OF THE NEWPORT- BEACH.CITY JMLL ROLL Commissioners Presents Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd. ' CALL: Commissioners Absents Briggs, and Wightman MINUTES. Commissioner Pleger made a motion to approve the minutes of the Planning Com- mission meeting.of October 19th, 1950 as submitted-to the Commission, seconded by Commissioner Rudd and carried. PUBLIC HEARINGS: Variance: Chairman Longmoor declared the hearing open on the first application of Fred C. Hamlin for a'50% rear yard variance on Lot 1, & 5' of Lot 2, Block 10, East Newport, and asked if anyone wished to speak for or against. Mr. Hamlin was present but had no comments. Commissioner Copelin stated that he, Mr. Nelson, and Mr. Longmoor had investigate&the�.ap�lication and that the variance was needed in order to construct a garage, and they felt that it would be in order to grant the variance. No. protests from adjacent property owners. Commissioner Copelin made a motion, seconded by Commissioner Pleger that the hearing be closed. Motion carried. Chairman Longmoor asked what action the Commission wished to take, and Commissioner Copelin made a motion that the variance be granted and that a resolution be sent to the City Council recommending its approval, Motion seconded by Commissioner Pleger_ and carried by the following roll call vote, to-wits AYES: Commissioners. Copelin, Ellerbrosk, Longmoor, Pleger, Reed, Rudd, & Smith.. NOES: Noss ' ABSENT: Commissioners. Briggs, and Wightman. Variance: Application of Robert H. Ingram for a 50'E) variance on Lot 15, Block 4, Section 59 (121 Bay Front, Balboa Island). Chairman declared the hearing open and asked for any comments. Gtr. Ingram was present but had no comments. Dis- cussion among commissioners. Commissioner Pleger moved the hearing be closedi seconded by Commissioner Rudd and carried. Commissioner Copelin then made a motion that recommendation for approval be sent to the City Council, seconded by Commissioner Rudd and carried by the following roll tail vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, & Smith. NOES: None ABSENT: Commissioners: Birggs, and Wightman. Variance: Application of'Lester R. Kelly for a variance on the Wly 30+ of Sly 49' Lot 10, Block 5, Section 5, Balboa Island (1706 Park Avenue) so that he may allowed a five foot setback on Park.Avenue. Thieves set over from the October meeting in order to contact Dr. Suess, the im- mediate neighbor to the East. Secretary Cope2An read Dr. Suess's letter stating that he was not in favor of granting Mr. Kelly the variance to the Commission. --Max Pope, building contractor: Said Mr. Kelly was unable to appear at either ' the last meeting or this meeting, but that he was aware of the letter of protest and felt that since the house west of his property was on the property line, he should be allowed to build out five feet. (Haase West-of his property is across the alley from him) Mr. Kelly would be appreciative of any consideration however. 131 Discussion. Commissioner Pleger moved.that.the bearing be...closed,..seconded.by Commissioner Copelin and carried. Commissioner Ellerbroek made a motion.that.the.application be denied, because did not feel that with all the property-remaining-to build on that the variance is necessary. No hardship involved and-neighbor is definitely affected.. Commis- sioner Pleger seconded the motion and was passed by the following roll call vote, to -wit: AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, and Smith. NOES: Nona ABSENT: Commissioners: Briggs, and Wightman. 2nd HEARING, AMENDMENT TO ZONING ORDINANCE #525. Owners of properties on the Ocean side of Ocean Boulevard, Corona del Boar, between the Sally prolongations of Larkspur Avenue and Poinsettia Avenue, have signed certain "Deloarations Concerning Restrictions" in connection with the imposed construction of an access road. The amendment is to eliminate the ten (10) foot setback requirement on the properties. Chairman Longmoor asked if there were any comments or anyone who wished to speak.' --BYark Soden, Attorney for W. T. Jefferson: Mr. Jefferson definitely wants to pro - test against any change in the 10 foot setback rule. Mr. Jefferson feels that the people petitioning for the setback are trying to enhance the value of their late and he feels that it ss unfair and unjust to people on the other side of the Boule- vard. Was asked by the Chairman not to go into the matter of 'sanitation since it is not within the jurisdiction of the Planning Commission. --Col. Andrew W. Smith, 516 Ocean Blvd, Corona del Mar: The doing away with the 10 foot setback is a breach of promise. When they bought the property, they were informed that there was a 25 foot setback on their side of the Boulevard which they could not go beyond. Unit see why it should be changed as everyone knew the set - back requirements when they bought. Dr. Burt bad a plan which.had included all the owners on the bluff lots, but since that time, the plans beve been juggled until 2/3's of the cost will be paid by the bluff lot dwners and 113 by the owners on the other side of the Boulevard'. They dropped Mr. Jefferson out of the assessment district because he was against it. One person has 'refused to sign and they will drop him, they'd like to drop me but I'm right in the middle of the thing. This is a private road to be benefited by people over there, and well have to pay 113 of it. Maintenance is going to be something. Everybody in Corona del Mar is interested in saving view, but you can't get 5% of the people in C D M to vote for .the road. - -R., W. Calderhead, 817 Coast Blvd. I am very much against the giving up of that 10 feet. The people bought that property down there the way it is and there's no.. reason that he can see for giving them the 10 feet. Would like to enter protest against the granting of the 10 foot setback. - -Dave Thomas, 226 Orchid Ave, CDM: Would like to go on record as,protesting the granting of the 10 foot setback. -- Wallace Calderhead, 712 Iris Ave, CDM. Would like to protest also. Maintenance cost will be too much. Much discussion. Commissioner Pleger made a motion to,close the hearing, seconded by Commissioner Smith and carried. Commissioner Smith made a motion that a recommendation be sent to the City Council that the zoning ordinance be amended to remove front yard ben (10) foot setback as 132 it applies on the South side of Ocean Avenue.. for that property which is .included in the "Deed of Restrictions" and provided.-that the. lower.access rosd.project is approved by the City Council. Motion seconded by Commissioner. Rudd. and carried by the fol- lowing roll call vote, to -wit: , AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Pleger, Reed, Rudd, and Smith. NOES: None ABSENT: Commissioners: Briggs and Wightman. Chairman Longmoor explained that it does not become effective unless the City Cm n- cil goes through with the entire project. COMMUNICATIONS: Secretary Copelin read a letter from the Central Newport Beach Community Association— Gentlemen: At the regular meeting of the Central Newport Beach Community Association, held Monday, October 16th, there was a full discussion upon the proposed Master Plan, especially in its relation to zoning Ocean Front property seaward of the sidewalk. Conclusion reached by unanimous vote was that the Ocean Front property seaward of the sidewalk be continued and Zoned as public property. It is the desire of the members that this property should remain forever under public domain, and we feel that the best assurance for this cannot be had if it is Zoned R -1. We have full confidence that no building permits or sale of this property will take place on the recommendations of the present City Council or the present Planning ' Commission. However, what a new City Council or a new Planning Commission would do in the future is problematical. We do not want to take such a gamble now or do 'any worrying about it in the meantime. Therefore, I have been instructed by the members of this Association in regular session to address this letter to the City Council and a copy to the City Planning Commission, protesting the proposed R -1 zoning of Ocean Front property seawal�d,of the sidewalk. We beg of you to give serious consideration to this protest.;`;,' Very truly yours, Edw. T. Healy, Pres. Commissioner Pleger made a motion to refer the.letter to the Planning Consultants for an answer, seconded by Commissioner Ellerbroek and carried. Chairman Longmoor asked if there was any new business to be brought before the Com- mission. - -Paul Swan, 661 Swarthmore, Pacific Palisades: August of this year, I purchased property at 208 Crystal on Little BalbrNi Island, (Lot 5, Block 5, Section 5). The property consists of a standard lot 30' x 801 plus a small triangular section to the rear of the lot. One of the terms of purchase was that permission would be granted to construct a garage apartment on the triangular portion, and therefore, closed the escrow. Upon presentation of plans to the Building Department, it has nbt been de- cided yet as to whether or not It11 be able to do this. Would like some kind of fuling on it. After much discussion on it, it was decided that the property was mis- represented to Mr. Swan and that he take it up with his escrow firm. The 4ommiesion discussed the new zoning plan and ordinance and it was decided that the following memo be sent to Mr. Wise, the planning consultant:- It is the consensus of the commissioners tbgt the side yard specifications in the zones of R-1. R -2, and R -3 for side yard setbacks should follow the same formula as in the old ordinance, also that the words 'building site' should be ' substituted for the word 'lot,' Also, that the terminology used in the new ordinance be incorporated in the combined zone. Commissioner Pleger made a motion that the proposed Land Use and Zoning Plan as' amended by said Planning Commission be re- referred to the City Council with the recommendation that said amended Land Use and Zoning Plan including precise zoning regulations be adopted. Motion seconded by Commissioner Copelin and carried by the following roll call vote, to -wit: 1 i �J 133 AYES: Commissioners: Copelin, Ellerbrosk, Longmoor, Pleger, Reed, Rudd, & Smith. NOES: None ABSENT: Commissioners: Briggs and wightman. ADJOURNMENT: There being no further business, Commissioner Pleger made the motion for adjournment, seconded by Commissioner Rudd and carried.
