Briggs, Keene MINUTES: Minutes of the meeting on October 20th were.approved on motion of Comm. Copelin, seconded by Comm. Rudd, and carried. Variance Application of Mr. Harvey D. Pease of 498 Park Ave., Balboa Island, to seek,relief of that portion of the zoning code requiring 'side -yard' set - #253 backs for a corner reversed frontage setback situation. The applicant also seeks waiver of off - street parking restrictions, as well as exception from Pease, Harvey the.front yard set -back as existing on therremainder of the block. The property is further located on Lots 22 & 23, Blk 8, Section 1 .. Lots.22 & 23, NOTES: Blk 8, Sect. 1 There is a 6 ft, setback maintainedaalong Agate Ave. on the remainder of the block abutting the property. The side setback along Park Ave. would apparently be 3'. All existing structures are non - conforming. The appli- GRANTED cant proposes the erection of a swimming pool, and the operation of a private invitational school of physical education, for boys and girls under the age of 14. All in a C -1 -H zone. FINDINGS: Comm: Lind moved that the applicant be required to maintain six off- street.parking spaces, as well as the erection of new construction six feet from the Agate front and five feet from the alley line. Waiver of side yard setbacks was granted. Comm. Copelin moved that the Commission recommend,the GRANTING of this application in compliance with the conditions requested, seconded.by Comm. Smitth, and carried by the following roll call vote, to wit: ALL AYES V -254 Application of Miss Clyde Maynard of 609 Larkspur, CDM for the waiver of front yard setback requirements. The request concerns the construction Maynard, Clyde of a garage recessed 52' from the side walk. The property is located in an R -2 Zone, on Lot 9 of Block 637. Lot 9, Blk 637 NOTES: This site is one of the older developments in CDM, and the exist- ing small home is very poorly located on the lot for proper improvements, however, present day standards are maintained as to required side and DENIED rear setbacks. There is no garage or parking facilities on the building site at present, and the Building Dept., felt the best utility of land would be maintained if a portion of the home were dismantled and a garage designed so that the alley might be used for ingress and egress. Miss Maynard felt this cu uld be too costly. FINDINGS: The Committee investigating this problem reported that there were many structures in the area developed-in a similar manner; and the requests would probably become burdensome were this request granted. It was also felt this proposal might hamper the proper development of the neighborhood. Comm. Rudd moved the Commission recommend the DENIAL of this application seconded by Comm. Hayton and carried, bytthe following roll call vote, to wit: ALL AYES Application of Mr. Ernest Ross, for the privilege of constructing a garage to within 18" of a required 3' side yard setback. The property V -257 is located at 317 E. Bay Front, Balboa Island, Lot 27, Tract 742, in an R- 2 Zone. Ross, Ernest NOTES: The side -yard in question is contiguous with a public walk- way of 10 ft, a fact which the owner points out would in principle Lot 27 create a 13 ft. area between buildings, rather than the required Tract 742 6 ft. The Building Dept. understands this request has been permitted in the past, on a variance. FINDINGS: This request appeared to the Commission; to be in line with grants made in the past for similar conditions. Comm. Lind moved that the Commission recommend the GRANTING of this application, seconded by Comm. Smith, and carried by the following roll call vote, to wit: ALL AYES Application of Mr. George S. Fruehling, of 130 Via Lorca, Lido Isle, V -255 for the privilege of waiving a side yard requirement of 18" in order to construct book shelves in this additionally acquired area. The Fruehling, property is further located on Lots 629 and 630, in the 907 Tract. George.S. NOTES: Similar construction does exist on another portion of the lot, however, the 18" appears to be a 'tract' requirement. This in view Lots 629, 63( of the fact that the prints had been stamped by the Lido Isle Tract 907 Architectural Committee. The applicant feel& the small area of the building site makes it necessary to have more storage space for GRANTED household necessities. The existing block wall would be considered fireproof, and construction is not continuous, area touching the wall would be approximately (6 ft. x 4 ft.) FINDINGS: The Committee reported sufficient buffer area from neigh- boring properties, and fire hazards, existed from the establishment of a public walkway adjacent. It was not considered detrimental to the nighborhood to permit Mr. Fruechling, to build to the block wall. Comm. Rudd moved the Com®ission recommend the GRANTING of this appli- cation, seconded by Comm. Copelinland carried by the following roll call vote, to wit: ". 'ALL AYES Application of Mr. Charles W. Masters, for the privilege of permitting V -256 a one -foot front setback, in place of the required 10' setback, at 316 -318 Hazel Dr., in Corona del Mar. The building site is further Masters, Chas. located on Lots 50 and 51 of the 'A' Block, in Tract 673. W. NOTES: The applicant mentions that this R -1 site has been developed in a similar manner by neighbor properties. The for is on a very steep Lots 50 & 51 ' grade, dropping 20 ft. in 30', and Mr. Masters feels it would hot be Blk. A possible to construct necessary footage, economically, were he compelled Tract 673 to maintain a 10' front setback. FINDINGS: The Committee reported this was just a request for a repetition of that which has been granted the neighbors. Commissioner Smith moved that the Commission recommend the GRANTING of this application, seconded by Comm. Hayton, and carried by the following roll call vote, to wit: ALL AYES Application of Mr. Ernest Ross, for the privilege of constructing a garage to within 18" of a required 3' side yard setback. The property V -257 is located at 317 E. Bay Front, Balboa Island, Lot 27, Tract 742, in an R- 2 Zone. Ross, Ernest NOTES: The side -yard in question is contiguous with a public walk- way of 10 ft, a fact which the owner points out would in principle Lot 27 create a 13 ft. area between buildings, rather than the required Tract 742 6 ft. Cooper, for the privilege of constructing an additional accessary storage room (8' x 12') to protrude six feet into Cooper, Clarencthe required 10' rear yard setback. The property is located adjacent to the Beacon Bay area t 116 Harbor Island Rd., in the 5th Block of Block 5, Tract 2172 R -1 zone. FINDINGS: Since there was no alley involved, the Committee could see no reason for denying this application. Comm. Rudd moved that the Commission recommend the GRANTING of this application, seconded by Comm. Reed and carried by the following roll call vote, to wit: ALL AYES V -259 Application of the Macco Corp. for a variance of the rear -yard setback from a required 10'0" to 6'6" for a proposed dwelling to be located at Macco Corp. 1301 Bonnie Doone Terrace, on Lot 61, in Tract 1700, of the Irvine Terrace and located in an R -1 zone. Lot 61, R -1 NOTES: It is requested that the rear yard to interpreted as a side yard Tract 1700 in order to utilize the lot to better advantage. The sub - divider feels Irvine Terr. this setback will be in line with adjoining 'building site' developments. Tract The tract is harmoniously developing in a staggered setback manner. FINDINGS: The Commission concurred with the applicant's views. Comm. Copelin moved the Commission recommend the GRANTING of this application, seconded by Comm. Hayton, and carried by the following roll call vote, to wit: ALL AYES V -260 Application of the Macco Corp, for a variance of the front yard setbacks, , which shall consist of 10' on Bonnie Doone Terrace, and 15' on Patolita Macco Corp. Drive, this for the purpose of a'proposed new dwelling to be located on Lot 73 of Tract 1700, at 721 Patolita Drive, in an R -1 Zone. Lot 73 NOTES: The applicahtostates this will conform with the original approval Tract.1700 of the district map in allowing staggered setbacks. It was further stated that this variance was inadvertently left out of the original requests for setbacks. FINDINGS: It was found that this request was in keeping with the orig- inal requests for the over -all plan of the tract. Comm. Copelin moved that the Commission recommend the GRANTING of this application, seconded by Comm. Lind, and carried by the following roll call vote, to wit: ALL AYES V -261 Application of the Lido Professional Bldg., Inc. (Mr..G. M. Shumaker, pres.) for the granting of a waiver of car parking stall requirements, Lido Prof. namely relief from the 'off- street' 84 spaces, required by Newport Building Beach's Zoning laws. The property has been assigned an address of 3355 Via Lido, Newport Beach, Lot 5, on Lot 5, of Tract 1117 and zoned C -1 -H. Tract 1117 NOTES: Mr. Shumaker feels he could adequately care for this parking problem by supplying 73 spaces. He feels he would be deprived of more valuable usage of the land, were he required to devote more space for parking. There is a portion of Via Oporto which the City of Newpdut is requesting be opened for traffic. A RESUBDIVISION APPLICATION for ' this 'metes and bounds' parcel of land, IS ON THE AGENDA. COMM. COPELIN HAS REQUESTED THAT THIS MATTER BE GIVEN PRIORITY IN THE DIS- CUSSIONS OF THIS EVENING. Ire Application of the Newport Balboa Savings and Loan Association to resubdivide a parcel of land described as a portion of Lots 4 & 5 of Tract 1117 and further located at 3366 Via Lido, in Newport Beach. Legal description on file. NOTES: The.purpose of this application is to create a legal building site of record, for the installation and erection of a professional 'office building'. This parcel of land has been defined and sold by 'metes and bounds', in the past. There is to be a USE PERMIT No.. 202 processed, in conjunction with these requests for waiver of certain 'off - street' parking requirements .;and the - RESUBDIVISION. T 183 RESUBDIVISION #22 Lots 4 & 5 Tr. 1117 Lido Prof. Building wu e . 11 -. ..' - -- USE PERMIT Application of the Lido Professional Bldg., Inc., and Mr. G. M. Shumaker, #202 for the privilege of extending a proposed structure beyond two stories as limited in the Newport Beach City Zoning Code. Mr. Shumaker seeks Lido Prof. relief under Section 9103.53(a) of the (C -1) zoning regulations. The Building building will be located at 3355 Via Lido, on a portion of Lot 4, in Tract 1117 of a.0 -1 -H zone. NOTES: The applicant proposes a pent house (2 units) above a two story office building. The height limit will be approximately 10' in excess of the residential, 2 story height. However, 70' might possibly be permitted, under a use permit in this C -1 zone. FINDINGS: Resubdivision #22. Mr. Harwood of the Newport - Balboa Savings and Loan Assoc., mentioned the abandoned alley which separates Lots 4 and 5, by twenty feet. He stated that some seven years ago this public thoroughfare was vacated by the City and the resulting parcel of land was regarded as a building site, by his company. Mr. Emory Hanson, traffic engineer, employed by Mr. Palmer, wished to go on record as assuring all interested parties that access shall be provided for the publics convenience, at all times. The churches involved, were partic- ularly concerned about his guarantees, that ingress and egress shall be provided to their property. Mr. Hansen suggested a private easement as an adequate guarantee. The City of Newport Beach took exception to this recommendation and pointed out Mr. Shumaker's specific interest in dedicating his portion of land for JRubiic Right of Way. The Griffith Co. was also shown to favor the dedication of land required by the City. It was therefore gegarded as the Saving and Loan Company's responsibility to satisfy street land requirements for anticipated public traffic. All parties of interest agreed the character of the street should not change, were these requests granted; therefore, the applicant's reluctance in dedicating the land needed adjacent to the proposed parking area, was confusing. Mr. Hanson explained that Mr. Palmer was vacationing in San Juan, Porto Rico, and could not be readily contacted. Comm. Longmoor moved, the Commission recommendathe CONDITIONAL GRANTING of this application provided the authorization, so granted, shall be contingent on the owners of the property in question, so dedicating their portion of land, as required by the City of Newport Beach, for *Public Uninhibited passage', seconded by Comm: Copelin, and carried by the following roll call vote, to wit: ALL AYES Variance #261..... ' The Commission concurred with the applicant's views, namely, that parking could be adequately cared for in regards to future demands were the Via Oporto street also considered in computing needed 'off - street' parking. Comm. Smith moved that the Commission recommend the GRANTING of this application subject to the dedication of land for 'public right of way' as needed, seconded by Comm. Reed, and carried by the following roll call vote, to wit: ALL AYES 184 USE PERMITS #201 Irvine Co. & Coast Hotels Lot 445 Block 94 Use Permit #202.... Approval of the three story design was given provided residential set- backs were adherred to, and other requirements as specified for the overall development were complied with. Comm. Lind moved the applicant be GRANTED use permit #202, seconded by Comm. Lind, and carried by the following roll call vote, to wit: ALL AYES REQUEST for Waiver of 3 parking stalls for a Mr. Reilly, Jeweler... for relocation of an existing store in the block to be occupies by 'The Lido Professional Building'. Comm. Copelin moved that the applicant be GRANTED a waiver of parking needs since this will be in compliance with the overall program of developddng the Lido Professional Building Square, seconded by Comm. Lind, and carried by the following roll call vote, to wit: ALL AYES Application of the Irvine Company & Coast Hotels, Inc. for a permit to construct andooperate a motel, restaurant, and Cocktail lounge, as well as related activities. The property has a recently assigned address of 2101 Coast Highway; the restaurant will be located at 2171 Coast Highway on Lot 445, Block 94 of Irvine's Subdivision. And shall be further located as the 400 Northeasterly feet of the tract along the Coast Highway, and the 600 feet prolongation along Avocado Ave. NOTES: The motel shall eventually consist of 108 units. It has been agreed that more than adequate 'off street' parking for both operations shall be provided. FINDINGS: Residents of interest presented protests to that portion of the application which referred to 'related activities'. Ingram and Collins, contractors, agreed to delete that portion of their request and confine activities of this operation to a Restaurant, Motel, and Coctail'Lounge. It was agreed the new road supplementing Avocado shall be 110 ft. wide. Comm. Copelin moved the Commission recommend the GRANTING of the application as above conditioned, seconded by Comm. Rudd, and carried by the following roll call vote, to wit: AYES: Lind, Smith, Rudd, Reed, Copelin, Longmoor NOES: Hayton UP -203 Application of Mr. F. Edward Parker, of 278 Flower St., Costa Mesa, to operate an auto repair service (foreign) for the benefit of sports car Parker, F. enthusiasts at 2300 West Ocean Front, Newport Beach. The property is Edward located in a C -1 Zone on Lots 1 & 2 of Block 23. NOTES: Lots 1 & 2 A small machine -shop type of operation is planned, which shall concern B1. 23 the use of lathes, drill presses, compressors, etc. Structural alteration of the front portion of the building is also planned. The applicant is also requesting curb - cutting permit privileges. FINDINGS: Neighbors mentioned opposition to the noise which might develop from this activities. The Commission did not feel this was a suitable location for the activity as planned. Comm. Reed moved that the Commission recommned the DENIAL of this application, seconded by Comm. Hayton, and carried by the following roll call vote; ALL AYES t 0 U 185 Application of the Irvine Co. and Lou Reed, and Associates, for a permit to display and sell, new and used cars. The property is located on the UP -204 Placific Coast Highway, on Lots 12 and 13, in Tract 1210, of the Irvine Subdivision. All in a Z -1 -H zone. Addressed assigned: 500 West Coast Irvine Co. & Highway. Lou Reed & NOTES: The applicant mentions this property to be operated in conjunction Assoc. with the Lou Reed Chrysler Agency, located on the westerly portion of Tract 1210. FINDINGS: The Commission concurred with the applicant's view and approved of his requests providing '4' off - street customer parking stalls:: were assigned. It was also required that a permanent office building (approx. 8 x 16) be required. Comm.. Lind moved that the Commission recommend the GRANTING of this application as so conditioned, seconded by Commissioner Smith, & carried by the following roll call vote, to wit: ALL AYES Application of the Irvine Co., P.O. Box 37, Tustinq Calif. for the privilege of using an R -3 parcel of land abutting the C -1 -H district used by the Villa Marina Restaurant. The property is located on the South side of Bayside Drive. NOTES: Section 9105.1(e) grants permission for the operation of a public or no fee private parking lot in an 'R' zoned district adjacent to any 'C' district, on a 'use permit'. This use, if permitted, will be for the expanding needs of the Villa Marina Restaurant. The area in question shall be taken from the Ken Nile's Motel. FINDINGS: The Commission concurred with the applicant's views. Comm. Copelin moved that the Commission recommend the GRANTING of this appl- ication, seconded by Comm. Reed, and carried by the following roll call vote, to wit; ALL AYES Application of Mr. & Mrs. K. V. Dilts, 230 Larkspur Ave., Corona del Mar, to resubdivide a parcel of Land described as the Northeasterly rectangular Lots 12 & 13 Tr. 1210 UP -205 Irvine Co. 10 ft. of Lot 24, all of Lot 25, and all of Lot 28. (70 foot frontage AMENDMENT in all). and further located in Block 138 in an R -1 district. #16 NOTES: The applicant has been unable to secure the signature of the neighboring property owner, in order to establish a legal building site for the remainder of the block. Hayton knowing the area very well, felt this application should be approved. He flit the block needs this type of enlarged building site. Comm. Hayton moved that the Comm. recommend the GRANTING of this application, seconded by Comm. Reed, and carried by the following roll call vote, to wit: ALL AYES Petition of E. Morris Smith to amend the provisions of Ordinance No. 635. The property under consideration is located in an R -2 zone, and Mr. Smith feels the community of Corona del Mar, would be more adequately served, were these lots re -zoned C -1 -H. This, for the purpose of establishing a 'drug store' outlet for the Lonnie Vincent Firm. The parcel of land is further located in Block 436, Lots 1, 2 4, 6, 8, 10, also Block H, Lot 3. I It is also bounded by Jasmine and Iris Streets, and First Street and I the Coast Blvd. FINDINGS: The Commission expressed a hope that this application, if granted, would not weaken the Zoning structure, as it now exists in Corona del Mar. There was no opposition present at this first 'reading'. The second 'reading' shall take place Dec. 15, 1955, before this application is sent to the City Council. The business at hand being completed, the meeting was adjourned on motion of Commissioner Hayton; seconded by Comm. Smith, and carried. Ray Y. Copelin Secretary
