CITY HALL COUNCIL CHAMBERS Chairman Longmoor called the regular meeting of the Planning Cmdesion to order. ROLL CALL: Commissioners present: Longnoor, Reed, Rudd, Keene, Briggs, Bopelin, Lind Commissioners absent: Smith, Hayton MINUTES: Minut4s of the meeting on September 16, 1954 were approved upon motion of Como Reed, seconded by Como Lind, and carried. AMENDMENTS: #9 1st hearing on the application of Weaver H. Smith and Eleanor R. Smith and the owners of Lots #39, 40i 41, 46, 47, and 48 SMITH, in Tract #682 to amend zoning Ord. #635.from an Rrl District to Weaver H. an R-2 District on said lots. Said lots face Waterfront Drive in amend zoning Corona del Mar and are the only lots in a block of property not Lots 39,40, in an R-2 District as shown on District Map #16. 41,46,47,48Com. Reed moved that the hearing be closed and the matter be set Tr. #682 for second hearing November 18th, motion seconded by Can. Rudd, and carried. VARIANCES: (Referred back from City Couucil upon request of the Planning V - #154 Commission due to time limitation allowed by Ord. #635, wherein HALL, Donald more time is needed to properly study the matter and effect a ' solution) Application of Donald Haven Hall to allow commercial work to be set over performed in an R-2 district,, at 418 Marguerite Ave., Corona del Mar. The hearing was declared open. No one was present representing the applicant. The hearing was closed upon motion of Como Reed and set over for further study until the next meeting on November 18th,.motion seconded by Como Lind, and carried. V - #160 (Set over from Sept. 16 1954 meeting due to applicant not being present at that meeting Irwin, Sadie Application of Sadie M. Irwin to erect a three (3) car garage with apartments above in a C -1 District in conformity with a #1 Fire Lot 9, B1k.21, Zone and with a zero setback on the northeasterly side and Npt.Beh Tract a four (4') inch setback along the alley side and the 22nd St. frontage. The applicant desires the garages to be used in Granted connection with her hotel across the alley which is a residential usage and to be constructed as requested for later conversion to a store building. The property is Lot #9, Block 21, Newport Beach Tract. The hearing was declared open. FINDINGS: The property is in a #1 Fire Zone and would require an impractical expense for supporting structure to carry a 2nd story fire wall set in three feet from the property line. There are to be no windows on the northerly wall next to the adjacent lot. The southerly wall being along an alley would allow windows along that side without detriment to anyone. Balboa Island FINDINGS: The proposed stair would offer considerable less obstruc- tion to view of property to the north than the existing non - conforming Granted olive trees and shrubs. CONDITIONS: The setback is limited to the construction of the proposed stair only and not to be construed as permitting any future construction to be placed within the variance area. FINDINGS: The Lids:Isle Association stamped their approval on the applicants plans, and the architectural impact of the-design is very favorable. The Commission feels that the additional overhang will not detract from the neighborhood or be detrimental to surrounding or adjacent property. The hearing was closed upon motion of Cam. Copelin, seconded by Com. Rudd, and carried. Com. Copelin moved that the application be granted, seconded by Com. Rudd, and carried by the following roll call vote, to -wit: ALL AYES Application of C. W. Parkman for a three foot frontyard setback along Grant St, to replace the existing garage now set on a thirty foot (301) setback. Under Ord. #635 the setback required is twenty feet (201) as per district Map #1 on property described as Lot 7, Block I, Seashore.Colony Tract, and located at 104 Grant St., Under the previous Ord. #525, District Map #1 shows the setback as three feet (31). The hearing was declared open. FINDINGS: The setback required by the previous Ord. #525 on said property as described herein is shown as three feet (3') on District Map #1 and was changed under Ord. 0635. Existing construction is consistently set it three feet. The Commission feels that the setback should be three feet as originally allowed. Said setback will not be detrimental to adjacent-or surrounding property and will be greater than that now in use on the property. The hearing was closed upon motion of Com. Sattler for a five foot yard setback on v = #166 De Sola Terrace and Seaward Road, instead of the ten (10) feet required by District Map #20 on De Sola Terrace and fifteen (15) Battler, Robert L.feet on Seaward Road. Said property is described as Lot 110, -Tract #1237, and located on the southwest corner of said De Sola Lot 110, Tr. 1237 Terrace and Seaward Road. The hearing was declared open. DENIED FINDINGS: Original front setbacks were established in conformity with the subdividers plans, and this is the first request for a variance of this kind in Corona Highlands. The lot is large enough to allow a house to be constructed on it in conformity with the existing setbacks and has no difficult contour to prohibit ordinary construction. - The hearing was closed upon motion of Com. Copelin, seconded by Com. Lind, and carried. (The applicant desired the variance before designing his house so he would be better able to design said house and avoid design than ges.) Com. Copelin moved that the application be DENIED, seconded by Com. Lind, and carried by the following roll call vote, to -wit: ALL AYES 103. Application of Eldon & Mary Drschel for a thirty inch (30 ") yard setback along De Sola Terrace and a seven foot (71) setback on De Anza V - #167 ' Drive instead of the required ten feet (101).on both streets as shown on District Map #20 on property described as Lot #87, Unschel, Eldon & Mary Tract #1237, and located on the southeast corner of said De Anza Drive and De Sola Terrace in Corona Highlands Tract. Lot 87, Tr. #1237 ! The hearing was declared open. FINDINGS: The said lot of record is large enough to contain 5' setback on De a house with the existing setbacks. Due to a considerable Sole. Lot #981 would be reduced below its recorded size by its addition to Lot #982, and the remaining portion should also be ruled upon should this subdivisio$ be allowed. The proposed lots are not conforming with the existing code and allowance of the subdivision will not reduce the district use as has been done by previously allowed R-3 lots with an R-1 use requirement. Harper for a frontyard setback of six (6) feet six (6) inches in place of the nine (9) feet required by District Map #14 to allow the addition of a bay window to project 30 inches ihto said nine (9) foot setback for a width of eleven (11) feet, on prOperty.described as.Lot 7, Block 15, Section 1, Balboa Island, and located at 550 S. Bayfront, in an R-2 district. The hearing was declared open. FINDINGS: The proposed addition will be in line with existing houses in said Block 15, facing the South Bayfront. No objections were received by letter or in person. Said proposed addition will allow the applicant a greater use of his property. The hearing was closed upon motion of Com. Copelin,,seconded by Com. Dead restrictions require a 25 foot setback. Previous such applications have been denied, and Mr. Grolds house required to be altered by Resolution #376, February 28, 1949. Five letters of protest and one letter of no objection were received by the Commission. Set over for meeting of November Offices 183 1954 for further study. Being a resolution made to adopt a form for resubdividion of less than 5 lots, and to establish a fee. Set over for meeting of Resolution #588 November 18th by the Administrative Assistant, no time to accomplish the preparation. Being a resolution to raise the fees for Use Permits to $15.00; Variance to $25.00; and Amendment's to $50.00. Set over until Resolution #589 November 18th meeting pending completion of a survey of surrounding and adjacent cities as to their charges for comparison purposes.
