Roland Hammond, 1603 Balboa Avenue, applicant,
appeared before the Commission and concurred with
the staff report and recommendations.
William Coulter, 307 E. Bayfront, Balboa Island,

appeared in favor of the request.
Mary Madison, owner of property at 1601 Balboa
Avenue and 222 Abalone, and member of the Board
Directors of the Balboa Island Improvement Assoc -
tion, appeared before the Commission in favor of
the request. She advised that although the Asso(
iation wrote a letter in opposition to exceeding
the square footage allowed under.the R -1.5 zonin!
this matter was discussed and they took a stand
not to go against anyone on a small piece of
property and advised the Hammonds to go ahead on
their project.
Mrs. Dick Young, 1600 Balboa Avenue, and owner o
property at 1605 Balboa Avenue, appeared before
the Commission in favor of the request.

Additional correspondence and petitions in favor
of the request were distributed to the Commissio
for their review.
Public hearing was opened in connection with thi
matter.
Brion Jeanette, Architect, appeared before the
Commission on behalf of the applicants. He
commented on the request and advised that althou
the original modification was approved, the appl
cation was withdrawn because of threats voiced a
the meeting to stop construction in any way
possible and the potential delays as a result of
the appeal process. He commented on the desire
to begin construction as soon as possible becaus
the weather was good, financing had been obtain.e
the contractor had been secured and the Collins
were leaving on vacation, therefore, permits wer
secured with the understanding that the third
parking space would be provided. Although the
third space could be provided, it would be more
desirable to eliminate it since the applicants d
not intend to use the space which would be locat
in front of the front door. Also, the third
parking space would require a new curb cut which
would eliminate an on- street parking space used

they reapplied for the modification which was
subsequently denied by the Modifications Committ,
They feel that denial was unjustified because
nothing has changed since the original modificat

Commission to comment on the intent of the ordin
ance and felt that the question of parking shoul
have been settled at the beginning of constructi
and not after completion.
Phil Landsdale, 242 Hazel Drive, appeared before
the Commission to comment on the "request. He fe
that the development improved the area and that
on- street parking was more valuable than a drive
way. He also advised that his home contained mo
square footage than that of the subject house an
he had only a two car garage.
Dorothy Krauter, 234 Poppy, appeared before the
Commission and felt that this request would set
precedent. She also commented on preservation o
view areas in the City.
Mary Curtin, 254 Poppy, appeared before the Comm
sion and advised she felt that three -car parking
should be required on -site because of future
changes in family requirements as well as proper
ownerships.

Jack Reilly, 222 Hazel,appeared before the Commi
sion in favor of the request and felt that the
trade - off to allow parking on the street was mor
beneficial to the neighborhood.

Brion Jeanette appeared before the Commission in
rebuttal to the opposition and advised that many
of the homes on Hazel were larger than that on tl
subject property and only had two- car.garages.
Also, parking was allowed only on one side of Ha

neighborhood.

heard, the public hearing was closed.
Commissioner Agee commented that the Commission
had an obligation to listen to the residents in
the area as to what they wanted and it was clear
that the majority of the people would rather hav

motion was made that Planning Commission overrul
the decision of the Modifications Committee and
grant the appeal, thereby approving the modifica
tion with the following.findings:
•
1. The proposed room additions are minor in
nature, and no bedrooms are being added in
conjunction with the proposed development.
2. Requiring the third parking space on the sub
ject property would eliminate an on- street
parking space, which is more beneficial to
all of the residential properties on Hazel
Drive.
3. The proposed development meets or exceeds al
of the other Residential Development Standar
(i.e. floor area limit, open space option,
building height, etc.) for Corona del Mar.
In support of the motion, Commissioner Balalis
commented on his involvement with the establish-
ment of the Residential Building Standards and t
initial idea that if square footage was being
increased through the addition of bedrooms, it w
more than likely that the number of people livin
in the house would be increased, thus the need f
additional parking. In this particular case, th
number of bedrooms has actually decreased,
although the square footage has increased,.and
•
therefore, the modification is justified.
Commissioner Frederickson commented on the prese
vation of an on- street parking space which would
be used by others in the neighborhood; was conce

with the applicants' deviation from what was
agreed upon prior to construction; and pointed
out-that although it would be easier to maintain
the requirement for on -site parking spaces if no
precedent was set, preservation of on- street
parking was more important.
Commissioner Seely commented on the parking situ
tion and pointed out that the applicant has been
consistent in his request and felt satisfied tha
the findings were as applicable now as when the
matter was first heard before the Modifications
Committee.
Commissioner Hummel commented that this hearing
and discussion reinforced his feeling that the
entire old Corona del Mar area was in dire need i
a Specific Area Plan. He voiced concern with th
parking problems in the area but felt that the
circumstances.of this case warranted granting thi
modification.
•
Commissioner Heather advised of her opposition ti
the motion, because she felt the maneuvering of
the applicant was not done in good faith and fel
that the request would set a precedent.

received both of the reports and upon review of
the reports as well as the original conditions
imposed on the use permits and tentative maps,
felt that the conditions were sufficient to allot

developer to satisfy the need for drainage, soil
stability, landscaping and irrigation. Mr. Hogai
further advised that staff had no knowledge of
changes in circumstances which would warrant den

extensions as requested.

Jim DeMarco, Attorney for the applicant, appeare
before the Commission and advi.sed they had nothi
to add at this time and requested the opportunit,
to respond later should there be any opposition
to the request.
John Stewart, 440 Vista Grande, appeared before
the Commission and recommended that the tentativ
tract maps be extended but that the use permit
extensions either be denied or the matters be se
for public hearing. The reason for this request
was based on changes in the Uniform Building.Cod
pertaining to lot lines which may be in conflict
with the enforcement of the C.C.& R.s of the
Bluffs Homeowners Association; the sites represe
the only two vistas on the public street; and th
problems with drainage.
Marie Buckey, 2187 Vista Entrada, appeared befor
the Commission and requested that a public heari
be set concerning these extensions in order that
the information relative to drainage, ground wat
seepage, soil erosion, etc., could be reviewed.
Also, there are new people in the area who may
want to be heard.
•
Planning Commission discussed the issue of drain
age and the conditions which were imposed when t
developments were approved. There was some conc
that the conditions were not as explicit as they

should be and needed clarification. It was poinl
out that the only way changes could be made to.t)
conditions was by denial of the extensions and
subsequent submittal of new applications for the
projects.
Planning Commission discussed the proposed ordin-
ance recently recommended for adoption by the Cii
Council pertaining to the termination of an appl-
cation should it not be exercised within the
allotted time period. They also compared the
subject request with that of the extension grant(
and additional conditions imposed several weeks
ago in connection with Tract 8725.
John Stewart appeared before the Commission and
voiced concern that the conditions imposed on thl
use permits and tentative tract maps were not
explicit enough to guarantee correction of the
drainage problem to the degree they desired and
.
advised that if there was some way to make the
conditions more explicit in order to assure this
then they had no objections.
Commissioner Seely commented on the proposed ord
ance relative to termination of applications not
exercised within the allotted period of time and
the reasons behind such an ordinance, mainly tha,
the passage of time alone created changes in
.circumstances and attitudes.
Jim DeMarco, Attorney, appeared before the Commi!
sion on behalf of the applicant and advised that
the conditions and number of houses in the devell
ment existed because that was what the surroundil
homeowners wanted. He commented that the only
additional significant information was the claim
that certain drainage problems may or may not
exist and since the staff had expressed the opin
that the problems could be handled through the,
existing conditions, felt that the applications
should be extended.
At this time, discussion was closed to the publi
since no others desired to appear and be heard.

Commissioner Frederickson opposed the motion beta
he felt that the projects had been discussed and
altered to the point that problems had been work
out, including the conditions relative to draina
and did not feel evidence had been presented
contrary to allowing the projects to proceed.
Commissioner Agee commented in support of the
motion because it was previously agreed by the
Commission that the concept of time was importan
to the point of amending the Municipal Code.
Commissioner Seely reiterated his position with
respect to basic changes as a result of the pass
of time and voiced concern that the Planning Com
mission had the responsibility of making a recom
mendation relative to drainage without benefit o

all the reports which had been made.
Commissioner Balalis brought up the question of
whether or not a condition could be added with t
consent of the applicant at a public hearing.,
similar to the action taken in connection with
Tract 8725. Staff pointed out that the process
in that instance was different in that a formal
application for alterations was filed with the
City together with the appropriate fee and the
matter was set for hearing and.treated in the sa
manner as a new application.

felt a public hearing would not serve any purpos
for either the homeowners or the applicant.

ing was to approve the extension to which he was
opposed and, therefore, would have to support th
motion.
The adding of conditions at the public hearing w
further discussed and Assistant City Attorney
Coffin pointed out that this could be accomplish,
only if the applicant requested alterations to tl
tentative maps or the use permits but that no
conditions could be added with respect to the
extensions. Staff further pointed out that if i
was the desire of the Planning Commission to hol
a public hearing and be in a position to conside
new evidence and add or change conditions, then
the extensions should be denied and the applican
instructed to reapply.

The project list of the Current Plans and Projec
Division was reviewed and discussed. It was fel
that a lot of the items were housekeeping matter
and could be disposed of in a relatively short
time. Also,.there were certain items which, whe
completed, would help to relieve everyday proble
and eliminate some of the workload thereby provi
ing additional time for more import issues. Plan
ning Commission suggested that the housekeeping
items be separated from the others and that new
lists be prepared for review at a future study
session.
The Advance Planning Division project list was
reviewed and discussed. Planning Commission als
discussed changes in current procedures in order
that the establishment of the various Specific
Area Plans could be done in a more expeditious
•
manner.
