Motion X Motion was made that Planning Commission instruc the staff to prepare a complete background repor for discussion by the Planning Commission on November 4, 1976. The motion was discussed and staff pointed out that no public notices had been given relative V these requests for extension and in view of the concern with these developments in the past as well as the supposition. on the part of the sur- rounding homeowners that the issues were dead, a least for the time being, careful consideration should be given to whatever action the Commissio may take. Commission Balalis commented on the issue and fe . that a public hearing should be held in connecti with the continuances. Commissioner Seely commented on the recent actio by the Commission with respect to changing the Municipal Code to provide for a public hearing i connection with requests for extensions. He als pointed out that the matter could be considered a discussion item at the November 4th meeting an if it was felt at that time that a public hearin was desirable, the matter could then be set for hearing. Commissioner Heather felt that the new Commissio ers should have the opportunity to review the background information prior to any public heari process. Commissioner Seely suggested that the motion be amended to include "and that staff be directed t notify the homeowners association that the matte would be a discussion item on November 4, 1976." Commissioner Frederickson accepted the amendment as a part of his original motion. That the proposed use is consistent with the Land Use Element of the General Plan and is compatible with surrounding land uses. 2. The project will not have.any's.ignificant environmental impact. 3. The Police Department has indicated that the, do not contemplate any problems. 4. The approval of Use Permit No. 1806 will not under the circumstances of this case be detrimental to the health, safety, peace, morals, comfort and general welfare of perso residing and working in the neighborhood or • detrimental or injurious to property or impr vements in the neighborhood or the general welfare of the City. and approve Use Permit No. 1806, subject to the following conditions: 1. That development shall be in substantial conformance with the approved plot plans. 2. Part 2: 76 -3 -B: An amendment to the Land Use • Element, Residential Growth Element,.an Recreation and Open Space Element to revise the open space and paseo system in Harbor View Hills for consistency wi adopted Planned Community development plans. Planning Commission held separate discussions on Parts 1, 3, 4, and 9. The remaining parts were considered to be "housekeeping" items and since no one requested separate discussion on any of t issues, determination as to their disposition wa made in the final motion. He commented on the traffic study presently under way and requested that the mattes be delayed until 1977, pending results of the survey. He commented on the possibility that thl lots in question may be needed for parking and felt that residential development may suffer as result of the adjoining commercial development. George Hauser, 2575 Crestview Drive, owner of th subject property, appeared before the Commission and requested that the matter not be delayed any further but that a decision be made at this time Planning Commission discussed the effects of a delay on this request and the need for either a zone change or use permit in addition to the change in the General Plan. Commissioner Seely commented on the traffic stud, being made as well as the unlikelihood that this particular property Would-solve the parking prob lems in the Corona del Mar area. He felt there should be no further delay, that residential property was more valuable and desirable than commercial property and supported the requested amendment. Hal Pinchin appeared before the Commission to answer questions regarding the requested delay pending results of the survey. He advised that the opportunity.for parking on commercially zoned property was greater than it would be if .the property were changed to residential because of the opposition in the area to parking encroac ments into residential neighborhoods. Also, he felt that the cost to the City or a parking district would be less if it were zoned.commerci Commissioner Balalis commented that it was unfai to the property owner to delay the matter at thi time pending questionable and uncertain future acquisition of the property and that the opportu ity for further review existed because of the • need for a zone change or use permit prior to Motion X development of the property. Commissioner Frederickson commented that the Planning Commission had a great responsibility in the development of the community and at the same time had a responsibility to act as expedi- tiously as possible on various req.uests presentee He felt that the processing of a.traffic study, receipt of the community's input, review by the City, etc., would entail a lengthy period of time and that it would be unfair to penalize the pro- perty owner for what may be a long time program. Assistant City Attorney Coffin pointed out that the determination of basic land use was made at the General Plan level and that future .review would not necessarily allow for reconsideration of • project but rather was more an administrative function to bring the actual land use into con - formance with the General Plan. Ayes X X X X X The motion to approve Part 1 - 76 -3 -A was voted Noes X on and carried. Absent X Part 3 - 76 -3 -C: Commissioner Seely commented o the desirability of including the Lido Peninsula in a Specific Area Plan because of the concern f redevelopment and effects of traffic on the peni sula. He felt that the plan of one area had an impact on the plan of another in terms of traffi parking, circulation, development, etc. and that the cost of developing a Specific Area Plan must be weighed against the adverse effects of delays and piece -meal planning. Planning Commission discussed notification procedures and whether or not sufficient publica tion had been made to include the Lido Peninsula in this request. It was pointed.out that the notification as published was adequate from a legal standpoint. John Shea, 2214 West Oceanfront appeared before the Commission to comment on the development of Specific Area Plans. He felt that the area bein discussed was too large for one plan, that the Page 9. MINUTES or n- c, INOUX COMMISSIONERS s� \City of Newport Beach MINUTES October 21, 1976 MOLL CALL various areas within the proposed district had little in common other than the matter of traffic which could be handled by means other than throuc the Specific Area Plan process, and that smaller Specific Area Plan districts should be establishc He also commented on the length of time it has taken to develop past Specific Area Plans and voiced concern with the length of time it would take to develop a Specific Area Plan for the a.rei in question. He voiced concern with interim . development or redevelopment and the adverse impacts which may be created on existing develop• ment due to delays in the development of a Speci Area Plan. In summary he felt that the size of the area should be reduced, that interim approva' should be very selective, that no.more parking should be given away, and that the City should "hurry" in the development of the Specific Area Plan. • Planning Commission discussed priorities in the development of the various Specific Area Plans throughout the City and the possibility of dividing this particular area into sections for the purpose of zoning. Community Development Director Hogan advised tha the area could be divided into sections, however it was the staff's opinion that the entire area being recommended was interrelated with respect to the main considerations which go into the development of a Specific Area Plan. Motion X Motion was made to adopt Part 3 - General Plan Amendment 76 -3 -C with the following modification that it be adopted with respect only to the Cannery Village /McFadden Square area and the Lid Peninsula. Commissioner Agee advised of his opposition to t motion because he felt the Central Balboa area should be included in the Specific Area Plan are Following discussion and clarification of the issues in question and the areas to be covered, • Commissioner Seely withdrew his motion. The difficulty of the task without further informatic was apparent and since the search for basic data throughout the area was presently under way and results would be available within approximately 60 days, it was suggested that the area be approl as a whole at this time and separated after the basic data was received. Commissioner Heather expressed concern with the notification procedure and felt that the publica• tion was too general and that the affected propel owners were not aware of the changes being consi, ered. Following clarification and assurance that the area could be separated into sections and prior- ities at a later date when more information was available, Commissioner Agee withdrew his motion Following discussion relative to notification of Motion X property owners, motion was made that the Planni Commission recommend to the City Council the adoption of General Plan Amendment 76 -3 -C as recommended in the staff report with the under- standing that the staff would present a progress report within 60 days at which time the area could be further divided and the boundary lines delineated.
