Public hearing was opened in connection with thi matter. Dean Gilbert, 2472 Eldon Avenue, Costa Mesa, appeared before the Commission in connection wit this matter and projected pictures of the site on the screen. He commented on the reduction it .density, increased amount of open space, parkinc along Newport Boulevard and design of the build- ings. Staff reviewed changes to several of the recomme ed conditions of approval as a result of combini • the two northerly lots and providing only one access point on Newport Boulevard. Mr. Gilbert concurred with these changes. Roland Landrigan, 535 E1 Modena, President of ti Newport Heights Community Association, requester that the Planning Commission give serious consie ation to the problem of traffic and any increase which may be generated by this proposed develop. ment. That the proposed site will be graded and developed with due regard for the aesthetic qualities of the natural terrain. 6. That the proposed development will be compat ible with surrounding development and with the character of the neighborhood, and is no detrimental to the orderly and harmonious development of its surroundings and of the City. 7. That the site plan and layout of the buildin parking areas, pedestrian and vehicular acce ways gives proper consideration to the func- tional aspects of the site development. and approve Site Plan Review No. 7, subject to t following conditions: 1. That a resubdivision be filed to create two parcels from Lots 25, 26 and 27 and one parcel from Lots 20 and 21. 2. That the full width of the alley off Catalina Drive along the North side of Lot. 20 be improved from Catalina Drive to 20 feet beyond the drive approach for the pro- posed duplex. 3.. That all access rights to North Newport Boulevard except for the private drives on Lot 23 be released and relinquished to the City. 4. That the existing curb inlet on the east sid of North Newport Boulevard be reconstructed. 8. That any unused existing driveway approaches on North Newport Boulevard and Catalina Dri% be closed up. 9. That a 5 foot wide easement for sidewalk anc public utility purposes along the east side of North Newport Boulevard be dedicated to the City of Newport Beach and that additions "pocket" easements for street lights, fire hydrants, etc. be provided behind the.sidewi 10. (Note The size of this main may be enlarged by th City. If this occurs, the City will pay th developer for the additional material cost for pipe, valves, and fittings). 13. That individual water and sewer services be provided to each dwelling unit, and that pressure regulators be installed on the wat services. 14. This plan is sub - ject to the review and approval of the Director of Community Development and the Director of Parks, Beaches and Recreation, and installation of improvement will be in substantial conformance with the approved plan. If any archaeological, paleontological or .historic resources are uncovered during grading, work shall be halted and the appropriate authorities consulted in compli ance with the City of Newport Beach Archaeo logical Guidelines. 25. That the structural designs for the propose units be reviewed by a qualified acoustical engineer and design modifications incorpor- ated as required to bring interior noise levels to acceptable levels. Compliance wi state noise insulation standards must be demonstrated at the time of the building. permit application. 26. Commissioner Lynch stepped down from the dais and refrained from deliberation in connection . with Item #3, due to a possible conflict of interest. Newport Beach 1977 MOLL CALL Owner: Same as Applicant Engineer: Williamson and Schmid, Irvine Community Development Director Hogan pointed out that it was the intent of the applicant to incre the square footage of office space on the newly created parcel, however, the total square footag allowed within Newport Center would not be incre ed since a redistribution was planned in accord- ance with the resolution that was approved by th City Council relative to development in Newport Center. He also answered questions of the Commi sion and advised there was no Planned Community Plan or Text at this time, that an environmental impact report had not been prepared for the pro - posed resubdivision but would be prepared at suc time as a plan was submitted to the City for review, and that the intent of the resubdivision was for the purpose of selling the property. Public hearing was opened in connection with thi matter. Douglas Schnorr appeared before the Commission o behalf of The Irvine Company and concurred with the staff report and recommended conditions. He commented on the proposed use of the property by Pacific Mutual and the redistribution of develop ment rights within Newport Center. As to the requirement for an environmental impact report, Mr. Schnorr advised that the only thing they wer requesting at this time was that a line be drawn on a map in order that a real estate transfer could be made. Planning.Commission briefly discussed developmen of the residual portion of the property, includi a previously approved use permit and tentative tract map which has since expired. There being no others desiring to appear and be heard, the public hearing was closed. Commissioner Heather felt that this request was premature in view of the pending review of the General Plan. She also felt the need to review a Planned Community Text prior to any resubdivi- sion. Page 8. Commissioner Hummel advised that he could not support a resubdivision without a plan and since a review of the General Plan would be held in the near future, felt the request was inappropri, at this time, especially since no plan was avail. able. ! Commissioner Lynch returned to the dais. Planning Commission discussed the various option with respect to this hearing and concurred that the matter should be heard and a decision made based on the merits of the use and not on the validity of the lease. It was also pointed out that the approval of the use would run with the land and not the applicant. Public hearing was opened in connection with thi matter. Dick Johnson, 20649 Santiago Canyon Road, Orange applicant, appeared before the Commission and concurred with the staff report and recommenda- tions. He answered questions of the Commission with respect to the proposed improvements, parking, and lighting. Arnold Gordon, M.D., co -owner of the property, appeared before the Commission and disputed the validity of the lease. Planning Commission advi him of their decision not to receive testimony with respect to the lease. Jim Whitesides, Attorney with the law office of Jeffrey R. Matsen, representatives for the applicant, appeared before the Commission and presented a copy of the original lease agreement with the Irvine Company as well as a letter acknowledging the lease by the present property owners. He also categorically denied any allegations made by the owners of the property. There being no others desiring to appear and be heard, the public hearing was closed. The approval of Use Permit No. 1845 will .not, under the circumstances of this case be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing and working in the neighborhood or be detrimental or injurious to property or improvements in the neighborhood or the general welfare of the City. • and approve Use Permit No. 1845, subject to the following conditions: 1. That the offstreet parking lot shall be marked with approved traffic markers or painted white lines not less than 4 inches wide in accordance with the approved, revised parking layout. A minimum of 6 of the open parking spaces shall be accessible for customer and employee use at all times. 4. That a landscape plan shall be submitted to an approved by the Director of Parks, Beaches and Recreation. No rotating, flashing, blinking or signing with animation, flags, banners or other attention - attracting devices shall be permil ted on a permanent basis. For fourteen days each calendar year during the new car model announcement time . 7. Illumination of the automobile display area shall be required to discourage thefts from automobiles. There being no others desiring to appear and be heard, the public hearing was closed. Motion X Following discussion, motion was made that All Ayes Planning Commission make the following findings 1. That there are exceptional or extraordinary circumstances applying to the land, referre to in the application, which circumstances conditions do not apply generally to land i the same district, since the height of the building has not been altered with the addi of the roof over the third level of the str ture and the height of the building conform to the height limits which existed at the t of construction. 2.
