Nuzum Helen Herrmann MINUTES On motion of Commissioner Dosh, seconded by Commissioner Glass, and carried, the minutes o October 16, 1969 were approved. Item 1. MODIFICA- Request to add an additional dwelling unit to an existing triplex. The structure would be TION NO. 94 nonconforming because the garage would be sub- standard in width and the required clearance CONTINUED would not be maintained between structures. USE PERMI — a Request for extension of a use permit allowing on -sale liquor in connection with bonafide eat- ing facilities, in conjunction with club NO. 1233 CONTINUED facilities, and further permitting patron UNT11— dancing and live entertainment for club member NOV. 20 and their guests, as well as permission to rent the facilities to private parties. A use permit is required since the establishment is within 200 feet of a residential district. Location: Portion of Block 52, Irvine's Sub- division located at 2601 Eastbluff Drive, westerly side of Eastbluff Drive, north of Vista del Sol. Zone: C -N -H and R- 4- B -2 -UL Applicant: Newport Beach Tennis Club, Newport Beach • Owner: The Irvine Company, Newport Beach Chairman Jakosky stated he was sorry but this matter would have to be continued again inasmuch as he was not present at the meeting when the original discussion took place and he was there- fore disqualifying himself. Commissioner Brown also intended to step down thus leaving only 3 voting members which would not constitute a quorum. City Attorney Seymour advised the Commission they should take some action to extend the use permit until it could be heard by a quorum of the Commission. On mo.tion.of Commissioner Glass, seconded by Commissioner: Watson, and carried, Use Permit 1233 was continued until November 20, 1969 with the stipulation that the use permit would remain in effect until that time. Mr. Bernard Pegg of 2633 Bamboo Street presente a petition to the staff regarding this use • permit, to be entered into the record. Page 2. USE PERMIT Request to allow dancing in conjunction with a restaurant and cocktail lounge. Location: Portion of Block B, Tract 919, located at 2500 West Coast High- NO. 14n-- APPROVED way, north side of West Coast Highway, 200± feet east of Tustin Avenue. Zone: C -1 -H Applicant: Pierino Benigni, Newport Beach Owner: Jakosky Company, Costa Mesa Mr. Frances Ursini represented the applicant, who also was present at the meeting. There wa a discussion regarding whether or not Mr. Benigni intended to continue serving food or whether this establishment was to be operated only as a bar. Mr. Benigni indicated that he intended to continue serving food. The application was approved subject to the Motion x following conditions: Second x Ayes 1. Mead, Garden Grove Owner: Same as applicant Mr. Mead was present at the meeting and answer id questions of the Commission, who expressed con cern regarding the lack of off - street parking on the premises, this being the first applica- tion for extensive remodeling to come before the Commission since the adoption of the "Off - Street Parking Ordinance ". Dr. Alexson, who has just purchased the properly directly to the east for the purpose of re- development, stated he did not favor residents 1 . use on the second floor of Mr. Mead's property, After discussion, the application was approved Motion x subject to the condition that the applicant Second x deposit with the City Attorney an agreement, All Ayes either with the City or with a private party, guaranteeing off- street parking for two cars. VARIANCE Request to construct a two -story accessory NOS building, (boathouse and garage), and to permit said accessory building to be constructed and WITHDRAWN used before construction of the main building (a single - family residence). Location: Lot 36, Tract 802, Harbor Island, located at 36 Harbor Island. Zone: R -1 Applicant: Ernest C. Kanzler, Jr., Costa Mesa Owner: Same as applicant Mr. Robert Howie represented the applicant, who also was present at the meeting. New plan were distributed to the Commission indicating that what had originally been designated as a detached accessory building was now intended • to be structurally a part of the main building Mr. Kantzler addressed the Commission and answered questions, after which it was deter- mined that a variance was no longer necessary and it was suggested that Mr. Kantzler might wish to withdraw his application. Mr. Kantzle Motion x concurred and the application was withdrawn. Second x All Aye Item 7. AMENDMENT Request to amend portion of District Maps 39, 49, 50, 53, 54, 55 and 56 from an Unclassified 90. 260 "U" District to a Planned Community "PC" CONTINUED District. UNTIL N6P -20 Location: Portion of Blocks 55, 56, 92 and 93 of Irvine's Subdivision, bounde on the south by San Joaquin Hills Road,.on the west by Jamboree Road on the north by Ford Road and on the east by MacArthur Boulevard. Zone: "U" - Unclassified • Applicant: The Irvine Company, Newport Beach Owner: Same as applicant Page 5. CITY OF NEWPORT BEACH COMMISSIONERS J�t\ 5r• November 6. 1969 m Mr. Daren Grath, Principal Planner, introduced the subject of "Big Canyon" and called upon Mr. James E. Taylor and Mr. Ken Noll, repre- sentatives of the Irvine Company to explain the proposed development which is an overall planned community. The Commission expressed concern about the pri vate streets; the final width of these streets provision for guest parking, whether on- street in bays, or in designated parking areas. Both Mr. Wilson and Mr. Ben Nolan stated that the issue of private streets should either be gone into thoroughly or deleted from the zoning question. It was generally thought tha the private streets, as ah issue, could be better answered at the time of tentative map processing in accordance with the provisions of the private street policy at that time. Therefore, private streets should not be men- . tioned in the zoning application. The Commission then commented on miscellaneous provisions of the performance standards as they relate to this ordinance. Such questions as 8 foot walls in relation to side yard set- backs, front yard setbacks and off - street park ing for the golf club house were raised. The Irvine Company stated that revisions would be submitted relative to these points. Mr. Calvin Stewart, Parks, Beaches and Recrea- tion Director addressed the Commission regard- ing the findings of the Parks, Beaches and Recreation Commission, who approved this appli- cation in principal, with the following con - ditions: 1. That a minimum of four acres of usable park land be set aside for recreational purposes; 2. That a development of bicycle and walking trails throughout the area be encouraged. 3. That some sort of pedestrian access • be made through the development open- ing onto Ford Road. Mr. Stewart stated that the Parks, Beaches and Page 6. CITY OF NEWPORT BEACH a November 6, 1969 COMMISSIONERS Recreation Commission felt that adequate open space for free play was not provided by the golf course alone, therefore the recommendation for 4 acres of usable park land was made, preferably to be located in the single family dwelling area. Discussion then centered around the need for a northerly connection with Ford Road in that the only means of ingress and egress from this development is onto San Joaquin Hills Road. Mr. Taylor stated that the Irvine Company was opposed to an opening on Ford Road and that the figures of their traffic consultant in- dicated that there is no need for a northerly connection. Again, the staff felt that this could be an issue which might be better resolved at the tine of tentative map processing, however the staff and the Planning Commission were not convinced • that a northerly connection is not needed. Both felt that further discussion of this issue would be in order as part of the zoning applica- tion. In order that the wording of the ordinance Motion x could be revised and corrections made, the Second x application was continued until November 20, All Ayes 1969. COMMUNICA IONS The Commission considered a request from the 1. Irvine Company for change in design of turning areas to be provided on single - family residen- tial lots along the south side of Bayside Drive between Bahia Corinthian Yacht Club and Balboa Yacht Club. (Tentative Tract No. 6927.) The method of accomplishing this was discussed, one suggestion being that Condition No. 11 of the tentative map which states: "That access to Bayside Drive be provided by means of joint driveways on common lot lines, with appropriate • cross- easements being furnished" be revised when the final map is submitted; also that some form of "non- barrier" agreement to the common lot line be worked out. It was suggested that the Irvine Company consult with the City Attorney before making a definite proposal. Page 7. i CITY OF NEWPORT BEACH November 6, 1969 Planning Director Wilson apprised the Commis- sion of the two following meetings: A program on service stations to be held on November 13, 1969 at 6:45 P.M. at Friedemann Hall, 134 So. Glassell Street, Orange, sponsor ad by the League of California Cities, Orange County Division. The subject scheduled is "Location and Zoning and Regulation of Service Stations in Cities "; speaker John Touhey, Executive Vice President of International Service Station Association.
