Public hearing was opened in connection with this matter. John B. Kingsley, President of the Moana Community Association, appeared before the Planning Commis- sion and stated there was no objection to up- grading the peninsula. He requested clarification of the exact property to be included in the P -C District and strongly objected to any "night club' use on the peninsula. John Curci, representing the Curci- Turner Company, appeared before the Planning Commission and reques - ed clarification as to whether the P -C District would have to be developed as one parcel or whether individual parcels could be developed. He also stated that the P -C District would serve their purpose for any redevelopment. Mrs. Majowski, trailer owner, appeared before the Planning Commission and requested clarification of the zone change and its effect on residents in the trailer park. Roberta Riddle, Space 23 in the trailer park, appeared before the Planning Commission and commented on congestion that may be created with the redevelopment of the peninsula and questioned the reason for re- zoning the property at this time Mr. McCoy, resident of the Lido Trailer Park, appeared before the Planning Commission and ques- tioned the reason for the zone change at this time. He also questioned the General Plan. Kay Beal, trailer owner, appeared before the Planning Commission and questioned what would happen to trailer owners should the land be redeveloped. Staff advised that trailer park use could continue under the P -C District and that the • land owner had control over any redevelopment sub- ject to approval of the City. Following discussion, motion was made to recommend to the City Council that Amendment No. 413 be approved. Request to amend portions of Districting Maps Nos. 39, 41, 54, 56, and 58 from the Unclassified Dist- rict to the P -C (Planned Community) District. INDEX Item A -3 AMENDMENT 007 APPROVED Location: Property generally bounded by Bison Avenue on the north (and its easterl extension), MacArthur Boulevard on the east, Ford Road on the south, and Jamboree Road on the west (Philco -Ford site). Zone: Unclassified Initiated by: The City of Newport Beach Assistant Community Development Director Hewicker advised the Planning Commission that a use permit was approved for the Philco -Ford plant at the time the property was annexed to the City which would be the development plan under the P -C District and any additional changes or development would require an amendment to the use permit. Public hearing was opened in connection with this matter. Richard Mag, Staff Counsel for Philco -Ford, tenant on the property, appeared before the Planning Commission and stated there was no objection to the zone change. He requested clarification of the'height limitation which would be imposed. Staff advised that the property was currently in the high rise zone which allowed a maximum of 375 feet and there was no proposal for any change. There being no others desiring to appear and be heard, the public hearing was closed. Commissioner Heather questioned why the property, should be reclassified to the P -C District rather than M -1 -A which would allow the existing use. Planning Commission discussed allowable uses in the M -7 -A District as opposed to the flexibility of Page 3. X Item A -4 AMENDMENT Request to amend a portion of Districting Map No. 65 from the Unclassified District to the P -C _N G_. 415 District (Planned Community District). APPROVED Location: Property generally bounded by the Upper Newport Bay on the north, "Newport Dunes" on the east, East Coast Highway on the south, and the Upper Newport Bay on the west (Bay- side Village Mobilehome Park and Boat Storage). Zone: Unclassified Initiated by: The City of Newport Beach Public hearing was opened in connection with this matter. R. A. McGrew, Space #7, Bayside Village, appeared before the Planning Commission and questioned what effect the zone change would have on property taxes. He also felt that the trailer park was the best use for the property which was continually being up- graded and objected to any "phase out" of the trailer park. Julie Anna Schmidt, trailer owner in Bayside Village, appeared before the Planning Commission and questioned future "phase out" of the trailer park as indicated in the staff report. Staff advised that the trailer park would remain as a permitted use until such time as the property owner - submitted a request for a change in land use and same was reviewed and approved by the City There being no others desiring to appear and be heard, the public hearing was closed. APPROVED Location: Property generally bounded by San Joaquin Hills Road on the north, Santa Cruz Drive on the east, Santa Barbara Drive and Newport Center Drive on the south, and Santa Barbara Drive and Jamboree Road -on the west; and on property generally bounded by San Joaquin Hills Road on the north, MacArthur Boulevard o the east, East Coast Highway on the south, and Avocado Avenue (and its southerly extension) and a vacant parcel on the west side of Newport Center Drive on the west (Portions of Newport Center). Initiated by: The City of Newport Beach Public hearing was opened in connection with this matter. Larry Moore, Associate Director, Planning Admin- istration, The Irvine Company, appeared before the Planning Commission and advised that the Company has remained silent on previous zone changes becau e the majority of the property was unclassified but this rezoning covers property on which only 10% is unclassified. The Irvine Company believes the C -O -H and C -N -H Districts conform to the General Plan and therefore strongly objects to changing same to the P -C District thereby eliminating established ground rules and essentially starting all over again. Staff advised that the City wants the ability to review the various types of projects throughout the City and a P -C District provides for the review process. Planning Commission discussed whether or not the existing zoning conforms to the General Plan. Page 5. Staff advised that it was not included. There being no others desiring to appear and be heard, the public hearing was closed. In discussion of the matter, it was felt by some of the Commissioners that the present zoning was consistent with the General Plan and that a finding should be made regarding same. Other Commissioners pointed out the fact that the P -C District would offer more alternative uses, a greater flexibility and at the same time give the City the right of review. Julius Paldi, applicant, appeared before the Planning Commission to answer questions and stated he agreed with the conditions recommended in the staff report. Roger Squier representing Surgical Mechanical Research, appeared before the Planning Commission in opposition to the request and questioned en- forcement of the conditions if approved. That a minimum of twenty off - street parking spaces be provided (i.e., five parking spaces for each bay). The parking area shall be paved except for • that portion which is landscaped. No vehicle waiting for service shall be parked for a period longer than twenty -four hours on the site unless in the process of being ser- viced. No vehicle shall be considered to be in the process of being serviced for a period longer than one (1) week. 5. All lighting fixtures shall be located so as to shield direct rays from adjoining propertie . Luminaires shall be of a low level, indirect diffused type and shall not exceed a height of greater than twenty (20) feet above finished grade. 6. All exterior signing shall be approved by the Department of Community Development. • 7. That areas for the outdoor storage of trash shall be enclosed by solid walls or fences and gates,'and shall be integrated with the design of the proposed garage. 8. That a landscape plan shall be submitted to and approved by the Director of Parks, Beaches and Recreation prior to the issuance of a building permit for the proposed garage; and the site shall be landscaped according to the plan and be permanently maintained. At least fifteen (15) percent of the site (including the 15 foot front yard setback, exclusive of the approved driveway) shall be landscaped with plant materials designed to provide beautification and screening. 9. That the existing dwelling shall be converted. into an office and storage facility or to a caretaker's residence concurrent with the establishment of the proposed garage. 10. Zone: R-1 Applicant: Lido Isle Woman's Club, Newport Bea Owner: Lido Isle Community Assoc., Newport Beach • Assistant Community Development Director Hewicker advised that the City had received very few com- plaints in the year the tennis court had been lighted. Planning Commission discussed adjustment and certification of the lights and enforcement of the conditions following complaints. Public hearing was opened in connection with this matter. Lewis Byington, President of the Lido Isle Commun- ity Association appeared before the Planning Commission to answer questions in connection with this matter and stated agreement with the condi- tions recommended in the staff report. Robert W. Wright, 21.7 Via Jucar, appeared before the Planning Commission in opposition to the request. William Sprague, Administrator for Lido Isle, appeared before the Planning Commission and advise of the set -up whereby the lights were turned on an off through the use of a hocked time clock. He • also advised that in checking with the Newport Beach Police Department five days ago, there had been no complaints. Andrews, 221 Via Koron, appeared before the Planning Commission and stated that since the lights have been installed, there were less prob- lems with the children and also verified that the guards do close the gates and turn off the lights at 10:00 P.M. There being no others desiring to appear and be heard, the public hearing was closed. Motion X Motion was made to approve the extension of Use All Ayes Permit No. 1632 subject to the following condi- tions: 1. The existing tennis court lighting fixtures ai Light shields (the interior surfaces painted black) shall be permanently maintained so as confine direct rays to the tennis court area and to obscure the light source from the following locations: • a) The northerly side of Via Lido Nord. b) The southerly side of the adjoining basketball court. c) The easterly side of Via Jucar. d) The westerly side of the adjoining strada. 0 2. The electrical panel containing the light switch shall continue to be provided with a keyed lock. The lights shall be turned off by 10:00 P.M., and the panel shall remain locked between the hours of 10:00 P.M. and 8:30 A.M. 3. To insure that the installation, maintenance and operation of said lights remain compatible with the residential uses of the adjoining properties, this approval shall be extended fo a three year period; any request for subsequen extension to be acted upon by the Modification Committee. That a six foot high masonry wall be constructed around the outer perimeter of the expanded parking area except for a twenty foot wide area to allow for a fifteen foot wide egress easement to Irvine Avenue. That a resubdivision be approved and a parcel map be filed. Planning Commission also requested that the staff refer the matter of traffic problems as discussed earlier to the Traffic Affairs Committee for revie and that a report be made back to the Planning Commission at their meeting of December 20, 1973. Mitchell Teemley, applicant, appeared before the Planning Commission to answer questions and pre- sented the Commission with a prepared statement relative to the parking. He stated that the majority of students would be children and the school intends to provide a bus service which would eliminate the need for a great deal of park- ing. There being no others desiring to appear and be heard, the public hearing was closed. Following discussion which included providing the bus service and requiring off -site parking should X the bus service prove unsatisfactory, motion was made to approve Use Permit Application No. 1702 subject to the following conditions: Page 16. That a maximum of 30 students or staff members be permitted at any one session between the hours of 8:00 A.M. and 5:00 P.M. 2. That the hour of operation shall not exceed the hour of 10:00 P.M. 3. That a free bus service shall be provided by the applicant for the use of those students desir- ing transportation between their homes and the school.
