MINUTES - Chairman called for the reading of the minutes of September 219t.
Com, Williams moved that the reading of the minutes of the meeting, held September 21, 1938
be dispensed with, as all mbmbers had received copies thereof, and that they be approved as
written. Seconded by Com. ?Yhitson. Motion carried and so ordered by the Chairman.
HEARINGS -
APC °LIGATION FOR VARIANCE
Application for 50; front yard variance of Arthur M. and Helen M. Johnson, owners of
Lot 18, Blk 1, $action 5, Balboa Island, was read by the Secretary. He stated that the hearing
had been advertised October 4th, postcard notices sent to surrounding property owners, plans
and plot plan posted and all other requirements of the ordinance complied with.
Chairman declared the hearing open for discussion and asked if anyone present wished to
epdak on this matter.
Secretary stated that a letter of protest had been received signed by 5 property owners
in the block. Those protesting were, May M. Blamer owner of lot 20, Ida B. Ruth owner of
Lot 24, Ban W. litter owner of Lot 23, T. E. Adams owner of Lot 17 and Philp R. Hoeflor owner
of Lot 19.
Mr. D. B. Kirby, architect for Mr. Johnson, explained the plane to the commission and
the reasons for requesting the variance. He stated that the house next door to Johnsoa'e
property on the south, owned by hr.. Hoefler, one of the protestants, 1s a 2 story house and
Is within j ft. of the front property line. The view to the south is the only one desirable
because of the bridge ramp which obstructs the view to the north. As the plans are Laid out
they are keeping the house north on the lot as far as possible and it will set approximately
9 ft from the rear property line. thus allowing light and ventilation for both houses. Allow-
ing the variance will not obstruct the view of anyone south of the property and the view north
Is obstructed by the bridge. As the property in question faces the Canal and as there is a
wide walk plus 34 ft to the property line and since the house nest door is within 3 ft of the
property line, Er. Kirby stated that he believed no injury would rasult from the granting of
this variance and that Mr. Johnson is justified in making such request.
, sir. Johnson was present and stated that he believed his request reasonable because the
house next door, owned by Mr. Hoefler, sets within 3 ft of the front lot line.
Com. Seeger brought oat the fact that, as this is on a minor way, it is one of those.
instances when the Commission does not have to confine itself to a 50% variance.
No one was present to protest the granting of this variance.
Com. Whitson moved the adoption of Resolution Na i44 recommending that a 50% 5 ft, front
yard variance be granted to Arthur M. and Helen M. Johnson on Lot 18, "lk.l, Sec 5, Balboa
Island and that the same be transmitted to the City Council by the Secretary asthe recommenda-
tion of this commission and a copy be filed as a part of the minutes of this meeting.
Seconded by Cow. Estus.

Motion carried and so ordered by the Chairman.
FIRST HEARING ON REZONING OF A PORTION OF LOT F. TRACT 919.
Secretary read the application of Mr. E. S. Gibson, owner of a portion of Lot f, Tract
919. for resoning the rear of this property to allow construction of an auto court. He stated
that the hearing had been advertised October 4th, plans and plot plan posted, postcard notices
sent to surroundia; property owners and all other requirements of the ordinance complied with.
No written protests were received.
Chairman declared the hearing open for discussion and inquired if anyone wished to speak
on this matter.
Mr. Walter Spicer stated that he was a neighbor of Mr. Gibson's and was interested in
Mr. Gibson's problem because it is also his problem. lie stated he believed the whole tract
should be rezoned so that it si in the same classification bacir to 10th Street. His property
is toned in the same way as Mr. Gibson's and is a non - conforming use beyond the hundred feet
facing on Coast Highway. In case of fire, he might not be allowed to rebuild.
Com. Whitson stated that it costs the City considerable money to amend the ordinance
and suggested that Mr. Spicer and other property owners in this district petition for rezoning
immediately so that thw whole tract may be rezoned at one time.
There wessome discussion as to whether the whole district could be rezoned from the
application of Mr. Gibson for rezoning a portion of this area.
The Chairman ruled that this application designates a specific part of this area and then,
fora applies only to Mr. Gibson's property. The Commission may initiate action for r atoning
ezoni
the entire area, however, two separate hearings must be hold on the other property in question,

Com. Whitson moved that this matter be sent to second hearing November 16th, Seconded
by Coy. Briggs. Motion carried and so ordered by the Chairman.
It was the opinion of the Oonmission that the zoning C -1 and R -1 existing at the present
time on this property was unfair to the owners of this property and should be in one classifi®
cation to the foot of the bluff.
Com. Seeger moved that the Planning Commission request the City 'Engineer to furnish
this Body with a map for its information showing the crest and foot of the bluff adjacent to
this property. Seconded by Com. Whitson. Motion carried and so ordered by the Chairman.

the Newport Beach Planning Commission for approval the mapof a proposed subdivision on Coast
Highway ,rest of the Beacon, being outside the city limits, said subdivision to be known
as Tract 1011, owned by Mr. Strobridge.
The map was examined by the Commission.
Certain undesirable features of the subdivision were brought out during discussion.
1. Area of lots in the R -1 zone are not of sufficient area being only 40 x 100.
2. No provisions are made for sewer disposal.
3. No provision is made for voter supply.
4. The Planning Commission would like to see some building restrictions placed
upon the property.
It was the ooinion.of the ODmmission that the subdividers were depending upon the City
of Newport Beach for water supply and that it would be ds4sirable for this area to be admitted
to the City.
Com. Briggs moved that the Planning Commission go on record as not approving this tenta-
tive map of Tract loll and that the Chairman appoint a committee to take this map to the
Orange County Planning Commission and explain the reasons for this Commission not approving
same. Seconded by Com. Williams. Motion carried and so ordered by the Chairman.
Sir. J. A. Hoek appeared before the Co unission to present a plan for subdividing land
which he has under lease from the City lying on the north shore of Newport Bay between hiaarbor
Island and thlb Balboa Iacht Basin. He explained that he had only a rough draft of the sub-
division prepared and that he had been advised by council that it was not necessary to submit
the map to the Planning Commission for approval, since it involves only sub- loasing of land,,
but that he was presenting the map informally for suggestions from the commission and would
like and informal approval of the ,general plan. He' explained the map and stated tha0 he
copes to make this the best subdivision on Howport Harbor.
It was the opinion of Com. Seager that. since the proposed subdivision lies within the
city, it is a part of the city and subject to the ordinances thereof.
Chairman Hopkins stated that, as air. Beek had been advised that it was not necessary to
present the map for approval of the Planning Commission, no formal action could be taken.
He suggested that Mr. Beek study the requirements of Ordinance 440 as to the lot areas jot"
quired , etc. in preparing the tentative map. No further suggestions were made exdspt that
the alleys might be made 5 ft. wider.
Mr. Beek presented the Chairman with a parchment scroll from the Directors of the
Tournament of Ligbte Association as a memento of appreciation for his work during the
Tournament of Lights.
on motion of Com. Williams, seconded by Gam. Seeger and duly carried, the meeting ad•
journed.
