Item #1 Request for interpretation of various sections of REQUEST the Municipal Code pertaining to permitted uses in -FSR- the M -1 District. TUER- PRETATION Location: 505 - 29th Street, Newport Beach Zone: M -1 Applicant: R. L. Lawrence, Newport Beach Planning Commission discussed the type of sales to be conducted. R. L. Lawrence appeared before the Planning Commis- sion and answered questions concerning the intended operation and residential use of the property. He stated that he agreed w$th the staff recommendations; intended to make the existing residence into a combination office - studio- residence for his own use; and would comply with whatever provisions the City imposes. Following discussion, it was the finding of the. He stated he was in agreement with the conditions as recommended in the staff report with the exception of Condition No. 3 (b). He felt that a sign larger than ten square feet was needed on the south elevation due to the fact that the building would be two stories in height on that side and the building on the adjacent property obstructed the view of a small sign. There being no others desiring to appear and be heard, the public hearing was declared closed. Planning Commission discussed grading and construc- tion of a wall adjacent to the residential property Motion X Public hearing was re- opened and Mr. J. R. Norman, All Ayes Architect working with Mr. Schunk appeared before the Planning Commission to explain and clarify the matter of grading. The Chairman again closed . the public hearing. Motion X Following discussion, Amendment to Use Permit No. All Ayes 1178 was approved subject to the following condi= tions: 1. That development shall be according to the approved.plot plan and elevations, except for minor modifications approved by the Director of Community Development. 2. There shall be no outside display of tires. 3. Exterior signs shall be limited to the followin a. One double -faced freestanding sign, not exceeding a height of twenty -five (25) feet and an area thirty -six (36) square feet for each side. b. Two wall signs not to exceed thirty -six (36) square feet each may be placed one on the south elevation and one on the west elevation. c. One sign identifying the operator of the premises and address of the building, to be located on thebuilding and not exceeding a total of eight (8) square feet. Page 3. All small signs advertising products for sale, trading stamps, credit cards and the inspection of pollution control devices, lamps and brakes, as authorized by the State, shall be clustered into not more than three (3) sign groupings located on the building face, and a total of which shall not exceed twelve (12) square feet in area, exclusive of the additional space required for signs advertising State- authorized services. The sign background shall be of materials in harmony with those utilized in the building. e. One double -faced sign, in a permanent frame not exceeding an area of twelve (12) square feet for each side, for promotional purpose,. f. No rotating, flashing, blinking or signing with animation, flags, banners or other attention- attracting devices shall be permitted on a permanent basis. Attention- attracting devices may be permitt d for thirty (30) days, however, when connect id with a change in ownership or management. 4. That all products or merchandise shall be stored within the main building, except the used casing area indicated on the plot plan. 5. That landscape planting and sprinkler irriga- tion plans be submitted to and approved by the Community Development Department, and the site shall be landscaped according to the plan and be permanently maintained. 6. That the parking area shall be paved except for that portion which is landscaped. All parking spaces shall be marked clearly and shall meet all City codes and standards as to size and accessibility. Parking on site is prohibited except for such vehicles as are in the process of being service J, those belonging to employees and service trucks owned by the establishment. • No vehicle waiting for service shall be parked for a period longer than twenty -four hours on the site unless in the process of being ser- viced. Lighting - All lighting fixtures shall be located so as to shield direct rays from ad- joining properties. Luminaires shall be of a. low level, indirect diffused type and shall not exceed a. height of greater than twenty (20) feet above finished grade. 8. That the design of the driveway approach on Iris Avenue and East Coast Highway shall meet the approval of the Traffic and Parking Engineer. 9. That the types and locations of street trees shall be provided along Iris Avenue to the Specifications of the Parks, Beaches and Recreation Department and that the standard inspection fee of $3.00 per tree be paid. 10. That a sidewalk with a minimum width of eight (8) feet be constructed behind the curb and • gutter'along the Iris Avenue frontage in conjunction with the new driveway approach. 11. That a resubdivision application be processed and a parcel map be filed. 12. That all new construction work in the parkway along the northeasterly side of East Coast Highway be performed in accordance with an approved encroachment permit obtained from the State Division of Highways. 13. That the existing storm drain pipe crossing th site be removed and replaced with a 48 inch diameter R.C.P. in accordance with a plan approved by the Public Works Department. 14. That a storm drain easement with a minimum width of ten feet be dedicated to the City of Newport Beach. The centerline of the ease- ment shall correspond to the centerline of the new storm drain pipe. 15. That building construction be permitted over the storm easement only if the foundation be • especially designed to: a. Completely straddle and remain clear of the ten foot wide easement. Transmit the loads to a depth below the new 48" R.C.P. so that the structure's support is independent of the storm drain pipe and the earth around and over it. 16. The outdoor trash and used casing areas shall be enclosed by solid walls or fences and gates and shall be integrated with.the design of the tire facility. 17. That all grading shall be in accordance with grading plans and reports approved by the Building Official and a qualified Soils Engine r. Upon completion of the grading, the Building Official and the Soils Engineer shall certify that the grading has been completed according to the plans and the requirements of the grading ordinance. Permanent copies of the "as built" plans shall be furnished to the Building Official upon the completion of the grading operations. 18. That a wall shall be constructed along the northeasterly boundary of the subject property' in such a manner that it will not obscure the windows of the adjoining residential property. and will protect the occupants from noise, exhaust fumes, automobile lights and other similar sources of disturbance. Such wall shall be constructed of solid masonry to a height of three (3) feet from the Iris Avenue frontage to a depth equal to the required front yard setback established for the adjoin- ing residential property. The remaining por- tion of the wall shall be six (6) feet in height except as noted above. In the event of a complaint from the owner of the adjoining residential property, the wall shall be raised at the applicants expense to a maximum height of six (6) feet except where a three (3) foot height shall be maintained as noted above. He reviewed the Environmental Impact Report and answered questions relative to same. Various points of the EIR were discussed in detail. Supplemental information relative to storm water, geologic consideration and population consideration was presented to the Commission for discussion. The following persons also appeared before the Planning Commission and commented on the EIR: Bob Bein of Raub, Bein Frost & Assoc.; Robert Kromlin, Consulting Traffic Engineer; George Perlin, ARCO service station owner; Bruce Harrington, resident of Newport Beach and Attorney representing the applicant; Sue Ficker, 110 9th Street, Balboa; Jack Wassall, Vice President of the Balboa Improve- ment Association, 409 E. There being no others desiring to appear and be heard, the public hearing was declared closed. The Report was discussed at length especially as to completeness and the Planning Commission, in summar , felt that the following additional information was needed before any decision could be made: 1. Socio- economic impact of such a drastic change in the land use on the surrounding area and in turn the surrounding area's reaction to this impact. 2. Further study of alternative commercial uses, i.e., the proposed development for the Lido Shops waterfront area, and the economic feasibi ity of such alternative commercial uses on this particular site. 3. Impact of this density due to its difference from the surrounding density. 4. Accumulative effects of this density if it is taken as a precedent for the acceleration of development of surrounding areas. Motion X Planning Commission continued this matter to the Ayes X X X X X meeting of November 16, 1972, in order that the Abstain X above information could be submitted to the staff for evaluation. Bruce Harrington, Attorney for the applicant re- quested the Planning Commission to obtain an opinion from the City Attorney as to whether or not the additional information as requested by the Planning Commission was appropriate subject matter for an Environmental Impact Report. There being no others desiring to appear and be heard, the public hearing was declared closed. Planning Commission discussed the report at length especially as to the school district boundary lines being made coterminous with the City boundary line, parks for the entire project, and helicopter over- flights and noise levels. Motion X Following discussion, motion was made that the Environmental Impact Report in connection with Tract 7845 be approved with the recommendation that buyers be notified of the possible helicopter • overflights and that the schools will not be in the Newport -Mesa School District. Following discussion as to procedure and the possibility of the Planning Commission actions being made in two parts, to wit: completeness of report and findings with possible recommendations; Motion X the original motion was withdrawn and a new motion All Ayes made that the Environmental Impact Report for Final Tract 7845 be accepted as to completeness in accordance with the guidelines set forth by the City Council.
