on Carnation Avenue, and have the approval of ?e'r. 'Bayne Bally who
owns the adjacent pnvperty. Mr. Bean was instructed to have Mr. Roberts
file i� he desires 'a setback variance.
Mr. Sam Co]yr, of the Standard Marine Dock, was present, and stated that
he was representing the various marine docks in the harbor, to request
action on the matter of increasing the storage facilities for marine docks.
Chairman Lommnoor explained that this matter was tabled several months ago
pending the employment of a Planning Consultant, and suggested that plans be
submitted and a brief filed on the entire matter, for consideration along
with all other similar matters in the near future.

Walter Han, the new Planning Consultant, with the firm of Hahn and Camp-
bell, presented himself and his associate, Mir. Larry Wise, stating that he
wished to discuss the problems that are of most immediate importance.

Secretary Copelin read "Request of the City Council of Newport Beach to
the Planning Commission for a report on the proposed amendment to Land
Use Districting Plan ", which constitutes a proposed amendment to Ordi-
nance No. 525, relative to off - street parking for C -1 and C -2 areas or ,
zones. Commissioner Johnson made the motion, seconded by Commissioner
Pleger that the Commission initiate a proposed amendment, as outline,
to Ordinance No. 525, and advertise same for hearings, as required. Mo-
tion carried and so ordered.
Commissioner Daniell presented a suggested amendment to Ordinance No.
525, relative to changes in zoning requirements for R -3 zoning, which
Secretary Copelin suggested be submitted to MIr. Hahn, as Planning Con-
sultant.
STANDING
Chairman Longmoor stated that he wished to make his appointment$ of
COMMITTEES
chairmen of the various standing committees for -the 1948 to 1949 year,
APPOINTED
and explained the workings of 'each, and 'expressed his appreciation to
the Commissioners who served during the past year. 9hairman Longmoor's
first appointment was for the reappointment of Commissioners Johnson,
Copelin, and Rudd as the standing committee for the consideration of mat -
ters.,referred by the Orange County Planning Commission, for which Commis-
sioner Daniell made the motion for approval, and Commissioner Wightmail
seconded. motion carried and so ordered. The committee for the- Archi-
tectural Committee of Commissioners Baltz, Pleger, and George Lind, was
also recommended by Chairman Longmoor for reappointment, so Secretary
Copelin made the motion for approval, which was seconded by Commissioner
- dightman, and carried and so ordered. Secretary Copelin however, then
made the motion, seconded by Commissioner Rudd that Commissioner Eller-
broek be included on this committee, which carried and so ordered..
ADJOURNTENT
Commissioner Baltz made the motion for adjournment, which was seconded
by Commissioner Pleger, and carried and so ordered.
