Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, and Wightman. Commissioners Absent: Briggs: MINUTES: Upon motion of Commissioner Reed, seconded by Commissioner Copelin, the min- utes of the last regular. Planning Commission keeting of October 18th, 1951 were approved as submitted to the Commission. Motion carried. PUBLIC HEARINGS -USE PERMITS: 1. Application of Arthur L. Dillon to move dry cleaning shop, 117 22nd Street, Newport Beach, Lot 18, Block 22, Newport Beach Tract) Mr. Dil- lon was present and stated that the reason for the move besides being a better location was that the present quarters have apartments over the shop and where he comtemplates the move, it is a one story building. Commissioner Ellerborek made a motion.that the application be approved, seconded by Commissioner Pleger and carried by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerborek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs. 2. Application of Joan Hayden Schott for a nursery school at 440 Heliotrope Avenue, Corona del Mar. Commissioner Copelin stated that he and Mr. Nelson had gone over and taken a look at the application and that the appli- cant had complied with all.State and County regulations and they could see no reasons for not granting it. Plans to have 30 students for half a day and 15 for all day. C-1 zone. Commissioner Pleger made a motion that the application be granted, seconded by Commissioner Ellerbroek and carried by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Rudd, Smith, & Wightman. NOES: None ABSENT:. Commissioner Briggs NOT VOTING: Commissioner Reed 3. Application of Dee H. Wade for light manufacturing at 3011 New- port Blvd. Present location is 429 30th St.. Machine horse -power contemplated: 30 h.p. Applicant in C-1 zone. Commissioner Copelin made a motion that the application be approved, seconded by Commissioner Pleger and carried by the following roll call vote, to-wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ' ABSENT: Commissioner Briggs 4. Application of the Newport - Balboa Federal Savings & Loan Associati for the erection of a neon sign on a metal pole at 3333 Via Lido, Newport Beach. This is to be a revolving sign exceeding the height limitations of 05 feet by Q feet. (contId) 178 VARIANCES: Commissioner Pleger made a motion that the Use Permit be granted for the erection of the sign according to plans and specifications attached to the application. Motion seconded by Commissioner Reed and carried by the following roll call vote, to -wit: , AYES: Commissioners: Copelin, Ellerbroak, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs Commissioner Rudd then made a motion authorizing the sign to exceed the 35 foot hiehgt limit to a total of 39 feet. Motion seconded by Commissioner Ellerbroek, and carried by the following roll call vote, to -witP AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs 5. Application of C. H. Hennell for U -Drive small boat rentals. 120 feet involved. This We of the Taylor house across from Palmer's office on Via Lido. Thirty boat rentals planned -- mostly sea operation, fishing and ski tow. Outboard boats in or out of the harbor. Since this application had just been submitted to the Commission at this meeting, the Commission wanted more time to go into it further. Mr. Hennell said thsre was,_no time element pressing so Commissioner Rudd moved that the application be set over until the next regular Planning Commission meeting on December 20th, 1951. Motion was seconded by Com- missioner Pleger and carried by the following roll call vote, to -wit: ' AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs 6. Application of Arnold Na e li, M.D. for construction of a Medical Center, Lot 2, Tract 1117. Behind new Bank of America Building on Via Lido) To be identical in construction with medical center in City of West Covina. Griffith Company furnishing parking to comply with zoning regulations. Will have to provide parking on building site-- C-1 -H. Upon motion of Commis- sioner Pleger, seconded by Commission r Ellerbroek, the matter was set over until the next regular meeting of the Planning Commission. AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger; Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: CommissionersBriggs. . 1. Application for Variance of S. L. Burgess for a front yard variance of seventeen inches (17 ") at 1810 W. Ocean Ft, Newport Beach. (Lot 5, Block 18, Newport Beach Tract) Building next to applicant's property is.out and would like variance to come up even with neighbor's house. Mr. Burgess owns the other property to his left also. Commission could see no reason for not granting the variance and upon motion of Commissioner Copelin, seconded by Commissioner Pleger, the hearing was closed. Motion carried. 179 Commissioner Copelin then made a motion that the application be granted, seconded by Commissioner Rudd and casr-ted by the following roll call vote, ' to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Read, Rudd, Smith, & Wightman. NC>ES: None ABSENT: Commissioner Briggs 2. Application of R. W. Walling for a 2j foot overhang on apartment over garage at 113 Apolena Ave, Balboa Island, (Section.2, Block 5, Lot 9). Max Pope represented the applicant and said that they had gone ahead with the plans and some of the plumbing was already in. Mr. R. R. Deaver, 117 Apolena. was present and protested the granting of the application. Commis - sioners Pleger and Ellerbroek looked over the plans and suggested some al- terations making the Variance unnecessary. Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner-Reed and carried. Commissioner Reed then made a motion that the application be denied, seconded by Commissioner Rudd and carried by the following roll call vote, to-wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs AMENDMENTS• L. Set -over second hearing on petition for amendment of certain property owers to re -zone following described property from R -1 to R-2 in Corona del Mar. AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs NEly 10' Lot 13, & Lot 15, Block 138 10' Lot 25, & Lot 27, Block 138 . Lot 122 Block 139 Lot 20, Block 139 Lot 22 & 24, Block 139 This was set over to take action at the.sams time as the.second hearing on the Planning Commission's Resolution of Intention #487 to also rezone the remain - ing property in the blocks from R -1 to R -2. Chairman Longmoor opened the hearing and Mr. Cormack was again present to speak for the rezoning of the property. Mr. Heimer (NE 10' 13, All of 15) bought lot zoned for R-2 and am in favor of having it rezoned back to R.-2. Contemplates building next year. The Commissiow, was thoroughly familiar with the case and Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Reed and carried. Commissioner Wightman then made a motion that the petition for amendment of the zoning ordinance, so as to allow the involved property to be rezoned from Rrl to R -2, be granted. Motion seconded by Commissioner Pleger and carried by the following roll call vote, to-wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs I .1 2. Chairman Longmoor then opened the second hearing on the Resolution of Intention #487 to rezone the remaining porpery not covered by the above petition, or:- Lots 9, 112 All ex NE 101 of 13, 17, 19, 219.23, All ex NE 101 of 25, in Block 138. Lots 10, 14, 16, & 18, Block 139, Corona del Mar. No one appeared to speak for or against and Commissioner Copelin made a motion to close the raring, seconded by Commissioner Reed and carried. Commissioner Wightmaa then made the motion to grant the change from R -1 to R -2 on the above mentioned lots and that a recommendation be sent to the City Council for the amendment of the zoning crdinance.on same. Motion seconded by Commissioner Pleger and carried by the following roll call vote, to -wits AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs 3. Cblirman Longmoor opened.the second hearing on the petition for amendment of Lots 11 - 19 inc., in Tract 444 for a rezoning from R -2 to R -3 zone. There was no one present to speak for or against the application. Com- . missioner Pleger moved the bearing be closed, seconded by Commissioner Rudd and carried. The Chairman asked what action they wished to take and Commissioner Pleger then made a motion that the ordinance be amended to allow the change in zoning from R-2 to R -3 on the above lots., Motion seconded by.Commissioner Smith and carried by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: None ABSENT: Commissioner Briggs 4._ Continued first hearing.on the Resolution of Intention #486 to amend Ordinance so as to allow,commercial incinerators in the City under certain regulations and conditions. The first hearinghad been set over from . the October 18th meeting for lack of information, regulations, and specifications from the City Attorney's office. The Chairman asked the Secretary if such in- formation had been submitted to the Commissions of that hour. The Secretary stated that no information or papers had been submitted, wherupon it was moved by Commissioner Rudd, seconded by Commissioner Copelin that the first hearik be continued to the December 20th meeting of the Planning Commission. Motion passed by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, Smith, & Wightman. NOES: Now ABSENT: Commissioner Briggs COMMUNICATIONS: The Secretary read a letter from the City Council regarding a resolution ' of the West Newport Beach Improvmement Association opposing any zoning which may permit any zoning other than residential in that area. It was duly moved and seconded by Comissioner Reed, and Commissioner Rudd that the letter be filed, carried. ANNUAL REPORT: ' Upon motion of Commissioner Pleger, seconded by Commissioner Smith, the annual report was approved as submitted with minor corrections to be made. Notion carried, ADJOURNMENT: There being no further business to come before the commission, it was moved by Commissioner Pleger, seconded by Commissioner Rudd, that the Commission adjourn.
